  1. VocalTec Inc. Software License and Warranty Agreement

  3.                               30 days evaluation copy

  5. Carefully read all of the terms and conditions of this license
  6. agreement before using the Internet Phone(TM) software.
  7. By pressing the "accept button", you indicate your acceptance 
  8. of the following terms and conditions.
  9.  
  10. This is a binding legal agreement between you and VocalTec, Inc.
  11. concerning the use of the VocalTec software and constitutes the
  12. complete agreements between you and VocalTec, Inc.
  13.  
  14. AGREEMENT
  15. 1. Grant License
  16. VocalTec, Inc. grants to you the right to use the enclosed software 
  17. program ( the " SOFTWARE " ) for evaluation period of 30 days.

  20. 2. Copyright
  21. The SOFTWARE is owned by VocalTec, Inc. and is protected by
  22. United States copyright laws and international treaty provisions.
  23. Therefor, you must treat the SOFTWARE like any other copyright
  24. material except that you may either: ( a ) make one copy of the 
  25. SOFTWARE solely for backup or archival purposes, or ( b ) transfer 
  26. the SOFTWARE to a single hard disk , provided you keep the original 
  27. solely for backup purposes. You may not copy the written material
  28. accompanying the SOFTWARE.

  30. 3.  Other Restrictions
  31. You may not rent or lease the SOFTWARE, but you may transfer
  32. the SOFTWARE on permanent basis provided that the recipient 
  33. agrees to the terms of this Agreement. You may not reverse engineer
  34. , decompile or disassemble the SOFTWARE.

  36. 4. Dual Media Software
  37. If the software package contains both 3.5" and 5.25" disks,
  38. then you may use only the disks appropriate for your single
  39. designated computer. You may not use the other disks on a
  40. computer or loan , rent, or transfer them to another user except
  41. as a part of a permanent transfer ( as provided above) of all
  42. SOFTWARE and documentation.
  43.  
  44. WARRANTY
  45. Limited Software Warranty: If you discover physical defects in
  46. the media on which the software is distributed or in
  47. documentation, VocalTec, Inc. will replace the media or
  48. documentation for a period of ninety ( 90 ) days after purchase
  49. by the customer. You must return the disk or documentation to
  50. VocalTec within the warranty period, accompanied by proof of
  51. purchase.

  53. This warranty does not apply to defects due directly or
  54. indirectly to misuse, abuse, negligence, accident, repairs, or
  55. alterations made by the customer or another party, or if the
  56. VocalTec serial number has been removed or defected.
  57.  
  58. VocalTec, Inc. disclaims all implied warranties, including
  59. without limitation warranties of merchantability, performance
  60. and fitness for a particular purpose. VocalTec, Inc. will not
  61. be liable for any bug, error, omission, defect, deficiency, or
  62. nonconformity in any software. As a result, the SOFTWARE is
  63. sold : as is " and the purchaser assumes the entire risk as to
  64. its quality and performance.
