DD form 214, Encl. 2. A report of medical examination at the time of my release from active duty refleted that I suffered from an injury right ulnar nerve due to fragment wound IRHA 7 April 72; Multiple fragment wounds with retained metal fragments both lower extremities; Scars from multiple fragment wounds, bridge of nose, mandible as well as lower extremities; Dermatofibroma, left thigh; and Neuropraxia right ulnar nerve with numbness and paresthesia of upper extremity. Encl 3. Upon application to the Department of Veterans Affairs I was initially awarded a 100% rating effective 13 June, 1973 which was subsequenty reduced to the current combined rating of 40%. Encl 4. Clearly the conditions which were made the basis for the Department of Veterans Affairs award of service connected disability compensation were shown to have been present at the time of may release from active duty. A review of all the documents I have submitted herewith establishes that I was at least 30% disabled at the time of my release from active duty. Therefore I should have been afforded the consideration by a Physical Evaluation Board and then placed on the Physical Disability Retired List rather than seperation due expiration of term of service. I therefore request that the Board for the Correction of Military Records take such action as is necessary to retroactively place me in disability retirement.
