- THE IMMEDIATE RELEASE AND REHABILITATION
- OF GERHARD BVGELEIN!

- On May, 18th 1992 Gerhard Bvgelein, aged 69, was sentenced with
- imprisonment for life by a judge of the 22. Criminal Division of
- the District Court Hamburg/Germany. The reason of the court:
- treacherous morder of a former NS-Wehrmacht (Fascist military)
- judge in the year 1947. This judical decision is terrific for
- different reasons:

- - The now sentenced Gerhard Bvgelein was an active member of
- resistance against the German Fascism; he refused to obey orders,
- he was a deserter; he deserted to the Red Army and fought with the
- SU against the Fascism.

- - The killed NS-Military Judge signed 120 to 170 Death sentences
- in the years between 1943 and 1945 and was 1947 still an ardent
- National Socialist.

- - The investigations and the questionings of witnesses the trial
- is founded upon mostly happened in the beginning of the 50ies and
- were effected by a former judge of the NS "Volksgerichtshof."

- - Most of the witnesses were ardent National Socialists. Gerhard
- Bvgelein himself denies the act.

- - Until the "Reunification" of the both german states Gerhard
- Bvgelein was a citizen of the GDR and was shortly afterwards put
- by force -- seriously ill and unfit for imprisonment -- into the
- remand prison of Hamburg.

- This trial is an example of the falsification of the history by
- the German state, that aims at making victims out of NS-committers
- and making criminals out of the people who actively stood up
- against Fascism and who called to account the murderers.

- We are outraged and shocked by this judical decision and call on
- all democratic and anti-fascist people in and out of Germany to do
- their utmost for the immediate release and rehabilitation of
- Gerhard Bvgelein.
