- I think you're missing the point. Any accident in which someone is killed is
- a tragedy, whether or not the victim "got what he deserved". If anything,
- those whom the victim leaves behind may feel even worse, knowing that the
- accident was preventable.

- But the point of the thread spawned by the incident on the trestle is that
- the railroad should not be held legally responsible for accidents that hap-
- pen to people who have been duly warned not to take the risk. Indeed, the
- system of strict and unquestionable liability towards which the U.S. has
- been moving can actually work *against* public safety. One of the posted
- articles mentioned a case in which a railroad didn't want to fence a danger-
- ous location, lest the courts interpret the action as an admission that all
- unfenced ROW is ipso facto dangerous.
