NetMarketShare: Mac, Safari, iOS gain market share
Safari and iOS market share for Internet usage rose from August to September, while the Mac OS X percentage dipped slightly, according to the latest market share survey from NetMarketShare (http://www.netmarketshare.com). According to the report, among operating systems, Mac OS X had 5.03% of the global market share in September, compared to 5% in June (that's global market share; in the US it's almost 10%). Windows remains dominant with 91.08% as of September. That's up from from 91.34% in August. Apple's highest percentage previously was 5.27% in October 2009. When it comes to browsers, Safari had 5.27% in September compared to 5.16% in August, while Internet Explorer had 59.65% Firefox had 22.96% and Chrome had 7.98%. That compares to, respectively, August percentages of 60.40%, 22.93% and 7.52%, for the browsers. The iOS's market share also rose, according to NetMarketShare. Apple ordered to pay damages to Mirror World
Apple has been ordered by a jury to pay damages to Mirror Worlds for infringing patents related to how documents are displayed on a computer screen, reports "Bloomberg" (http://www.bloomberg.com/news/2010-10-01/apple-loses-mirror-worlds-trial...). The federal jury in Tyler, Texas, awarded $208.5 million in damages for each of the patents infringed. "Bloomberg" says the verdict form was unclear as to whether the amount applies to the three patents collectively or would be charged individually. Lawyers for closely held Mirror Worlds declined to discuss the verdict. In 2008 Mirror Worlds Technologies, a Texas based company, accused Apple of violating four distinct but related patents that touch on creating "streams" of documents that are automatically sorted according to time stamps, including future dates assigned to calendars and other reminders. iTunes virus making the email rounds
A message from do_not_reply@itunes.com has been plaguing iTune users' inboxes, reports "WKBN" (http://www.wkbn.com/content/news/local/story/iTunes-Virus-Hits-Emails/rq...). It claims you owe money -- and even some without iTunes accounts have received the email, the article says.  Representatives from Apple said this is a very new virus and they are working to get the issue under control.They said to delete the email from your inbox and do not click on any of the links provided.

Apple settles music distribution lawsuit
Apple has become the latest defendant to settle infringement allegations from Sharing Sound LLC over a patent for online music distribution, joining Microsoft, Napster LLC and others, reports "Law360" (http://macosg.me/2/x6). Judge David Folsom of the U.S. District Court for the Eastern District of Texas signed off on the settlement Wednesday, clearing Apple of allegations that it on a Sharing Sound patent for "distribution of musical products by a website vendor over the Internet." Apparently, Sharing Sound is using the broad patent to rake in money from as many companies as it can because apparently the company "has never managed to use its patented technology to produce anything, or at least not anything interesting," says "TechCrunch" (http://techcrunch.com/2010/10/01/apple-itunes-sharing-sound-settlement/?...).

NPD Group: iPad not cannibalizing the PC market
Contrary to popular belief, the iPad isn't causing cannibalization in the PC market because iPad owners don't exhibit the same buying and ownership patterns as the typical consumer electronics customer, according to the new "iPad Owner Survey" from market research company The NPD Group (http://www.npdgroup.com). According to the report, only 13% of iPad owners surveyed bought an iPad instead of a PC, while 24 % replaced a planned e-reader purchase with an iPad. iPad owners, especially the consumers who purchased an iPad within two months of launch, are significantly more likely to own Apple products and newer technologies, such as e-readers and smartphones. iPad owners are much more likely than the overall population to own Apple computers, with 48 % owning a Mac desktop or Mac notebook, while NPD's "Online Household Penetration Study" fielded earlier this year found Macs in only about 11% of households. Olympic Developments sues Apple, others for patent infringement
Another day, another lawsuit. A private Delaware company by the name of Olympic Developments AG, LLC, has filed a patent infringement lawsuit in the California Central District Court Los Angeles Division against several major technology companies, including Apple, reports "Patently Apple" (http://www.patentlyapple.com/patently-apple/2010/10/olympic-developments...). The lawsuit appears to involve the sale of goods through Apple's iTunes and App Stores via an iPad or iPhone, the article adds. Sintek Photronics has reportedly sent samples of projected capacitive touch panels to Apple to be incorporated in upcoming iMac, reports "DigiTimes" (http://www.digitimes.com/news/a20100930PD213.html), quoting "industry sources." Apple’s AirPlay could revolutionize consumer audio

ChangeWave: Android OS makes another leap
For more than a year, ChangeWave (http://www.changewave.com) consumer smart phone surveys have been chronicling the upward movement of the Google Android operating system and its impact on the smart phone market. Going forward, the research group's latest consumer survey shows another surge in Android momentum among planned buyers. ChangeWave's survey of 4,000 respondents, completed Sept. 23, takes a close-up look at the transformation occurring in mobile OS and smart phone preferences. Back in June, the launch of the iPhone 4 temporarily slowed the rise of the Google Android operating system. But the research group's latest survey shows the Android OS is once again making major advances in the smart phone market. Among consumers planning to buy a smart phone in the next 90 days, 37% say they prefer to have the Android OS on their new phone. That's a seven-point jump since ChangeWave's previous survey and a new all-time high for the Google operating system.

iPad leads the tablet charge as mini-notebook shipments plummet
In the second quarter of 2010, shipments of mini-note/tablet computers were down 4% quarter-to-quarter (Q/Q), but up 29% year-over-year (Y/Y). However, without the 3.3 million iPads shipped in the quarter, shipments of mini-note/tablet PCs would have been down 14% Q/Q and 13% Y/Y. Clearly, there was an “iPad Effect” in the portable computer market, according to a new DisplaySearch report (http://www.displaysearch.com), which also tracks tablet computers five inches and larger. The effect might have been even more pronounced, but Apple struggled to fill demand, with shipment times listed as 7-10 business days for all of the second quarter of 2010 (Q2’10), and shipments into Japan and China were just beginning at the end of the period, says the research group. Analyst keen on iPhone, iPad, iPod shipment levels
In a note to clients -- as reported by "Barron's (http://blogs.barrons.com/techtraderdaily/2010/09/30/apple-stifel-repeats...), Stifel Nicolas analyst Doug Reid today repeats his Buy rating on Apple, boosting his price target on the stock to $360, from $350. Rep blasts Apple for 'discriminatory practice' against...
A former National Assembly representative has launched a one-man campaign protesting Apple's "discriminatory practice" of denying Taiwanese buyers of iPhone 4 protective sleeves, reports "Asia NewsNet" (http://www.asianewsnet.net/news.php?id=14666&sec=2). Kao Chia-yu launched the campaign because buyers of the iPhone 4 haven't received protective sleeves for the latest model of the smartphone as promised by CEO Steve Jobs. Jobs said earlier that those who purchased iPhone 4 by the end of September would get a free protective sleeve from the company to help with the antenna reception problem experienced when you hold the phone a certain way. Taiwan's top three telecom carriers, namely Chunghua Telecom, Taiwan Mobile, and FarEastone Telecom started to sell the iPhone 4 on Sept. 17. However, none have protective sleeves for the iPhone 4.

Apple making inroads into enterprise area
Small businesses and large corporations alike are beginning to embrace Apple by supporting and purchasing iPhones, iPads and Macs for their employees and by creating applications for their customers' Apple devices, according to "CNN Money" (http://money.cnn.com/2010/09/29/technology/apple_enterprise/index.htm?so...). In July Apple Chief Operating Officer Tim Cook said that 50% of Fortune 100 companies are already deploying or thinking about using the iPad for corporate use and 80% were supporting the iPhone. A newly announced settlement in a class-action lawsuit against graphics maker Nvidia has entitled owners of a number of notebook computers, including two of Apple's MacBook Pro models, to repairs or monetary compensation, reports "AppleInsider" (http://www.appleinsider.com) Case No. 08-cv-04312-JW relates to Nvidia chips found in some Dell, HP and Apple notebooks sold between 2005 and 2010. For Mac owners, the suit relates to 15- and 17-inch MacBook Pro models sold between May 2007 and September 2008. GoPro releases HD Hero 960 wearable camera
GoPro (http://www.GoPro.com), a wearable HD camera company, has released the HD HERO 960, an entry level, US $179 version of the HD Hero camera. It shares the same video and audio capture technology but with resolutions on the HD Hero 960 limited to 960p (1280 x 960) and 720p (1280 x 720) at 30 frames per second, and WVGA (848 x 480) at 60 frames per second. Also removed from the HD Hero 960 is the Hero Bus expansion port present on the 1080p HD Hero. The Bus allows for LCD, secondary battery and additional expansion BacPacs to be attached to the original 1080p HD HERO camera, but not the HD HERO 960. China Unicom sells 100,000 iPhone 4s in four days
China Unicom sold 100,000 iPhone 4s in the first four days the Apple smartphone was on sale in China, reports the IDG News Service (http://www.computerworld.com/s/article/9188599/China_Unicom_sells_100_00...). Earlier in the week, the mobile carrier reported that 200,000 users had pre-ordered the product. China Unicom has already stopped online reservations for iPhone 4, and is instead asking users to come directly to retail stores to sign up for the device, says IDG. Survey: Americans oppose mandatory FM tuners in cell phones
Seventy percent of cell phone and smartphone owners aren't interested in receiving FM radio broadcasts on their phone, according to a new survey from the Consumer Electronics Association (CEA). The study, "FM Tuners for Cell Phones -- Measuring Consumer Interest," found most consumers aren't interested in having FM tuners in their mobile devices, and an even broader majority (80 %) doesn'tt support a government mandate that would force manufacturers to include an FM tuner in mobile phones. Hulu Plus headed to Roku, TiVO
Hulu Plus, the premium subscription service from Hulu, is coming to several devices this fall, including Roku and TiVo Premiere set-top boxes. Alas, the revamped Apple TV doesn't seem to be among them. In addition to Roku and TiVo, Hulu Plus will also be appearing on the Xbox 360 early next year and support is expected to be added to the next Xbox Live beta, reports "Mashable" (http://mashable.com/2010/09/28/hulu-plus-roku-tivo/?utm_source=feedburne...). Another day, another lawsuit. Apple has sued Nokia in Britain, reiterating the claims it has already made in a lawsuit in the US, reports "Reuters" (http://www.reuters.com/article/idUSTRE68R45G20100928). The whole legal brouhaha has a convoluted background. In May Nokia announced the filing of another lawsuit against Apple, in Federal District Court in Wisconsin, regarding five of Nokia’s patents. As I suspected, Apple's Tim Cook isn't considering going to HP as CEO, despite rumors to the contrary. More than 500 medical students at the University of Leeds are being issued with iPhones which can access online text books, reports the BBC (http://www.bbc.co.uk/news/education-11427317). The iPhone has been knocked off the top spot of Britain's Cool Brands index by Aston Martin, reports "Telegraph UK" (http://www.telegraph.co.uk/technology/apple/8028268/iPhone-knocked-off-C...). Survey: iPad owners skew younger, male
"Advertising Week" has published the results of a Nielsen survey (http://blog.nielsen.com/nielsenwire/consumer/the-connected-devices-age-i...) of 5,000 consumers who own a tablet computer, eReader, netbook, media player or smartphone -- including 400 iPad owners. The survey found, among other things, that iPad owners skew younger and more male. Analysts: next iPad won't arrive until June 2011
Analysts at Goldman Sachs Group have told clients -- as reported by the San Jose Business Journal (http://sanjose.bizjournals.com/sanjose/stories/2010/09/27/daily19.html?a...) that Apple may roll out a thinner iPad with a built-in camera and mini-USB drive by June, later than some others have projected. The Sellers Research Firm (that's me) thinks we'll see a new iPad sooner than June, but not in time for the holiday season as some have predicted. My forecast: look for a new iPad around March. Also, I'm 99% sure the next iPad will have a built-in camera. I'm less certain about a mini-USB drive (though that would be great) and the rumored seven-inch iPad. File this one under the dubious category, but rumors are flying that Apple Chief Operating Officer Tim Cook is leaving Apple for HP. Analyst: iPad may outsell rivals 4-to-1
In a note to clients issued Monday morning, Canaccord Genuity's T. Michael Walkley said -- as reported by "Fortune" (http://tech.fortune.cnn.com/2010/09/27/can-anybody-beat-the-ipad/?sectio...) -- that Apple's iPad may outsell its nearest rivals 4-to-1 in 2011 as Android tablets "struggle." "Given the iPad's time-to-market advantage, superior user interface, and leading application ecosystem, we believe Apple will maintain both market share and value share leadership in 2010 and 2011 for this new product category," Walkley told clients. "Based on leading content for its iPad device, we believe demand for iPads will likely remain ahead of Apple's ability to supply iPads in [the second half of 2010]. Should iPad production continue to ramp, we believe our 13.4M estimate for 2010 and 25.5M estimate for 2011 could prove conservative."

Digital music sales go flat in the US
The Nielssen research group says the rapid rise of digital music sales has stalled in the United States, the world's biggest and most important market, with sales in the first half of 2010 flat compared with a year before. However, digital music sales were up 7% in Britain, up 13% in Germany and up 19% in France. Nielsen says digital sales were flat in the U.S. market after a 13% increase from 2008 to 2009 and 28% growth from 2007 to 2008. Jean Littolff, managing director of Nielsen Music, told "Reuters" (http://www.reuters.com/article/idUSTRE68Q2FM20100927) the flat U.S. sales could be due to weak consumer confidence, the appeal of new music releases and confusion over the many different ways people can buy music online. The Department of Justice announced that it has reached a settlement with six high technology companies -- Apple, Adobe, Google, Intel, Intuit and Pixar -- that prevents them from entering into no solicitation agreements for employees.   The Department said that the agreements eliminated a significant form of competition to attract highly skilled employees, and overall diminished competition to the detriment of affected employees who were likely deprived of competitively important information and access to better job opportunities. EU drops probe into Apple
European Union competition regulators have dropped a probe into Apple, after the company agreed to relax restrictions on the iPhone, reports "Macworld UK" (http://www.macworld.co.uk/ipod-itunes/news/index.cfm?newsid=3241048). Apple has agreed to introduce cross-border iPhone warranty repair services for EU purchasers and relax restrictions on development tools for iPhone applications. Apple has now appointed service providers to "offer cross-border iPhone warranty services in those member states where Apple does not directly take charge of repairs," the Commission said. The change in Apple policy should make it easier for iPhone customers to get repairs under warranty in a EU country other than where the smartphone was purchased, notes "Macworld UK."

Apple is the most highly covered tech company
It's no surprise, but it's official: Apple is the most highly covered technology company, according to a new study by the Pew Research Center’s Project for Excellence in Journalism. Forty-two percent of the stories about Apple described the company as innovative and superior, and another 27% lauded its loyal fan base. Still, there were doubts. According to the Pew Research Center, the most common such negative thread, that Apple products don’t live up to the hype, appeared in 17% of stories about Apple.  For Google, the company’s advancements in making content easier to find topped its coverage at 25%. But it was only half as likely as Apple to be framed as having superior, innovative products (20%).

iAd cutting into search giants' mobile ad shares
Google, Microsoft, and Yahoo! have swiftly lost share in the U.S. mobile advertising market to Apple's new iAd, reports "Bloomberg Businessweek" (http://www.businessweek.com/technology/content/sep2010/tc20100926_023792...). QuickBooks 2011 for the Mac is now on sale from Intuit (http://www.intuit.com). The latest version of the financial software is available Sept. 28 at a suggested retail price of US$229.95 for a single user license. QuickBooks 2011 for Mac features new reports and tools to help users track job-related mileage so they can claim the tax write-offs they deserve. Users can also customize reports and forms to reflect their brands and to show the exact data they need to show, says Dan Wernikoff, vice president and general manager of Intuit’s Financial Management Solutions division. He adds that two new features ensure that QuickBooks 2011 for Mac can grow as a small business expands: ° Multi-User Access allows up to five employees to simultaneously view and edit QuickBooks data files. ° User Permissions lets small businesses determine who can work in up to eight accounting activity areas. hsc releases Outlook Message Parser Plug-in
hendrickson software components has released their first REAL Studio plug-in, the Outlook Message Parser Plug-in (http://www.hendricom.com/omppreview.html). It enables REAL Studio (REALbasic) developers to parse Microsoft Outlook Structured Storage (.MSG) files in a cross-platform development environment, including Windows, Macintosh OSX, and Linux. Jumsoft releases new iWeb themes
Jumsoft (http://www.jumsoft.com) has released new themes for iWeb, the web site creation component of Apple's iLife suite. The new set offers 20 design themes suitable for multiple types of web sites, including 11 addition. The new iWeb themes collection contains nine reworked themes from previous releases, and 11 new ones. The refreshed classic themes include Magic Sound, Sail Away, and Paradise (now called Bold Shapes). The new designs range from slick Comfort Zone to '70s inspired Stereo 77 to the healthcare-related Supreme Care. The set also includes a number of business-oriented themes with more subtle styling, such as Basic Info and Silver Shadow. Each theme contains eight page variations such as Home, Album, and About Me. Jumsoft's iWeb themes require iWeb 2.0 or later. The iWeb Themes Bundle is US$69. You can buy individual themes for $12.99 each.

Google, Apple extend search engine deal
In February, there was some speculation about Microsoft having a very good chance at landing a deal with Apple to make Bing become its default search engine for the iPhone. However, Google will apparently remain the default search engine for now. Google CEO Eric Schmidt says their search contract had been "recently extended," but didn’t get into any particulars, reports "Search Engine Journal" (http://www.searchenginejournal.com/google-apple-extend-search-deal-for-i...). Apple was reportedly receiving about US$100 million a year in search revenue from Google with the deal it previously had inked with them.

China Unicom says iPhone 4 demand outpaces supply
China Unicom said Sunday its supply of iPhone 4 handsets isn't enough to meet demand but that it will boost its stock as quickly as possible, as sales began at a much faster pace than when the network operator first launched older versions of the iPhone last year, reports "MarketWatch" (http://www.marketwatch.com/story/china-unicom-says-iphone-4-supply-short...?). China Unicom had taken over 200,000 iPhone 4 pre-orders by early Saturday, the day sales started, and over 40,000 buyers received the phone and a bundled mobile service plan that day, the company said in a statement. For comparison, China Unicom sold 100,000 iPhone handsets in roughly six weeks last year after launching the devices in late October. "More iPhones will be available soon and customers should check back with their local store or online for updates on availability," Apple spokeswoman Carolyn Wu told "MarketWatch."

Apple releases iTunes 10.0.1
Apple has released iTunes 10.0.1. You can obtain it via the Software Updates component of Mac OS X's Systems Preferences app. The update adds a Ping sidebar in which you can "Like" or "Post" about music from your iTunes library. Plus, you can see the recent Ping activity of a selected artist in your library, or of all artists and friends you follow on Ping. iTunes 10.0.1 also fixes several bugs; namely it: ° Addresses an issue where the picture quality of a video changes depending on whether the on-screen controls are visible; ° Resolves an issue where iTunes may unexpectedly quit while interacting with album artwork viewed in a separate window; ° Fixes a problem that affects the performance of some third-party visualizers; ° Addresses an issue where the iTunes library and playlists appear empty; ° Resolves an issue that created an incompatibility with some third-party shared libraries.
