  1. W i n N E T   M a i l (TM)

  3. Terms and Conditions.
  4.  
  5. 1.  The WinNET Mail (TM) software is distributed freely for
  6.     the purpose of connecting with the WinNET service.
  7.     There is no charge for the software as long as it is
  8.     used for this purpose. 
  9.  
  10. 2.  The WinNET service is billed on a connect time basis at
  11.     the rate of 
  12.  
  13.             $8.00 per connect hour.
  14.         
  15.     There is a minimum connect time charge of
  16.  
  17.             $9.95 per month
  18.  
  19.     and a minimum account charge of
  20.  
  21.             $9.95 over the life-time of the account.
  22.  
  23.     The minimum monthly charge is prorated to the actual
  24.     number of days of service in the first month of service
  25.     and in the last month of service. 
  26.     
  27.     There is no charge for new account set up other than
  28.     a minimum life-time charge of $9.95 per account. 
  29.     Accounts that are created and then disconnected before
  30.     billing $9.95 in connect time or monthly minimum
  31.     charges will be billed a total of $9.95.

  33.     Connect time is recorded in increments of one minute. 
  34.     Fractions of minutes are billed as full minutes.  All
  35.     amounts are denominated in U.S. dollars.

  37. 3.  Payment.  As part of your account registration we
  38.     request a credit card number for payment.  You will be
  39.     charged $9.95 when you first establish your account as
  40.     your account's life-time minimum charge.  This $9.95 is
  41.     fully credited toward connect time charges and your
  42.     monthly minimums if you continue your account.

  44.     You will be sent a statement of account usage via
  45.     WinNET mail on the 2nd of each month.  Your credit card
  46.     will be charged for the amount on the statement.
  47.     
  48.     Other payment arrangements are possible, please contact
  49.     us. 
  50.  
  51. 4.  Ending Service.  If you choose to terminate your account
  52.     on WinNET, all you need to do is contact us by WinNET
  53.     Mail, letter, or telephone.  We will end your service on
  54.     the date that you request and prorate your minimum
  55.     charge for that month accordingly.

  57. 5.  Computer Witchcraft exercises no control whatever over
  58.     the content of the information passing through the
  59.     WinNET system.  Computer Witchcraft is not responsible
  60.     for the accuracy, quality, or content of the information
  61.     obtained through its service.  Computer Witchcraft makes
  62.     no warranty, whether expressed or implied, for the
  63.     service it offers.  Computer Witchcraft disclaims any
  64.     warranty of merchantability of fitness for a particular
  65.     purpose.

  67. 6.  Computer Witchcraft makes no warranty whether expressed
  68.     or implied for the WinNET Mail software.  No warranty of
  69.     merchantability or fitness for a particular purpose is
  70.     provided for the WinNET Mail software. 
  71.  
  72. 7.  WinNET may only be used for lawful purposes.
  73.     Transmission of any material in violation of United
  74.     States law, laws of the nation in which WinNET is used,
  75.     or state law or regulation is prohibited.  This 
  76.     includes, but is not limited to: copyrighted material,
  77.     material legally judged to be threatening or obscene, or
  78.     material protected by trade secret.  You agree to
  79.     indemnify and hold harmless Computer Witchcraft from any
  80.     claims resulting form your use of the WinNET service or
  81.     WinNET Mail software which damages you or another party.

  83. 8.  The WinNET Mail (TM) software may be distributed by you
  84.     to others as long as you agree to all conditions listed
  85.     in the READ-1ST.TXT and VENDOR.TXT files.
