  27. TAKING OF ISRAELI POLICE OFFICER AND SEEKS ASSURANCES FOR PALESTINIAN

  30. Amnesty International has expressed its condemnation of hostage-taking to the
  31. Islamic Resistance Movement (Hamas), which has taken responsibility for the
  32. holding of Nissim Toledano, a member of the Israeli Border Police.  Amnesty
  33. International is also appealing to the Israeli authorities not to carry out
  34. arbitrary arrests of Palestinians and to ensure that all detainees are treated
  35. humanely.

  37.       Nissim Toledano disappeared on the morning of 13 December after leaving
  38. his home in Lod in Israel.  Two Palestinians in the town of  al-Bireh claiming
  39. to belong to Hamas' military wing produced a photocopy  of his identity card
  40. and said he would be executed that evening unless  Israel released Sheikh
  41. Ahmad Yasin, the imprisoned Hamas leader.  Before the expiry of the deadline
  42. Sheikh Yasin appealed on television to those holding the police officer not to
  43. execute him and called for negotiations between Hamas and the Israeli
  44. authorities to take place.  In a statement released in Jordan on 14 December,
  45. Hamas said it was ready to negotiate.                The Israeli government
  46. has requested proof that Nissim Toledano is alive.  In the meantime, it has
  47. sealed off the Occupied Territories, imposed a curfew on the Gaza Strip and
  48. arrested over one thousand Palestinians.  They include Taher Shriteh, a well-
  49. known Gaza journalist, and Dr Mahmud al-Zahhar, a prominent political figure
  50. said to be close to Hamas.

  52.       Amnesty International takes no position on the legitimacy of  political
  53. conflicts, nor on the legitimacy of resorting to arms in pursuit of political
  54. aims.  However, it opposes human rights abuses such as  the taking of hostages
  55. and torture or execution of prisoners by either governments or armed
  56. opposition groups.

  58.       Amnesty International said Hamas should release Nissim Toledano.   "We
  59. are concerned that he is held solely as a hostage to obtain the release of
  60. Sheikh Yasin.  In any case he should not be subjected to any form of torture
  61. or ill-treatment and should not be executed.  Hostage-taking and violence to
  62. prisoners are forbidden by international human rights and humanitarian law."

  64.       Amnesty International is also calling on the Israeli authorities not to
  65. carry out arbitrary arrests of Palestinians in reprisal for the holding of
  66. Nissim Toledano.  "Anyone detained for this reason should be released.  The
  67. others should be given prompt access to a judge and then charged and brought
  68. to trial if they are not to be released.  All detainees should be protected
  69. from any form of torture or ill-treatment while in custody", Amnesty
  70. International said.
