  3. Thank you for choosing the enclosed NCR SCSI Device Management System 
  4. (SDMS(tm)) software.  Without an executed license agreement between you 
  5. and NCR, possession of the SDMS software contained herein does not imply 
  6. or grant a license or a commitment by NCR Corporation either express or 
  7. implied to provide any portion of the SDMS software for production 
  8. purposes.  NCR Corporation further reserves the right to change or 
  9. improve the software without notice.

  11. Use of the enclosed software is strictly limited to demonstrating and 
  12. evaluating the operation of SDMS with selected NCR SCSI controllers at 
  13. your facility only.  UNTIL A LICENSE AGREEMENT BETWEEN YOU AND NCR 
  14. CORPORATION HAS BEEN SIGNED, THE FOLLOWING TERMS AND CONDITIONS SHALL

  17. 1.    COPYRIGHT.  The SDMS software is owned by NCR Corporation and is 
  18. protected by United States copyright laws and international treaty 
  19. provisions.  You may not alter or remove any copyright notices which NCR 
  20. has caused to appear in the SDMS software or documentation.

  22. 2.    OTHER RESTRICTIONS.   You may not rent, lease, distribute, market, 
  23. sublicense the SDMS software.  You may not reverse engineer, decompile 
  24. or disassemble any portion of the SDMS software.
  25.  
  26. 3.    WARRANTY.   ANY USE BY YOU OF THE SOFTWARE IS AT YOUR OWN RISK. 
  27. THE SOFTWARE IS PROVIDED FOR USE ONLY WITH NCR SEMICONDUCTOR DEVICES. 
  28. THE SOFTWARE IS PROVIDED FOR USE "AS IS" WITHOUT WARRANTY OF ANY KIND. 
  29. NCR CORPORATION DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR 
  30. IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF 
  31. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

  33. 4.    NO LIABILITY FOR CONSEQUENTIAL DAMAGES.    In no event shall NCR 
  34. Corporation be liable for any special, incidental, indirect, or 
  35. consequential damages (including, without limitation, damages for loss 
  36. of business profits, business interruption, loss of business 
  37. information, or other pecuniary loss) arising out of the use or 
  38. inability to use this NCR product, even if NCR Corporation has been 
  39. advised of the possibility of such damages.

  41. 5.    U.S. GOVERNMENT RESTRICTED RIGHTS.   The SDMS software and 
  42. documentation are provided with RESTRICTED RIGHTS.  Use, duplication, or 
  43. disclosure by the Government is subject to restrictions as set forth in 
  44. subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer 
  45. Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of 
  46. the Commercial Computer Software - Restricted Rights at 48 CFR 52.227
