  1. License Agreement and Limited Warranty

  3. Important: Please read carefully before using this product.  
  4. Using this product indicates your acknowledgement that 
  5. you have read this License and you agree to be bound by 
  6. the terms and conditions of this License.  If you do not 
  7. agree to the terms of this license, you should return the 
  8. product and all accompanying items to the place of 
  9. purchase or RomTech within 10 days of purchase for a full 
  10. refund.  This License Agreement is proof of License.
  11.  
  12. Grant of License: RomTech, Inc. ("RomTech") provides you 
  13. the non-exclusive right to use the enclosed copy of software 
  14. program ("program" or "product") and accompanying printed 
  15. materials pursuant to the terms of this Agreement.  RomTech 
  16. reserves all rights not expressly granted under this Agreement.
  17.  
  18. Copy and Use Restrictions:
  19. You MAY DO the following:
  20.  
  21. 1. Use the software program for your own personal use.  If 
  22. you wish to use the program for more than one user, you will 
  23. need a further license for each user.
  24.  
  25. 2. Make one copy of the program for archive or back-up 
  26. purposes.
  27.  
  28. 3. Transfer the program to someone else, only if you assign all 
  29. of your rights under the License, cease all use of the program, 
  30. erase or destroy any copy (including the hard disk copy) made 
  31. in support of your use of the program, and the other person 
  32. agrees to the terms of this License.
  33.  
  34. 4. If the product is an upgrade from another product, whether 
  35. from another supplier or us, you may use or transfer the 
  36. product only in conjunction with the upgraded product, unless 
  37. you destroy it.  If the product is an upgrade from a RomTech 
  38. product, you may only use that upgraded product in 
  39. accordance with this License.

  41. Copy and Use Restrictions:
  42. You MAY NOT do the following:
  43.  
  44. 1. Use the product or make copies of it except as permitted in 
  45. this License.
  46.  
  47. 2. Copy any images, photographs, animations, video, audio, 
  48. music, and text incorporated in the program.  All such 
  49. materials are owned by RomTech or its suppliers and are 
  50. protected by copyright laws and international treaty provisions.

  52. 3. Translate, reverse engineer, decompile or dissemble the 
  53. program, except to the extent that the foregoing restriction is 
  54. expressly prohibited by applicable law.
  55.  
  56. 4. Rent, lease, assign or transfer the product except as set out 
  57. above.
  58.  
  59. 5. Modify the program or merger all or any part of the 
  60. program in another program.
  61.  
  62. Term:  This License shall continue for as long as you use the 
  63. product.  However, it will terminate if you fail to comply with 
  64. any of its terms or conditions.  You agree, upon termination, 
  65. to destroy all copies of the product.  The Limitations of 
  66. Warranties and Liability set out below shall continue in force 
  67. even after any termination.

  69. 90 Day Warranty: We warrant that the storage media in this 
  70. product will be free from defects in materials and 
  71. workmanship for 90 days from the date of purchase.  If such a 
  72. defect occurs, return it to us at the address below and we will 
  73. replace it free.  This remedy is your exclusive remedy for 
  74. breach of this warranty.  It gives you certain rights and you 
  75. may have other legislated rights which vary from jurisdiction 
  76. to jurisdiction.

  78. Limitation of Warranties and Liability: Except for the 
  79. expressed warranty above, the product is provided on an "as 
  80. is" basis, without any other warranties or conditions, expressed 
  81. or implied, including but not limited to warranties of 
  82. merchantable quality, merchantability or fitness for a 
  83. particular purpose, or those arising by law, statute, usage of 
  84. trade or course of dealing.  You assume the entire risk as to 
  85. the results and performance of the product.  Neither we nor 
  86. our dealers or suppliers shall have any liability to you or any 
  87. other person or entity for any indirect, incidental, special or 
  88. consequential damages whatsoever, including the possibility 
  89. of such damages or they are foreseeable; or for claims by a 
  90. third party. Our maximum aggregate liability to you and that 
  91. of our dealers and suppliers shall not exceed the amount paid 
  92. by you for the product.  The limitations in this section shall 
  93. apply whether or not the alleged breach or default is a breach 
  94. of a fundamental condition or term, or a fundamental breach.  
  95. Some states/countries do not allow the exclusion or limitation 
  96. of liability for consequential or incidental damages so the 
  97. above limitation may not apply to you.
  98.  
  99. General:  This License is the entire agreement between us, 
  100. supersedes any other agreement or discussions, oral or written 
  101. and may not be changed except by written signed agreement.  
  102. This License shall be governed by and construed in 
  103. accordance with the laws of the state of Pennsylvania, USA.  
  104. If any provision of this License is declared by a court of 
  105. competent jurisdiction to be invalid, illegal, or unenforceable, 
  106. such provision shall be severed from the License and the other 
  107. provisions shall remain in full force and effect.  The parties 
  108. have requested that this Agreement and all documents 
  109. contemplated hereby be drawn up in English.
