  6. This agreement between The Birdsong Company herein called TBC and
  7. the person or organization named as "Licensee", herein called
  8. Licensee, is the full understanding between TBC and Licensee.
  9.  
  10. TBC grants to Licensee a, non-exclusive, non-transferable, 
  11. non-assignable license to use software known as "Waffle File
  12. Server", herein called WFS.  Title to WFS and its documentation 
  13. belong to TBC.
  14.  
  15. The one-time license fee for individuals and "Small Business" is
  16. $17.00 (US Dollars) for each machine on which WFS is run; what a
  17. "Small Business" is is determined by TBC. Others are invited to
  18. send a Request For Quote (RFQ) on your company letterhead.
  19.  
  20. License fees are payable via checks to "The Birdsong Company".  
  21. Checks should be in US dollars, drawn on a US branch of a US bank. 
  22.  
  23. Licensee will pay TBC a one-time fee of ________ Dollars ($________)
  24. for the license to use this Software.
  25.  
  26. Licensee may make a reasonable number of copies of WFS for back up
  27. and recovery purposes.

  29. TBC disclaims all warranties relating to this software, express or
  30. implied, including without limitation any implied warranties of
  31. merchantability or fitness for a particular purpose. TBC will not
  32. be liable for any special, incidental, consequential, indirect or
  33. similar damages due to loss of data or any other reason, even if
  34. TBC has been advised of the possibility of such damages.  In no
  35. event shall TBC's liability for any damages ever exceed the price
  36. paid for the license to use the software. Redistribution or reverse
  37. engineering penalty fees are not refundable under any circumstance.

  39. This Agreement, and all amendments, modifications, alterations, or
  40. supplements, shall be governed by the law of the State of California.
