  34. ADOPTION AGREEMENT

  37. READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT TO RELEASE
  38. ALL RIGHTS IN REGARD TO THE CHILD TO BE BORN.

  41. @001, the BIOLOGICAL MOTHER, and @002, the BIOLOGICAL FATHER; 
  42. referred to collectively as the BIOLOGICAL PARENTS, 
  43.  
  44.  
  45. and @087, the ADOPTIVE MOTHER, and @088, the ADOPTIVE FATHER,
  46. referred to collectively as the ADOPTIVE PARENTS,
  47.

  49. agree:

  52. BIOLOGICAL PARENTS are the parents of a child, which is now being
  53. carried by BIOLOGICAL MOTHER, who is approximately @003 months
  54. pregnant. BIOLOGICAL PARENTS are aware that the ADOPTIVE PARENTS 
  55. are specifically reliant on BIOLOGICAL PARENTS for these
  56. representations.

  59. BIOLOGICAL PARENTS desire to allow the child to be adopted by the
  60. ADOPTIVE PARENTS. BIOLOGICAL PARENTS understand that:
  61.  
  62.  
  63. (a) their parental rights will be lost and terminated by this
  64. agreement;
  65.  
  66.  
  67. (b) that they will have no legal rights as to the child as a
  68. result of this agreement whatsoever, including visitation of any
  69. kind;
  70.  
  71.  
  72. (c) that the ADOPTIVE PARENTS by this agreement will become the 
  73. only legal parents of the child;
  74.  
  75.  
  76. (d) that this agreement is binding and legally valid, and there
  77. will be no opportunity to change decisions made; and,
  78.  
  79.  
  80. (e) that this is a final legal agreement for BIOLOGICAL PARENTS 
  81. to turn over all rights as to the child to be born.

  84. BIOLOGICAL MOTHER agrees to obtain medical advice from qualified
  85. practitioners throughout her pregnancy. BIOLOGICAL MOTHER agrees 
  86. that ADOPTIVE PARENTS may have full and complete access to such 
  87. records.

  90. And, in consideration of this agreement, that BIOLOGICAL 
  91. PARENTS will receive the following reimbursement of expenses from
  92. ADOPTIVE PARENTS:
  93.

  95. $@004 (!004 dollars)

  98. This fund will be deposited by ADOPTIVE PARENTS within three 
  99. days of the final signature to this agreement, with @100
  100. (referred to as AGENT); and, prior to any disbursement from
  101. the funds, BIOLOGICAL PARENTS will each be required to sign an 
  102. affirmation of this agreement before any disbursements are made. 
  103. The agent will pay from this fund the actual costs of the 
  104. pregnancy of the BIOLOGICAL MOTHER. BIOLOGICAL PARENTS will 
  105. provide bills for all such expenses to agent. The maximum amount 
  106. of such reimbursement shall be $@005 (!005 dollars). ADOPTIVE 
  107. PARENTS shall upon exhaustion of the fund at any time replenish 
  108. the fund to the limit agreed upon.

  112. In addition to reimbursement of actual costs of the pregnancy,
  113. BIOLOGICAL MOTHER shall be entitled to a living allowance of 
  114. $@300 (!300 dollars) per month up to and including the month of 
  115. labor and delivery.

  119. BIOLOGICAL PARENTS shall provide any and all reasonable
  120. cooperation required by ADOPTIVE PARENTS on request including 
  121. execution of any legal documents required by ADOPTIVE PARENTS, 
  122. and attendance at any legal hearings required.

  125. This agreement shall be confidential, and all parties hereto 
  126. agree that the existence of this agreement and adoption shall be 
  127. private and confidential.

  130. The nature of this agreement is for unique and personal services
  131. and modification of legal rights, and the parties agree that this
  132. agreement may be specifically enforced.
