Julia, I did see your reply to my post about the other parents ahould
be liable. The Moderator of this forum made a boo-boo and accidently
posted it somewhere else (I don't remember where it ended up), other
than under mine. Being as I don't have children myself, and have never
looked at McD's play equipment up close, I'm not sure to what extent,
if any, McD's should be liable.
Regarding your insurance problems, have you talked to your State Insurance
Board or any local consumer group? Insurance companies are notorious for
trying to weasel out of their obligations to their customers. When I had
my sinus surgery in 1990, Connecticut General sent me a bullshit letter
that my doctor's fees exceeded reasonable and customary (but gave me no
proof to this). I guess my doctor and his staff settled the problem,
cause I did't hear about it again. And my current managed care provider, CIGNA
tried to get out of covering an inhaler (I'm asthmatic) because thay
claimed it was not on the list of covered medications (but cheaper
inhalers were). One nasty letter took care of that crap.
But check with your doctor or his staff, and see if they can refer you
to a consumers' group or some other organization that can help you with
your insurance problem. And while you're at it, see about pursuing the
irresponsible parents of the hyper children. Your insurance company
should cover the incurred medical expenses, and then recover the cost by
taking the irresponsible parents to court.
