- The Commission for the Defense of Human Rights in Central America
- (CODEHUCA), received urgent information from the Guatemalan Human
- Rights Commission (CDHG) on the death penalty against NICOLAS
- GUTIERREZ CRUZ, corporal in the Guatemalan army, who was accused of
- participating in the killing of 4 persons in January 1992.
- FACTS:
- NICOLAS GUTIERREZ CRUZ and the soldier ELISEO SUCHITE (on the run)
- were accused of having killed, on the 16th of January this year,
- the following campesinos: JUAN XAN JULAJ (47 years old); FRANCISCO
- JAZ LOPEZ (28); JUAN CALEL GRAVE (25) and MARVIN XAN ZANTIZO (11),
- in PERONIA, Guatemala City.
- NICOLAS GUTIERREZ CRUZ, had to be executed yesterday the 18th of
- August, because the appeal for cassation put in for the accused was
- not approved in his favour. However, the execution did not take
- place on this day as his defending counsel presented a new appeal.
- The execution is suspended until the competent court will make a
- pronouncement.
- It is important to mention that the death penalty spoken out
- against the corporal, of indigenous background, forms a contrast
- with the pardon given to 6 military men of higher rank who were
- involved in the assessination of 11 persons in August 1991. As
- stated by an official of the Guatemalan Auditor!a de Guerra (a
- military court), they were pardoned this month because of a lack of
- proof.
- On this matter we consider that the application of the death
- penalty against NICOLAS GUTIERREZ is concealing those intelectually
- responsible for the crime, that are the officials who gave the
- order for the massacre and who were not even investigated.
- For this reason, we address our Solidarity Network and ask you to
- react urgently to avoid the application of the capital punishment
- against GUTIERREZ CRUZ and that it will be commuted to the maximum
- prison sentence.
