Caspar signed the following declaration when he became gravely ill: "...I desire that after my death my brother undertake the guardianship of my son, Karl Beethoven, a minor..." . Luckily for us and for Beethoven, Caspar recovered and the adoption was postponed.

Beethoven completes his "Wellington's Victory" for Maelzel's Panharmonicon. It was Maelzel who saw the subject for a musical work in Wellington's victory over the French, in Vittoria. The work would do homage to the English, and gratify the national hatred for the French. Beethoven accepted his offer, which included "Rule Britannia" and "God Save the King" in the music Maelzel inserted in his Panharmonicon.
Beethoven later orchestrated his "Battle Symphony", as it was also called, and it enjoyed a stupendous success in Vienna. It later became the reason for a long and bitter quarrel with Maelzel over the rights of the work.
