  18.           The Shareware evaluation (trial use) version is provided AS IS.
  19.           Peter T. Smith MAKES NO WARRANTY OF ANY KIND, EXPRESSED OR
  20.           IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES OF
  21.           MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE.

  27.           Peter T. Smith warrants the physical diskette(s) and physical
  28.           documentation provided with registered versions to be free of
  29.           defects in materials and workmanship for a period of ninety days
  30.           from the date of registration.  If Peter T. Smith receives
  31.           notification within the warranty period of defects in materials
  32.           or workmanship, and such notification is determined by Falk Data
  33.           Systems to be correct, Peter T. Smith will replace the
  34.           defective diskette(s) or documentation.

  36.           The entire and exclusive liability and remedy for breach of this
  37.           Limited Warranty shall be limited to replacement of defective
  38.           diskette(s) or documentation and shall not include or extend to
  39.           any claim for or right to recover any other damages, including
  40.           but not limited to, loss of profit, data, or use of the software,
  41.           or special, incidental, or consequential damages or other similar
  42.           claims, even if Peter T. Smith has been specifically advised
  43.           of the possibility of such damages.  In no event will Falk Data
  44.           Systems's liability for any damages to you or any other person
  45.           ever exceed the lower of suggested list price or actual price
  46.           paid for the license to use the software, regardless of any form
  47.           of the claim.

  49.           Peter T. Smith SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES,
