  21. This is not really true.  Puffery is allowed only when the specific claims 
  22. are [sorry, I don't know the exact wording of the legalese] presumed to be
  23. clearly known to be hype by the intended audience and is not subjectable
  24. to quantitative analysis.  When you favorite toothpaste company brags that
  25. their new product "Tastes better than ever, better than any other toothpaste"
  26. this is puffery.  But if they say "our new toothpaste will prevent gum
  27. disease", then this is fraud, if it is not true.  Failure to abide by
  28. truth-in-advertising laws is illegal, and "overselling" is not permitted,
