  19. The Commission for the Defense of Human Rights in Central America
  20. (CODEHUCA), received urgent information from the Guatemalan Human
  21. Rights Commission (CDHG) on the death penalty against NICOLAS
  22. GUTIERREZ CRUZ, corporal in the Guatemalan army, who was accused of
  23. participating in the killing of 4 persons in January 1992.
  24. FACTS:
  25. NICOLAS GUTIERREZ CRUZ and the soldier ELISEO SUCHITE (on the run)
  26. were accused of having killed, on the 16th of January this year,
  27. the following campesinos: JUAN XAN JULAJ (47 years old); FRANCISCO
  28. JAZ LOPEZ (28); JUAN CALEL GRAVE (25) and MARVIN XAN ZANTIZO (11),
  29. in PERONIA, Guatemala City.
  30. NICOLAS GUTIERREZ CRUZ, had to be executed yesterday the 18th of
  31. August, because the appeal for cassation put in for the accused was
  32. not approved in his favour. However, the execution did not take
  33. place on this day as his defending counsel presented a new appeal.
  34. The execution is suspended until the competent court will make a
  35. pronouncement.
  36. It is important to mention that the death penalty spoken out
  37. against the corporal, of indigenous background, forms a contrast
  38. with the pardon given to 6 military men of higher rank who were
  39. involved in the assessination of 11 persons in August 1991. As
  40. stated by an official of the Guatemalan Auditor!a de Guerra (a
  41. military court), they were pardoned this month because of a lack of
  42. proof.
  43. On this matter we consider that the application of the death
  44. penalty against NICOLAS GUTIERREZ is concealing those intelectually
  45. responsible for the crime, that are the officials who gave the
  46. order for the massacre and who were not even investigated.
  47. For this reason, we address our Solidarity Network and ask you to
  48. react urgently to avoid the application of the capital punishment
  49. against GUTIERREZ CRUZ and that it will be commuted to the maximum
  50. prison sentence.
