I got to the bottom of it with my configuration here is how:
The rockwell chipset that my modem uses supports a command AT&S1 which sets
up the modem so it will drop the DTS line when the carrier is lost.
This has the effect of logging out of the current session when used with the getty & login that comes with poeigl. (which I think is standard )
