  29. The above actually referred to WB 1.3.1 beta.  WB 1.3.2 was posted on BIX's
  30. 'open' developer conference.  It comes with an "interesting" software license
  31. agreement, which I am enclosing here for your edification :-) It is rumored
  32. that it is closely resembling Apple's software licenses.  Sorry for the foulup.

  43. PLEASE CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING THIS
  44. SOFTWARE.  ANY DOWNLOADING, REPRODUCTION, COPYING OR OTHER USE OF THE 
  45. SOFTWARE WILL CONSTITUTE ACCEPTANCE OF THESE TERMS AND CONDITIONS.  IF YOU 
  46. DO NOT AGREE WITH THEM YOU SHOULD DISCONTINUE THIS TRANSMISSION.

  48. I.  LICENSE
  49.  
  50.     Commodore-Amiga, Inc. ("Commodore") makes this Software available 
  51. subject to the following non-exclusive license.  You are responsible
  52. for selecting the appropriate Software (computer programs and related 
  53. documentation) to meet your needs, and for its installation, use and 
  54. results.
  55.  
  56.     A.  This license allows you to:
  57.  
  58.         1.  Use the Software only on a single AMIGA computer. 
  59.     You must obtain a supplementary license from Commodore before 
  60.     using the Software in connection with any other use;
  61.  
  62.         2.  Download the Software only on media that is
  63.     compatible with the AMIGA;
  64.  
  65.         3.  Make one copy of the Software in any machine
  66.     readable form for backup purposes.  The Software is protected by 
  67.     United States copyright law.  You must reproduce the Commodore 
  68.     copyright notice on any copy of the Software; and

  70.         4.  Configure the Software for your own use by adding
  71.     or removing fonts, desk accessories and/or device drivers.

  73.     THE SOFTWARE MAY BE USED ONLY FOR PERSONAL OR NON-COMMERCIAL USES 
  74. ON AMIGA COMPUTERS AND MAY NOT BE USED FOR COMMERCIAL PURPOSES OR 
  75. REDISTRIBUTED WITHOUT AN EXPRESS LICENSE FROM COMMODORE (available 
  76. >From Commodore's Software Licensing Department).

  78.     B.  Commodore reserves all rights not expressly granted to you 
  79.         above.

  81.     C.  The following activities are expressly prohibited by this 
  82.         license:

  84.         1.  The Software contains trade secrets and in order to
  85.     protect them you may not decompile, reverse engineer, disassemble
  86.     or otherwise reduce the Software to a human perceivable form.  
  87.     You agree not to directly or indirectly divulge to any person or 
  88.     entity the  Software, or any trade secrets related to the Software, 
  89.     until such  time as Commodore makes such information available to
  90.     the public  without restriction.  YOU SPECIFICALLY AGREE NOT TO 
  91.     DECOMPILE, MODIFY, NETWORK, RENT, LEASE, LOAN, SELL OR DISTRIBUTE 
  92.     THE SOFTWARE, OR ANY COPY, IN WHOLE OR IN PART.  YOU UNDERSTAND THAT 
  93.     UNAUTHORIZED REPRODUCTION OF A COPY OF THE SOFTWARE OR UNAUTHORIZED 
  94.     TRANSFER OF  ANY COPY OF THE SOFTWARE MAY SUBJECT YOU TO A LAWSUIT 
  95.     FOR DAMAGES, INJUNCTIVE RELIEF, AND ATTORNEY'S FEES.

  97.         2.  You agree and certify that neither the Software nor
  98.     any other technical data received from Commodore or the direct
  99.     product thereof, is being or will be downloaded, shipped, 
  100.     transferred or reexported, directly or indirectly to Country 
  101.     Groups Q, S, W, Y, or Z (see Attachment 1) or Afghanistan or the 
  102.     People's Republic of China, without prior written approval from 
  103.     Commodore and either a validated export license or written permission 
  104.     from the U.S. Office of Export Administration.
  105.  
  106.         3.  You agree and certify that you will not use, ship,
  107.     transfer, or reexport any Software or other technical data, or any 
  108.     direct product thereof, related to any commodity that will be used 
  109.     directly or indirectly in the following activities (or in the 
  110.     training of personnel for such activities), whether or not it is 
  111.     specifically designed or modified for such activities;
  112.  
  113.             (i) designing, developing, fabricating or 
  114.         testing nuclear weapons or nuclear explosive devices;
  115.                 (ii) designing, constructing, fabricating, or
  116.         operating the following facilities, or components for
  117.         such facilities;
  118.  
  119.                 (a)  the chemical processing or irradiated
  120.             special nuclear or source material;
  121.                 (b)  the production of heavy water;
  122.                 (c)  the separation of isotopes of source 
  123.             and special nuclear material;
  124.                 (d)  the fabrication of nuclear reactor fuel
  125.             containing plutonium.
  126.  
  127. II.  TERM
  128.  
  129.     The license is effective until terminated.  You may terminate it
  130. at any time by destroying the Software together with all copies.  The 
  131. license will also terminate if you fail to comply with any of the terms or 
  132. conditions of this Agreement.  You agree upon such termination to destroy all
  133. copies of the Software.
  134.  
  135. III.  DISCLAIMER OF WARRANTY
  136.  
  137.     THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, 
  138. EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ITS MERCHANTABILITY 
  139. OR ITS FITNESS FOR ANY PARTICULAR PURPOSE.  THE ENTIRE RISK AS TO THE QUALITY
  140. AND PERFORMANCE OF THE SOFTWARE IS WITH YOU.  SHOULD THE SOFTWARE PROVE
  141. DEFECTIVE, YOU (AND NOT COMMODORE OR A COMMODORE AUTHORIZED REPRESENTATIVE) 
  142. ASSUME THE  ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
  143.  
  144.     Commodore does not warrant that the functions contained in the 
  145. Software will meet your requirements or that the operation of the Software 
  146. will be uninterrupted or error free or that defects in the Software will be 
  147. corrected.
  148.  
  149.     SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE 
  150. ABOVE EXCLUSION MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL
  151. RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
  152.  
  153. IV.  LIMITATION OF REMEDIES
  154.  
  155.     IN NO EVENT WILL COMMODORE OR ITS AFFILIATED COMPANIES BE LIABLE TO 
  156. YOU FOR ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL, SPECIAL OR 
  157. CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE ANY 
  158. SOFTWARE EVEN IF COMMODORE OR AN AUTHORIZED COMMODORE REPRESENTATIVE HAS 
  159. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY 
  160. OTHER PARTY.
  161.  
  162.     SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY 
  163. FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION
  164. MAY NOT APPLY TO YOU.
  165.  
  166.     Commodore's liability to you for actual damages for any cause 
  167. whatsoever, and regardless of the form of the action, will be limited to 
  168. the money paid to Commodore for the Software that caused the damages or that
  169. is the subject matter of, or is directly related to, the cause of action.
  170.  
  171. V.  GOVERNMENT END-USERS
  172.  
  173.     If this Software is acquired by or on behalf of a unit or agency of 
  174. the United States Government this provision applies.  This Software:  (a)
  175. was developed at private expense, and no part of it was developed with 
  176. government funds, (b) is a trade secret of Commodore for all purposes of the
  177. Freedom of Information Act, (c) is "commercial computer software" subject to
  178. limited  utilization as provided in the contract between the vendor and the
  179. governmental entity and (d) in all respects is proprietary data belonging
  180. solely to Commodore.
  181.  
  182.  
  183.     For units of the Department of Defense (DoD), this Software is sold
  184. only with "Restricted Rights" as that term is defined in the DoD Supplement
  185. to the Federal Acquisition Regulations, 52.227-7013 (b) (3) (ii) and:
  186.  
  187.     Use, duplication or disclosure is subject to restrictions as set 
  188. forth in subdivision (b) (3) (ii) of the Rights in Technical Data and 
  189. Computer Software clause at 52.227-7013.  Manufacturer:  Commodore, 
  190. 1200 Wilson Drive, West Chester, PA  19380.
  191.  
  192.     If this Software was acquired under a GSA Schedule the 
  193. Government has agreed to refrain from changing or removing any insignia 
  194. or lettering from the Software that is provided or from producing copies 
  195. of manuals or disks (except one copy for backup purposes) and:
  196.  
  197.         1.  Title to and ownership of this Software and
  198.     documentation and any reproductions thereof shall remain
  199.     with Commodore-Amiga, Inc.
  200.  
  201.         2.  Use of this Software and documentation shall be
  202.     limited to the facility for which it is acquired; and 
  203.  
  204.         3.  If use of the Software is discontinued to the
  205.     installation specified in the purchase/delivery order and the 
  206.     Government desires to use it at another location, it may do so 
  207.     by giving prior written notice to Commodore-Amiga, Inc., 
  208.     specifying the type of computer and new location site.
  209.  
  210.     Governmental personnel using this Commodore Software, other than
  211.     under a DoD contract or GSA Schedule, are hereby on notice that 
  212.     use of this Software is subject to restrictions which are the same 
  213.     as or similar to those specified above.
  214.  
  215. VI.  GENERAL
  216.  
  217.     Any attempt to network, rent lease, or sublicense the Software 
  218.     or to transfer any of the rights, duties or obligations under this 
  219.     Agreement is void.
  220.  
  221.     This Agreement will be construed under the laws of the state of
  222.     Pennsylvania, except for that body of laws dealing with conflict 
  223.     of laws.  If any provision of this Agreement shall be held by a 
  224.     court of competent jurisdiction to be contrary to law, that
  225.     provision will be enforced to the maximum extent permissible, and
  226.     the remaining provisions of this Agreement shall remain in full
  227.     force and effect.
