  1. VocalTec Inc. Software License and Warranty Agreement
  2.  
  3. Carefully read all of the terms and conditions of this license
  4. agreement before using the Internet Phone(TM) software.
  5. By pressing the "accept button", you indicate your acceptance 
  6. of the following terms and conditions.
  7.  
  8. This is a binding legal agreement between you and VocalTec, Inc.
  9. concerning the use of the VocalTec software and constitutes the
  10. complete agreements between you and VocalTec, Inc.
  11.  
  12. AGREEMENT
  13. 1. Grant License
  14. VocalTec, Inc. grants to you the right to use the enclosed software 
  15. program ( the " SOFTWARE " ) on any single computer , provided 
  16. the SOFTWARE is in use on only one computer at any time. If you 
  17. have multiple licenses for the SOFTWARE, then at any time you may 
  18. have as many copies of the SOFTWARE in use as you have licenses. 
  19. The SOFTWARE is " in use " on a computer when it is loaded into 
  20. temporary memory ( i.e. RAM ) or installed into the permanent 
  21. memory ( e.g. hard disk or other storage device ) of that computer.

  23. 2. Copyright
  24. The SOFTWARE is owned by VocalTec, Inc. and is protected by
  25. United States copyright laws and international treaty provisions.
  26. Therefor, you must treat the SOFTWARE like any other copyright
  27. material except that
  28. you may either: ( a ) make one copy of the SOFTWARE solely
  29. for backup or archival purposes, or ( b ) transfer the SOFTWARE
  30. to a single hard disk , provided you keep the original solely
  31. for backup purposes. You may not copy the written material
  32. accompanying the SOFTWARE.

  34. 3.  Other Restrictions
  35. You may not rent or lease the SOFTWARE, but you may transfer
  36. the SOFTWARE and accompanying written materials on permanent
  37. basis provided that you retain no copies and the recipient
  38. agrees to the terms of this Agreement. You may not reverse
  39. engineer, decompile or disassemble the SOFTWARE.

  41. 4. Dual Media Software
  42. If the software package contains both 3.5" and 5.25" disks,
  43. then you may use only the disks appropriate for your single
  44. designated computer. You may not use the other disks on a
  45. computer or loan , rent, or transfer them to another user except
  46. as a part of a permanent transfer ( as provided above) of all
  47. SOFTWARE and documentation.

  49. WARRANTY
  50. Limited Software Warranty: If you discover physical defects in
  51. the media on which the software is distributed or in
  52. documentation, VocalTec, Inc. will replace the media or
  53. documentation for a period of ninety ( 90 ) days after purchase
  54. by the customer. You must return the disk or documentation to
  55. VocalTec within the warranty period, accompanied by proof of
  56. purchase.

  58. This warranty does not apply to defects due directly or
  59. indirectly to misuse, abuse, negligence, accident, repairs, or
  60. alterations made by the customer or another party, or if the
  61. VocalTec serial number has been removed or defected.
  62.  
  63. VocalTec, Inc. disclaims all implied warranties, including
  64. without limitation warranties of merchantability, performance
  65. and fitness for a particular purpose. VocalTec, Inc. will not
  66. be liable for any bug, error, omission, defect, deficiency, or
  67. nonconformity in any software. As a result, the SOFTWARE is
  68. sold : as is " and the purchaser assumes the entire risk as to
  69. its quality and performance.
