  27.    Incorrect.  PL 130.05(3)(b) makes mental incapacity the legal
  28.    equivalent of actual lack of consent.  From that point on, the
  29.    charge of rape is treated identically with any other.  (As it should

  31. However, Glen Ridge is here in New Jersey, not New York.
  32. The age of consent is lower here, though I'm not sure if the victim
  33. was above or below that age, and the law takes into account the age of
  34. the sexual partner in age-of-consent issues as well.
  35. Don't know what it says about mental incapacity, but that's obviously been a
  36. major part of the testimony that's been in the papers.
