  5. I respectfully request that my military records be corrected to 
  6. show that I was released from active duty where it was determined
  7. that I was unfit by reason of physical disability to perform the
  8. duties of my office, grade, rank or rating.

  10. I was release from active duty on {          } and {transferred/
  11. discharged} to the standby reserve component until final discharge
  12. on {          } .  A letter from Department of the Army notifying 
  13. me of this action dated {22 April 1975}, is enclosed as Encl. 1. 
  14. DD form 214, Encl. 2.

  16. A report of medical examination at the time of my release from 
  17. active duty reflected  that I suffered from an {injury right ulnar
  18. nerve due to fragment wound IRHA 7 April 72; Multiple fragment 
  19. wounds with retained metal fragments both lower extremities; 
  20. Scars from multiple fragment wounds, bridge of nose, mandible as
  21. well as lower extremities; Dermatofibroma, left thigh; and 
  22. Neuropraxia right ulnar nerve with numbness and paresthesia of 
  23. upper extremity.  Encl 3.} Upon application to the Department of
  24. Veterans Affairs I was initially awarded a {100%} rating effective
  25. 13 June, 1973 which was subsequently reduced to the current 
  26. combined rating of 40%. Encl 4.

  28. Clearly the conditions which were made the basis for the 
  29. Department of Veterans Affairs award of service connected 
  30. disability compensation were shown to have been present at the 
  31. time of may release from active duty.  A review of all the 
  32. documents I have submitted herewith establishes  that I was at 
  33. least 30% disabled at the time of my release from active duty. 
  34. Therefore  I should have been afforded the consideration by a 
  35. Physical Evaluation Board and then placed on the Physical 
  36. Disability Retired List rather than separation due expiration of
  37. term of service.

  39. I therefore request that the Board for the Correction of Military
  40. Records take such action as is necessary to retroactively place 
  41. me in disability retirement.
