  19. 2. Scope

  21. Any program(s) or file(s) retrieved in any manner from the PhotoFolio beta
  22. test home site, this includes but is not limited to the PhotoFolio
  23. executable and/or PhotoFolio program patches, executables not named
  24. PhotoFolio or similar, all documentation, all utilities, all patches and
  25. all examples hereinafter the "programs" or "the program", remain the
  26. property of Steeple Software and are (C) Steeple Software.

  28. 3. Warranty

  30. The author(s) is/are not responsible for any damages caused by the use or
  31. misuse of this documentation and/or the program(s) it describes.
  32.  
  33. The program is provided "as-is" and subject to change without notice; no
  34. warranties are made or implied. All use is at your own risk. No liability
  35. or responsibility is made or assumed.
  36.  
  37. The program should be considered in a "beta" state and therefore possibly
  38. unstable.
  39.  
  40. 4. Termination
  41.  
  42. Steeple Software may terminate this license at any time, with or without
  43. cause. This license and licensee's rights herein will automatically
  44. terminate upon the breach by the licensee of these terms and conditions.
  45. Upon such termination, the licensee shall destroy all copies of the program
  46. in its possession.
  47.  
  48. At the discretion of Steeple Software, misuse of your username/password
  49. combination could render your beta testing status terminated.
  50.  
  51. Licensees who never ever report anything and are using their beta test
  52. status only to obtain the program may have their beta testing status
  53. terminated. This does not mean however that you must find a bug to maintain
  54. your beta testing status.
  55.  
  56. 5. The program provided by Steeple Software may not be reproduced or
  57. distributed in whole or in part.
  58.  
  59. 6. The program may not be modified or sublicensed in any way.
  60.  
  61. 7. The license to use the program is extended to users with
  62. usernames/passwords that have been validated by Steeple Software.
  63.  
  64. 8. The licensee shall hold Steeple Software and its employees harmless from
  65. any and all claims, damages and liabilities resulting or arising out of the
  66. use of the programs.
  67.  
  68. 9. The licensee agrees to assist Steeple Software with the testing of new
  69. versions of the program by providing information and feedback of bugs and
  70. problems associated with the program.
  71.  
  72. 10. Steeple Software is under no obligation to fix or enhance the program
  73. when requested to do so.
  74.  
  75. 11. The licensee is not to disclose any bug fixes, changes, new features or
  76. enhanced capabilities of the program or any other information of any kind
  77. obtained from the beta test site or the files retrieved from that site
  78. unless directed to do so by Steeple Software.

  80. 12. This license is valid until the termination of the licensees'
  81. username/password.

  87. non-disclosure and beta testing license agreement.

  89. My preferred username is {maximum of 8 characters}.
  90.  
  91. Steeple Software reserves the right to alter your username from that
  92. provided.
  93.  
  94. Please note:
  95.  
  96. * A username/password will be assigned to you and delivered to you by
  97. signed PGP email. Your PGP signature will also be used for any future
  98. secure communications from Steeple Software.
  99.  
  100. * All software downloaded from the site will be in a zip archive with a
  101. password. Every zip file will have a different password. Zip passwords will
  102. be mailed by signed PGP email to all username/password holders, as new
  103. versions of the software are made available.
