  42. AGREEMENT TO ACCELERATE PROGRESS OF CONTRACT WORK

  45. @001, referred to as CONTRACTOR, and @002, referred to as OWNER,

  49. The parties have entered into an agreement for @003, on |004.
  50. Pursuant to this agreement, and any modifications thereto,
  51. substantial completion of the work is scheduled on |005.

  54. OWNER desires that the work be substantially complete on or

  58. CONTRACTOR, in consideration of an additional payment of $@007

  65. Time is of the essence in this contract. The parties agree that
  66. if the work is not completed within the time set forth in this
  67. agreement, the OWNER shall suffer damages which shall be 
  68. difficult of calculation. Accordingly, solely as liquidated 
  69. damages and not as a penalty, the CONTRACTOR shall pay to OWNER
  70. the sum of $@009 (!009 dollars) per @010 beyond the date 
  71. specified wfor the completion of the work herein.
