Dear Sir:
Please accept this letter as renunciation of improved pension
benefits in accordance with the VA General Counsel Memorandum,
June 1, 1989, which concluded that under 38 U.S.C. sec. 3106, a
claimant has (a) the right to renounce improved pension benefits
and following such renunciation, (b) the right to file a new
application for the same benefits which, according to the General
Counsel, must be treated as an original claim.
Enclosed you will find letters from the Social Security
Administration concerning the recent lump sum payments which my
dependents and I have received. I am renouncing my VA pension
because I would otherwise incur an overpayment. You will also
find that I have enclosed a new application for pension benefits
in accordance with paragraph (b) above.
Your expeditious action in this matter will be appreciated.
