- (Formerly S. 1220 and S. 341)

- ACTION: Call or fax a letter to your Senator, demanding that H.R. 776
- will be procedurally passed so that discussion on national energy
- strategy can continue and so that a bill will be passed this session.

- STATUS: Finally, H.R. 776 has been placed on the Senate calendar.
- Action is expected on late-Wednesday or early-Thursday before the full
- Senate. In what should be simply a procedural process, a filibuster may
- be mounted by Senators from Nevada who oppose the Yucca Mountain waste
- repository provisions in the bill. The Senate must merely bring the
- House bill to the floor, delete all of the language, insert the pre-
- approved Senate bill's (S. 2166) language, and vote on the "new" bill.
- Once this is complete, the House version of H.R. 776 and the "new"
- Senate version of H.R. 776 (S. 2166) can then begin to be reconciled in
- conference committee. Yet because Nevada opposes one small section of
- the bill, they will attempt to stall the bill in any way they can, which
- in this case, means stalling this procedural step. In order to invoke
- cloture (stop the filibuster), 60 Senators must vote in favor of
- stopping the prolonged debate. Sen. Majority Leader Mitchell (D-ME) has
- made a public statement saying that the vote will be too close to call.

- WHAT TO WRITE/SAY:

- 1. We've come too far on developing comprehensive energy policy to
- stop now. With the session quickly coming to a close, with
- elections nearing, and with a number of other highly debated
- bills yet to be resolved, Congress can't afford to let its two-
- years of work on energy policy be derailed.

- 2. Decide your opinion on forcing Nevada to be site of the only
- high-level waste by preempting the proper state channels and let
- it be known (full information on the so-called "screw Nevada"
- provisions can be found in other bill reviews and action alerts
- on these two bills).

- 3. Tell your Senators that one issue, nuclear waste, should not
- hinder a bill which promotes energy efficiency, alternative
- fuels, renewable energy, natural gas, reduced global emissions
- and a more "independent" general energy policy for the future.
- Either remove the "screw Nevada" provision and proceed or vote
- to invoke cloture keeping that language in the bill and proceed!
