Heres my story:
I ordered 8 CDs along time ago- like late May/ early June. Nothing too
obscure, I think 5 of them were Tzadik titles. Anyways I received one email
a few weeks after that apologizing for the delay, then about two weeks ago I
received an email saying that my order could not be fulfilled! They were not
able to get any of my CDs. And I just got my credit card statement about a
week ago, and they charged my card!!! To top it all off, I got a phone call,
apparently from a service rep asking me form questions such as "did you
receiver your order, were you happy with the service, would you shop with
shopnow.com again?" I dont think so.

Hello one and all. Sonic Youth mgmt here. We cannot thank you enough for
the overwhelming support you've shown us through emails, phone calls and
personal notes. Please forgive me for not being able to respond to each
directly. Everyone's email address will be kept and you will be given
updates as any news becomes available. We've received emails from all over
the world and there's no doubt that people are listening.
Unfortunately, there's no real lead on the stolen gear. With the help of
fans, the media and the mighty web, word is continuing to spread all over
this great land of ours. We just ask that you keep your eyes peeled at your
local music stores, pawn shops, newsgroups, ebay, amazon.com, etc.
Please know that the band is in excellent spirits and very much look forward
to returning to the studio. This is not the end of Sonic Youth nor is it a
'tragedy'. Basically, it's a pain in the neck for all of us but one that
will bring new challenges to the band as well as some new sounds for their
fans.
The true tragedy is the untimely passing of Mark Sandman from Morphine who
passed away on July 3. He will be missed by all of us.
One last thing. I would be remiss if i didn't make note of the following --
1 - I did not steal Sonic Youth's gear.
2 - Anyone posting they're selling the Sonic Youth gear as a joke is about as
funny as a head injury.
3 - Don't miss Tenacious D on tour.
Thanks again to all of you!!!!!
All the best!

Jody, it's illegal for any mail order operation
to charge a credit card before an order is fulfilled.
even if they were to have sent you a partial
fulfillment, they can only charge you for what
they send out.
this is the second or third time i've seen
someone mention this (on various mailing lists).
i'm not a lawyer, but perhaps it's time for
folks to speak with an attorney about this?

For those of you out there who don't read Billboard magazine (and I'm
sure on this list you must be legion), here is a feature piece on Dave
Douglas that appears in the new issue, out tomorrow.
BTW this is where I'll mention that I've just been hired last Friday as
the new PR guy for RCA, in charge of jazz and world music. I start on
August 2, so please don't construe this message as a corporate
perversion of the hallowed Zornlist - I won't be violating that

this will be of interest to many, I forward this for your consideration.

BILLBOARD, July 24
BUSY DAVE DOUGLAS IS MILES AHEAD
Winter & Winter Set Due From Trumpeter; RCA Deal Inked
By Bradley Bambarger
NEW YORK--No less an authority than avant-jazz avatar John Zorn
described
the music of trumpeter/composer Dave Douglas as =93a living, breathing
organism--an exciting world of possibilities where anything can happen.=94
He
also said Douglas=92 work is =93touched by genius.=94
Always a pioneer, Zorn offered those valuations on behalf of Douglas=92
=9296
Soul Note set =93Five.=94 Since then, jazz critics and music lovers have
been
catching up with similar superlatives for Douglas=92 way of paying smart
homage to his heroes (jazz, classical, and pop), while forging his own
distinctive soundprint across several ongoing ensembles.
The ever-active Douglas had a trio of discs vie for the tops of critics=92
polls last year: =93Moving Portrait=94 (DIW), a Joni Mitchell tribute wit=
h
piano
quartet; =93Magic Triangle=94 (Arabesque), an all-originals feature for h=
is
quartet with tenor sax; and =93Charms Of The Night Sky=94 (Winter & Winte=
r),
the
luminous debut by his chamber-jazz outfit of the same name.
So far this year, Douglas has produced =93Convergence=94 (Soul Note), the
third
effort by his string-laced quintet. And on Aug. 10, Winter & Winter
issues
=93Songs For Wandering Souls,=94 the fourth and finest set yet from his T=
iny
Bell Trio, with guitarist Brad Shepik and drummer Jim Black. Last but
not
least, Douglas just inked a four-record deal with RCA Victor that will
yield
a sextet album early next year.
The 36-year-old, Brooklyn, N.Y.-residing Douglas flourishes by flouting
categories, as he pursues many muses via his various groups. During the
recent Bell Atlantic New York Jazz Festival, Douglas packed the Knitting
Factory for a long, rich evening of three shows with three disparate
bands.
Charms Of The Night Sky mines a vein of Mitteleuropa, coming up with
gems
that flicker of Grappelli/Reinhardt, Viennese classicism, and Prague
coffeehouses. And =93Convergence=94 sets his most intricate compositions
alongside Messaien and a Burmese folk song. Then there is the
Balkan-accented improv of the Tiny Bell Trio, which embraces not only
czardas but Schumann transcriptions and the odd Rahsaan Roland Kirk
tune.
=93Juxtaposition is something I consider whether I=92m composing, putting=
a
band
together, or programming a live set,=94 Douglas says. =93I want to reflec=
t
all
my inspirations, but not in pastiche--it should have variety and unity.
And
each record should be unique. I never approach a session like this is my
=91jazz=92 thing and this is my =91classical.=92 Everything should be sui
generis.=94
The Douglas aesthetic obviously thrives on freedom. He produces his own
records, with top engineer Joe Ferla in the case of =93Songs For Wanderin=
g
Souls.=94 And Douglas says he chose RCA from among several major-label
suitors
=93because it seems the most open to breaking down creative barriers.=94
Winter & Winter principal Stefan Winter admires Douglas most for his
=93openness and curiosity,=94 he says. =93Some musicians have trouble pur=
suing
more than one direction at a time, but Dave constantly puts himself into
different contexts. That=92s why he is always growing.=94
Most labels =93don=92t believe in an artist putting out more than one alb=
um
a
year,=94 Winter adds, =93but that is silly in the case of someone like Da=
ve.
If
the projects are distinctive enough, all the activity can be good for
building an audience.=94
Seconding that opinion is Bruce Gallanter, owner of New York=92s Downtown
Music. =93All Dave=92s records sell for me,=94 he says. =93A lot of peopl=
e
search
out his records after first hearing him play with Zorn. Then =91Charms Of
The
Night Sky=92 cuts across every kind of buyer.=94
Adding luster to =93Songs For Wandering Souls=94 is the imprimatur of Win=
ter
&
Winter, since =93record buyers love the label,=94 Gallanter says. =93They=
have
great packaging and sound, with interesting artists. I have customers
who
buy everything the label puts out.=94
Winter=92s former label--the PolyGram-distributed JMT--was a favorite
among
adventurous jazzers, and his Munich-based Winter & Winter has earned
even
more admiration in a short span. In 2 1/2 years, the label reports sales
of
500,000 copies of 38 titles. Its wares are distributed by Allegro in the
U.S., Fusion 3 in Canada, Harmonia Mundi in France and the U.K., Bomba
in
Japan, and Edel in Germany, Austria, and Italy.
Another fan of Douglas and the Winter & Winter ethos is Jay Trachtenberg
of
eclectic public-radio outlet KUT Austin, Texas. The station aired past
discs
and has been previewing =93Songs For Wandering Souls,=94 which Trachtenbe=
rg
also
plans to play on his Sunday show on commercial triple-A KGSR. =93Not
everyone
is going to like Dave Douglas,=94 he says, =93but then not everyone likes
Diana
Krall.=94
Next year promises a boon for Douglas fans, as he will have at least
three
discs out as a leader. The first RCA album will be a sextet tribute to
the
late Mary Lou Williams, in the manner of Douglas=92 compositional homages
to
Wayne Shorter (=93Stargazer,=94 Arabesque) and Booker Little (=93In Our
Lifetime,=94
New World).
Indicative of Douglas=92 modernity is that he tips his hat to his
forebears
as he strikes out on his own. In that sense, all his varied work is a
tribute to the resolute individuality of another man with the horn. =93I
always think of Miles Davis=92 fearless drive to move forward,=94 he says.
=93It=92s
like being a long-distance runner. Those who keep looking back are the
ones
who lose.=94
Douglas has one more indie effort on the way: =93Leap Of Faith,=94 a teno=
r
quartet disc due in February on Arabesque. Set for next fall, Douglas=92
second album for RCA will be a feature for Charms Of The Night
Sky--violinist Mark Feldman, bassist Greg Cohen, and accordion ace Guy
Klucevsek.
Beyond his work as a leader, Douglas=92 expressive trumpet has long been =
a
key
to the Hebraic harmolodics of Zorn=92s Masada combo--which has 10 studio
discs
and two potent new live sets on Zorn=92s Tzadik label. Douglas is also in
pianist Myra Melford=92s Same River, Twice band, which has its second
album,
=93Above Blue,=94 out on Arabesque.
In coming months, Douglas travels the Old and New Worlds with the Night
Sky
group and Tiny Bell Trio, as well as with Masada. To unveil the RCA
debut,
his sextet plays a February stand at New York=92s Village Vanguard.
Douglas is
managed and booked in the U.S. by New York=92s Sooya Arts. His European
agent
is Saudades Tours in Rotholz, Austria. His compositions are published by
Noenmity Music (BMI).

Strictly speaking, this isn't true. You can charge before an order is
fufilled, and you then have 30 days to fufill it; charging before shipment
is not a popular way of getting business done, it is perfectly legal. Amazon
even does it; order something of theirs that takes a few days to fufill, and
you'll see.

Coincidentally, I got an email today (in response to a phone query I
made yesterday or the day before). Full text below. They've been very
friendly to me on the phone, despite the stupidity of having the cd
orders handled by a office that's not accessible to the customer service
office. I have yet to get any discs (I ordered a lot - in one order,
ignoring the limit, which I believed to be per disc, not per order), but
my card has yet to be charged as well.

Here's the email:
The first distributor we contracted with to fulfill our CD titles was
unable to handle the incredible demand, so we have contracted with a
second distributor. Unfortunately, not all titles are available with the
second distributor.
We are currently researching what CD titles were and were not shipped.
We
hope to have an email out to you by the end of next week, informing you
of
the status of your order. However, I do want to caution you that you may
not receive all of your titles. Any titles unavailable will be cancelled
from the order and you will not be charged for them. We are still
offering the top 25 CD titles for our low price of $4.95 per CD.
While we are disappointed that your experience purchasing from us has
not
been ideal, we hope you understand and we hope you will continue to shop
online with us. Please feel free to email or call with any further

>> Not that Cage would do improv... At least not in the way Ra did.

their improv styles differed specfically?
Well, I'm no expert, but the top statement is true. Cage didn't do any
improv, per se. He was a firm believer for a long time in chance
operations, which is not the same as free improv. On the contrary,
chance operations are (in theory) as strict on the performer as any
normally written score, perhaps more so, as they have to perform things
that are not normally juxtaposed in a performance, or even possible
sometimes.
So, in this case, Cage was probably performing a piece where he reads
some pregenerated phonemes, interspersed with pregenerated silence.
He has a fantastic voice, sort of a really, really pleasant Vincent
Price, so I love to hear him read.
Whereas Sun Ra is from the take-no-prisoners sense of improv, banging
around on the Moog, and generally having a grand old time.
So.
That's my take on it.
Joe Zitt is the Cage expert though. He may be able to clear up
anything i muddled.
