- Of course, the most effective rebuttal to Mr. Gary "dingdong" :)
- Warner's arguements as presented is that libraries, museums, and
- educational institutions are *specifically allowed* under current law
- to house materials otherwise deemed legally obscene and illegal. So,
- while a university may have a policy of not housing this kind of
- materials, it would not be breaking the law if it did.

- I am also left to wonder why Mr. Warner would *want* the
- responsiblity of monitoring public lists. Although there is little
- legal precedence at the moment, we do have the examples of Prodigy
- and Compuserve to look at regarding liabilities for material posted
- to public forums.

- Prodigy, which considers itself a newspaper and has an entire
- staff "editing" everything that passes over the system, is considered
- responsible for everything on that system. If a libelous or obscene
- message should sneak through, Prodigy could be sued.

- Compuserve, on the other hand, does not pre-screen any messages.
- A recent court decision found the service therefore not liable for
- a questionable message which had appeared there and inspired a lawsuit
- against CIS.

- taking pains to "protect" his or her student body from groups such
- as alt.sex.hamsters.duct.tape might be setting up the institution
- for a lawsuit should "Cindy's Torment" show up on the local
- news hierarchy.
