  7. This license agreement covers all existing versions of jambient: 
  8. the beta ("prerelease") and final ("release") versions of "jambient" 
  9. and "jambientFREE," from now on referred to below as "jambient," 
  10. unless otherwise specified. 
  11.  
  12. Different terms apply to the use and distribution of "jambient" 
  13. and "jambientFREE", please read carefully.
  14.  
  15. 1. All rights not expressly granted here are reserved by David Morris.
  16.  
  17. 2. All copyrights to "jambient," "jambientFREE" and their documentation 
  18. are exclusively owned by the author - David Morris.
  19.  
  20. 3. "jambient" and the beta version of "jambient" are not free software. 
  21. a) Beta Test Versions. Subject to the terms below, you are hereby 
  22. licensed to use the beta test version of "jambient" for evaluation 
  23. purposes without charge. Beta test versions of "jambient" are configured 
  24. to expire on specific dates, and may not be used after their expiry. 
  25. b) Release versions. Subject to the terms below, you are hereby licensed 
  26. to use the release version of "jambient" for evaluation purposes without 
  27. charge for a 30 day evaluation period. If you intend to use the release 
  28. version on an ongoing basis, a registration fee is required. You can 
  29. register using the www.jambient.com web site and registration button 
  30. on the splash screen.

  32. 4. YOU MAY NOT DISTRIBUTE "JAMBIENT". David Morris does not grant 
  33. permission to distribute jambient for profit in any form, including 
  34. but not limited to, electronic information service distribution, 
  35. bulletin board distribution, and magnetic or optical medium distribution. 
  36. Non-profit distribution of the software is additionally restricted in the 
  37. same manner.

  39. 5. "jambientFREE" is freeware. David Morris grants a free license for 
  40. use of "jambientFREE". 
  41.  
  42. 6. "jambientFREE" may be distributed by permission of David Morris. 
  43. In all cases where permission is granted to distribute "jambientFREE," 
  44. exact copies of the original version, including all documentation are 
  45. to be distributed; charging or requesting donations for any such copies 
  46. is prohibited. Distributing the software and/or documentation with other 
  47. products (commercial or otherwise) requires express written permission.

  50. 7. "JAMBIENT" AND "JAMBIENTFREE" ARE DISTRIBUTED "AS IS".  NO WARRANTY 
  51. OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE "JAMBIENT" OR "JAMBIENTFREE"
  52.  AT YOUR OWN RISK. THE AUTHOR WILL NOT BE LIABLE FOR DATA LOSS, DAMAGES, 
  53. LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS 
  54. SOFTWARE.

  56. 8. You may not use, copy, emulate, clone, rent, lease, sell, modify, 
  57. decompile, disassemble, otherwise reverse engineer, or transfer the 
  58. licensed program ("jambient" or "jambientFREE"), or any subset of the 
  59. licensed program, except as provided for in this agreement. Any such 
  60. unauthorized use shall result in immediate and automatic termination 
  61. of this license and may result in criminal and/or civil prosecution.

  63. 9. The terms of this license, as well as the "jambient" and 
  64. "jambientFREE" interface design, are subjects of changes in future 
  65. versions of "jambient" and "jambientFREE".

  67. 10. When you register "jambient" the "Registration code" is being issued 
  68. to you. This "Registration code" can ONLY be used by the person (or 
  69. company) that purchased it. 
  70. 10.a) A "Registration code" purchased by a company can be used to 
  71. register jambient on ONLY ONE computer.
  72. 10.b) A "Registration code" purchased by an individual can be used to
  73. register jambient ON NO MORE THAN TWO computers owned by that individual,
  74. provided that the copies are not used at the same time. E.g., you can 
  75. use jambient on your studio computer, and also use it on your laptop in
  76. the club, but not at the same time.

  78. 11. You can only use a "Registration code" received from jambient.com or 
  79. a company affiliating or partnering with David Morris and having written 
  80. permission to distribute "Registration code". (At present RegNow is the 
  81. only such company.)

  83. 12. Installing and using "jambient" or "jambientFREE" signifies 
  84. acceptance of these terms and conditions of the license.

  86. 13. If you do not agree with the terms of this license or if the 
  87. terms of this license contradict with your local laws, you must 
  88. remove "jambient" and "jambientFREE" files from your storage devices 
  89. and cease to use the product.
