  4.             SUMMARY OF STATE LIVING WILL LEGISLATION
  5.  
  6. TENNESSEE

  8. Synopsis: Tennessee is a strong living will state. The statute
  9. requires that a physician either implement the living will or
  10. inform the next of kin of the patient of his refusal, and then
  11. must assist in transferring the patient. To prepare a Tennessee 
  12. living will using the state suggested form, please select living 
  13. will preparation from the opening menu. Remember that the 
  14. publisher recommends preparing a "uniform" living will in 
  15. addition to the form suggested with by the State of Tennessee. 
  16. Please also consider executing a living will for any State that 
  17. you spend more than a few weeks per year, or where you are a 
  18. temporary resident.

  28. Witness requirements: Number: 2 Relationship: The statute 
  29. requires that witnesses not be related to the declarant by blood 
  30. or marriage, may not be the attending physician and employees of 
  31. the attending physician/hospital where the declarant is a 
  32. patient, may not be a person who is entitled to any part of the 
  33. declarant's estate and cannot have a claim against the estate.

  35. Recording of the living will is not provided for by the statute 
  36.  
  37. Revocation of the living will may be made by a separate written
  38. instrument of revocation. A verbal revocation is effective
  39. if made by the patient to the attending physician.
