  5. I respectfully request that my military records be corrected to
  6. show that I was released from active duty where it was determined

  8. Department of the Army notifying me of this action dated 22 April
  9. 1975, is enclosed as Encl. 1.  DD form 214, Encl. 2.

  11. A report of medical examination at the time of my release from
  12. active duty refleted  that I suffered from an injury right ulnar
  13. nerve due to fragment wound IRHA 7 April 72; Multiple fragment
  14. wounds with retained metal fragments both lower extremities;
  15. Scars from multiple fragment wounds, bridge of nose, mandible as
  16. well as lower extremities; Dermatofibroma, left thigh; and
  17. Neuropraxia right ulnar nerve with numbness and paresthesia of
  18. upper extremity.  Encl 3.  Upon application to the Department of
  19. Veterans Affairs I was initially awarded a 100% rating effective
  20. 13 June, 1973 which was subsequenty reduced to the current
  21. combined rating of 40%. Encl 4.

  23. Clearly the conditions which were made the basis for the
  24. Department of Veterans Affairs award of service connected
  25. disability compensation were shown to have been present at the
  26. time of may release from active duty.  A review of all the
  27. documents I have submitted herewith establishes  that I was at
  28. least 30% disabled at the time of my release from active duty.
  29. Therefore  I should have been afforded the consideration by a
  30. Physical Evaluation Board and then placed on the Physical
  31. Disability Retired List rather than seperation due expiration of
  32. term of service.

  34. I therefore request that the Board for the Correction of Military
  35. Records take such action as is necessary to retroactively place
  36. me in disability retirement.
