  26.              THE IMMEDIATE RELEASE AND REHABILITATION
  27.                        OF GERHARD BVGELEIN!

  30. On May, 18th 1992 Gerhard Bvgelein, aged 69, was sentenced with
  31. imprisonment for life by a judge of the 22. Criminal Division of
  32. the District Court Hamburg/Germany. The reason of the court:
  33. treacherous morder of a former NS-Wehrmacht (Fascist military)
  34. judge in the year 1947.  This judical decision is terrific for
  35. different reasons:
  36.  
  37. - The now sentenced Gerhard Bvgelein was an active member of
  38. resistance against the German Fascism; he refused to obey orders,
  39. he was a deserter; he deserted to the Red Army and fought with the
  40. SU against the Fascism.
  41.  
  42. - The killed NS-Military Judge signed 120 to 170 Death sentences
  43. in the years between 1943 and 1945 and was 1947 still an ardent
  44. National Socialist.
  45.  
  46. - The investigations and the questionings of witnesses the trial
  47. is founded upon mostly happened in the beginning of the 50ies and
  48. were effected by a former judge of the NS "Volksgerichtshof."
  49.  
  50. - Most of the witnesses were ardent National Socialists. Gerhard
  51. Bvgelein himself denies the act.
  52.  
  53. - Until the "Reunification" of the both german states Gerhard
  54. Bvgelein was a citizen of the GDR and was shortly afterwards put
  55. by force -- seriously ill and unfit for imprisonment -- into the
  56. remand prison of Hamburg.
  57.  
  58. This trial is an example of the falsification of the history by
  59. the German state, that aims at making victims out of NS-committers
  60. and making criminals out of the people who actively stood up
  61. against Fascism and who called to account the murderers.
  62.  
  63. We are outraged and shocked by this judical decision and call on
  64. all democratic and anti-fascist people in and out of Germany to do
  65. their utmost for the immediate release and rehabilitation of
  66. Gerhard Bvgelein.
