  4. Here is an excerpt from the Criminal Code of Canada.  The 1993 Carswell
  5. edition points to this section in the index under "Pyramid Selling".

  7. It states that anyone who:
  8.  
  9. "conducts or manages any scheme, contrivance, or operation of any
  10. kind by which any person, on payment of any sum of money, or the giving
  11. of any valuable security, or by obligating himself to pay any sum of
  12. money or give any valuable security, shall become entitled under the
  13. scheme, contrivance, or operation to receive from the person conducting
  14. or managing the scheme, contrivance or operation, or any other person, a
  15. larger sum of money or amount of valuable security than the sum or
  16. amount paid or given, or to be paid or given, by reason of the fact that
  17. other persons have paid or given, or obligated themselves to pay or give
  18. any sum of money or valuable security under the scheme, contrivance, or
  19. operation"

  21. ... is guilty of an offence.

  23. That's pretty convoluted language, as is most legalese.  Let's "distill"
  24. it a bit by replacing "scheme, contrivance or operation" with just
  25. "scheme" and "a sum of money or valuable security" with just "money".

  27. So we have that anyone who:
  28.  
  29. "conducts any scheme by which a person, on payment of money, shall
  30. become entitled under the scheme to receive from the person conducting
  31. the scheme (or from any other person) a larger sum of money than the
  32. amount paid, by reason of the fact that other persons have paid money
  33. under the scheme"
  34.  
  35. ...is guilty.

  37. What it's saying here is that you can't start, or involve yourself in, a
  38. scheme wherein you get money because others paid into the scheme.
  39. This outlaws the old fashioned pyramid where you simply sent the letter
  40. out to more people and sent your $2 or $5 to the people on the list.
  41. However, the phrase "by reason of the fact that other persons have
  42. paid..." fairly clearly limits the law to covering the just-send-money
  43. pyramid game - where you send money and get nothing back for it except
  44. the "right" to continue propagating the scheme.

  46. It does not cover multi-level sales of real products or services, not
  47. even multi-levels that could, by their nature, form exponentiating
  48. pyramids.  Technically, this law doesn't even apply to the "Four
  49. Reports" scheme, though any sane prosecutor trying a four-report'er
  50. would wish it did.  However "postal fraud" sections of the CCC cover the
  51. "Four Reports" and "Dave Rhodes" schemes effectively.
