  16.   NINTENDO JOINS IN SEIZURE AGAINST ILLEGAL BULLETIN BOARD SOFTWARE

  18.      REDMOND, WA--As part of a continuing and aggressive effort to
  19. halt counterfeiting of video games and business software, Nintendo of
  20. America Inc.  and six major software manufactures filed an action
  21. against distributors of a computer "bulletin board" network system
  22. giving software acess to users.
  23.  
  24.      Illegal software was seized by authorities from APL, an electronic
  25. bulletin board computer system (BBS) headquartered in Baltimore, MD.
  26.  
  27.      "Counterfeiting and illegal use of video games and business
  28. software has grown immensely over the past few years.  We have and
  29. will continue to prosecute those who've become part of the underground
  30. counterfeiting network", said Lynn Hvalsoe, Nintendo's General Counsel.

  32.      The legal action outlines that illegal software wass accessed
  33. through operators who provide personal computer users a code to enter
  34. the system via telephone and modem.  Illegal bulletin boards have
  35. become a popular trend, with an estimated 5,000 systems in the United
  36. States.  Illegal bulletin boards also have been found in Europe and
  37. Asia.

  39.      This case represents the first time video game and business
  40. software companies have joined together to fight software pirating.
  41. The business software companies, represented in this case through the
  42. Business Software Association (BSA), include Aldus, Autodesk, Lotus
  43. Development, Microsoft, Novel and WordPerfect.  All companies,
  44. including Nintendo, are individual plaintiffs in the legal action.

  46.      The action is part of Nintendo's large anti-counterfeiting
  47. campaign much of which is aimed at illegal video games being
  48. manufactured, sold and shipped from Taiwan, Hong Kong, and other
  49. countries.

  51.      "Counterfeiting is a very serious crime and Nintendo is working
  52. hard to let violators know they will be pursued and charges will be
  53. brought against them," added Hvalsoe.  Hvalsoe pointed to success
  54. this year in the signing of Federal legislation (S893) which elevates
  55. copyright infringement, such as that engaged in by bulletin board
  56. operators, to a felony with penalties of up to $250,000/and up to five
  57. years in prison.

  96. OF ITS DISTRIBUTION.  We recognize that there are many legitimate
  97. bulletin boards and many honest system operators who support the
  98. ethical use of software.  Unless you have questions about action taken
  99. against the APL BBS, however, please do not call Clark Devolopment,
  100. Nintendo of America or Nintendo of America's attorneys.
