  30.      Perhaps you didn't know that at some jobs, a person could
  31.      not only be fired for smoking at the job site, but for
  32.      doing same off the premises or at home.  That is why the
  33.      Colorado Legislature passed the Smoker's Rights Bill in 1990.
  34.      You are living in some fantasy world if you think that employers
  35.      only have to relate dismissal to work performance.

  42.      Nearly every attorney in the State of Colorado has made their
  43.      opinion regarding the effects of Amendment 2.  Where have you
  44.      been?  Stuck in a snowbank since before the election?
  45.      You just made my point.  Nearly everyone *excluding* homosexuals
  46.      have the rights you mentioned.  Here is what Amendment 2 says:

  48. Neither the State of Colorado, through any of its branches or departments
  49. nor any of its agencies, political subdivisions, municipalities or school
  50. districts, shall enact, adopt or enforce any statute, regulation, ordinance
  51. or policy whereby homosexual, lesbian or bisexual orientation, conduct,
  52. practices or relationships shall constitute or otherwise be the basis of,
  53. or enable any person or class of persons to have or claim any minority
  54. status, quota preferences, protected status or claim of discrimination.
  55. This Section of the Constitution shall be in all respects self-executing.

  57.      Do you understand what the statment on the second-to-last line
  58.      above means, "..or claim of discrimination."?  This excludes
  59.      homosexuals from even having the same right that smokers currently
  60.      have.  If you speak some other language, then maybe it does
  61.      elude your grasp.  
  62.      Your argument about "externally detectable differences" is
  63.      basically non sequitur.  You have reached a conclusion that does
  64.      not follow from the premise.  You cannot tell a homosexual from
  65.      the general population when he is not engaging in a homosexual
  66.      act any more than you can tell a smoker when he is not smoking.
  67.      Amendment 2 allows a homosexual to be fired from his job for
  68.      being a homosexual and does not allow him to file suit, whereas
  69.      if a homosexual employer fired a heterosexual for being hetero,
  70.      then he is covered by the law, and allowed to sue.

  72.      I feel sorry for you and others like you.
