Hi all,
sorry for this off-topic mail, but there are so many knowlegeable people on
this list that I bet someone can help me. Please respond privately if you
feel this isn't of interest to other people as well ...
I have produced a CD which I want to send to various record companies, but
there are some legal aspects which I don't know anything about and I want
to clarify these issues before sending the CD away:
1) All of the compositions are by me or my "bandmates" (it's not really a
band but a project, but that's not important right now), so I guess there's
a copyright on them per se. One track, however, is a cover of a Herbie
Hancock track - the composition's still intact, but we used a different
arrangement and chose a different title. In the credits, we wrote "composed
by Herbie Hancock" [not mentioning the original title, however] and
"arranged by Chris Genzel and Matthias Unterhuber". I'm not sure whether
we have to pay a fee to anybody for using this piece or for changing the
arrangement and title ...?
2) I used a couple of samples in a few songs. One song has various dialogue
excerpts from a movie. Another song has two samples from a CD - one rhythm
guitar loop and a bass loop - and one speech sample from another CD. In
both cases, I guess it's illegal to use these samples without permission,
so who would I have to contact in order to get the permission, and how much
would this cost? I can't afford to pay a few hundred bucks just for these
samples, naturally.
3) Would the fact that these two songs contain samples change anything with
the copyright, i.e. are these songs still my intellectual property?
4) Someone told me to secure the rights to these recordings by registering at
the GEMA (I don't know whether the GEMA is known to anyone outside of
Germany), but if these songs are my intellectual property wouldn't that
mean they are already copyrighted?

A live concert of saxophone great Eric Dolphy that leading jazz scholars
never knew existed will be released Sept. 21 by Blue Note Records.
[snipped portion of story dealing with Nat "King" Cole rarity reissued
same day] The Dolphy release, titled The Illinois Concert, is the rarer
of the two, coming from a March 10, 1963 concert at the University of
Illinois, which featured Dolphy on alto saxophone, flute, and bass
clarinet; a 23-year-old Herbie Hancock on piano, Eddie Kahn on bass and
J.C. Moses on drums.
"The Dolphy was a real surprise," says Blue Note's director of reissues
Michael Cuscuna. "A Dolphy fan, Alan Saul, found it in a chat room about
Dolphy on the Internet about three years ago. Then he helped me find the
guy who had the tape. It was recorded in mono by the University radio
station. It has some sonic problems, but other than that, everything is
completely audible."
The recording also features Dolphy's quartet augmented by the University
of Illinois Brass Ensemble on one cut ("Red Planet") and by the
University's Big Band on another ("G.W.). These two tracks are the
examples of Dolphy writing arrangements for a large ensemble, which he'd
been thought only to do for John Coltrane's Africa Brass sessions two
years earlier. Dolphy died in 1964 in a diabetic coma.

Lois Vierk is a composer that uses minimalist ideas, cascading basic
riffs on top of each other until they build into this huge storm of
sound. My favorite piece of hers of all time, and perhaps one of my
favorite pieces of all times, is Manhattan Cascade for Accordian, which
Guy Klucevsek performs on his CRI disc, Manhattan Cascade (which is a
fantastic disc, all the way around).
I also saw a cellist perform Simoom (for eight cellos, seven of which
were pre-recorded), and it was amazing, the sound that filled up the
room.
By repeating the same riff over and over, with variations and moving it
from cello to cello, it really feels like you're in some sort of
musical rapids, just tumbling and turning, caught up in the swell of
sound.
I've got a disc from her XI label that has Simoom, which is great, a
piece for trumpets, which is pretty good, and a piece for... I dunno.
I forget, but it's not as good. But even not as good is still really
great.
I had no idea she was coming out with a disc on Tzadik. It should be
excellent.
As well, I had no idea she had written for Kronos, though I'm not
surprised. Has that been recorded at all?

Sam The Record Man does have a decent selection (beats Tower for
sure; roughly the same as HMV, in my experience), but their prices
are horrible. To be honest, I don't know why anyone pays what they
(or HMV, Tower, Sunrise) charge for most imports. Must simply be the
convenience. If I had the $$ to drop $35/$40 CDN and up per CD, I'd
spend my dough elsewhere (Verge, DMG etc.) and buy twice as much. :)
Rotate definitely has the best prices on Tzadik/Avant and jazz-
related stuff, although their selection is relatively small since
it isn't their main focus. Record Peddler (on Queen near Rotate)
is also worth a look, as are Black Planet (also on Queen - specializing
in Kraut/Prog/WSD) and 2nd Vinyl (McCaul at Queen - jazz/classical etc.
new & used). RP & BP are fairly expensive, but as with the chain
stores, they do stock items unavailable elsewhere in the city.

If what he's doing now is anything like his tour of last fall, do not
hesitate, GO! It was an awesome show, Spooky on upright bass & turntables,
+ a keyboardist, another DJ, a drummer and a tabla player. + Kool Keith/Dr
Octagon. All live, no backing tapes, lots of improvisation, and a totally
happening band. One of the best shows I saw all year. I don't want to sound
like a drooling fanbay, but it really was great...

That Ginsberg spoken word album is amazing. IT is called The Lion For Real,
and features many of our favorite downtown artists. Marc bingham, mike
blair, ralph carney, bill frisell, arto lidsay, steve swallow, gary windo,
lenny picket.
I like spoken word, but only when it is accompanyed by musicians that play
the tone and feeling of what is being spoken, or vice versa!
