  23.          SEATTLE  -- Only because he is HIV positive... they
  24. sentenced him to more than 7 years in prison.
  25.  
  26.      On July 1,1988 Steven Farmer, after being tested for the
  27. AIDS antibody against his will, was sentenced to seven and
  28. one half years in prison for the crime of being HIV positive.
  29.  
  30.       On February 27,1990 an appeal was heard by the
  31. Washington State Supreme Court.  A decision was rendered
  32. February 14, 1991.
  33.  
  34.       Forced HIV testing and the criminalization of AIDS are
  35. an attack on every person's civil liberty and  constitutional
  36. right to privacy.  Forced testing also drives the disease
  37. underground, with disastrous public health consequences.
  38.  
  39.      The case sets a dangerous national precedent.
  40. Essentially any persons, particularly those perceived to he
  41. "High risk, " can be arrested, tried, and subjected to
  42. discriminatory sentencing if a judge decides they might be
  43. infected with HIV.
  44.  
  45.      If the Farmer sentencing  is not overturned, it will not
  46. matter that an activity is legal, nor will it matter that the
  47. activity could not transmit AIDS at all. With this legal
  48. precedent, any judge in any case can indiscriminately order
  49. testing and multiply a sentence many times over if the
  50. person tests HIV positive.
  51.  
  52.      What we have here is first and foremost a simple case in
  53. which Steven Farmer, because he is gay, became a
  54. scapegoat in a political witch-hunt. AIDS hysteria fueled an
  55. incredible and horrifying sequence of events which led to
  56. Steven being forced-tested for AIDS and sentenced for a
  57. crime fabricated by the prosecutors' office.
  58.  
  59.      The Farmer Case is actually two cases. Steven was
  60. originally in the legal system in a small misdemeanor plea-
  61. bargain case. After AIDS was raised as a possible issue,
  62. Steven suddenly found himself scapegoated, pilloried in the
  63. media, and slapped with new, contrived felony charges.
  64.  
  65.      Farmer is a first time non violent offender who at most
  66. would have received a 90 day sentence, as is the law.  (If he
  67. was a heterosexual) Most repeat violent offenders, some
  68. with numerous past felony convictions, did not and do not
  69. receive as much time in prison than what Mr. Farmer
  70. received.

  72.       An example of this case "loophole' , now created by the
  73. Washington State  Supreme Court on  the  Real Facts
  74. Doctrine would be that someone can be charged with and
  75. convicted of say .. shoplifting, for up in front of a judge for
  76. sentencing .. and the prosecutor can tell the judge.. and
  77. perhaps have a couple of "dubious witnesses" to back
  78. him/her up, that the defendant also had robbed a convenient
  79. store sometime in his/her past...never charge them with that
  80. crime much less prove it.. but then have the judge sentence
  81. the defendant to 3 times the sentence using that as the
  82. reason. This loophole that has been created in the Farmer
  83. verses
  84. Farmer" in the Washington State Law books.

  92.      Farmer has *finally* been able to exhaust all State
  93. remedies and can now go forward to federal court.  ( A fair
  94. trial in Washington state because of the AIDS hysteria
  95. withchunting is not possible at this time)   Having the Katz
  96. testimony expunged from the record was a victory of sorts
  97. something necessary to do for  the expected  successful
  98. appeal.  The issues of  Equal Protection under the law, and
  99. due process will also be a big part of as subsequent appeal
  100. to the Federal Court.  We believe that the Federal court will
  101. act more responsible than the Washington Supreme Court
  102. did.  They rarely allow created prosecutor/ press created
  103. public opinion and politics and hysteria  to enter into their
  104. decision something that the State Supreme's and
  105. Washington Courts aren't suppose to do either. It has long
  106. been known that Washington State doesn't even follow their
  107. own laws and make them up as they go along.
  108.  
  109.      Farmers attorneys, activists and friends believe that
  110. Farmer will finally win this vital fight, which has now been
  111. going on for over 5 years, at the Federal level. Farmer's
  112. defense fund committee was successful in raising the
  113. necessary 20 thousand dollars that was needed  to continue
  114. this last appeal.   The cost of justice doesn't come cheap.  It
  115. will now cost  another 10 thousand dollars to take it the rest
  116. of the way to Federal Court.  Farmers' supporters, Defense
  117. Fund Committee  are now launching another fund raising
  118. effort  on behalf of this case and Mr. Farmer. Two donors
  119. who wish to remain anonymous, have pledged that they will
  120. match dollar for dollar all moneys raised for this next appeal
  121. effort.

  130. March of this year to review the clemency appeal that
  131. Steven Farmer has applied for.

  174.       KIRO channel 7 was recently was quoted in one of its
  175. news segments on current events of the Farmer case that "It
  176. is feared", referring to Mr. Farmer, "That he will outlive his
  177. sentence and be released to the streets again."  We are
  178. committed to see that happens.  This is not a "Fear" it is
  179. called, justice.
