  5. This version of the DivX Open License supercedes any prior versions.

  7. Copyright (C) 2001 Project Mayo. Everyone is permitted to copy and

  11. Provided below is our open source license agreement ("License") under 
  12. which we provide the Codec (defined below) to you free of charge. 
  13. Please read it carefully.

  15. BY USING, COPYING, MODIFYING, OR DISTRIBUTING THE CODEC OR A LARGER 
  16. WORK (DEFINED BELOW), YOU INDICATE YOUR ACCEPTANCE OF THIS LICENSE 
  17. TO DO SO, AND ALL ITS TERMS AND CONDITIONS.

  19. For purposes of this Agreement, the "Codec" shall mean the OpenDivX 
  20. compression/decompression software provided to you by Project Mayo 
  21. ("Project Mayo") and any derivative work thereof, that is to say, a 
  22. work containing the Codec or a portion of it, either verbatim or with 
  23. modifications and/or translated into another language. A "Larger Work"
  24. shall mean any work including or integrating the Codec as an object 
  25. file or linked library. "Encoded Content" shall mean any multimedia 
  26. content encoded as output of the Codec, even if that Codec is 
  27. integrated into a Larger Work.
  28.  
  29. Permission is granted to you to use the Codec for any purpose, 
  30. and to copy it, alter it and redistribute it, subject to the 
  31. following:
  32.  
  33. 1. You may modify your copy or copies of the Codec or any portion
  34.  of it, provided that you cause the modified files to carry 
  35. prominent notices stating that you changed the files and the 
  36. date of any such change.
  37.  
  38. 2. You may copy, distribute, display and transmit the Codec's 
  39. source code, in any medium, subject to the following:
  40.  
  41. a. You must conspicuously and appropriately publish on each copy 
  42. an appropriate copyright notice and disclaimer of warranty; keep 
  43. intact all the notices that refer to this License and to the absence 
  44. of any warranty; and give any other recipients of the Codec a copy of
  45. this License along with the Codec.

  47. b. You must cause any Codec that you distribute or publish to be licensed
  48. as a whole at no charge to all third parties under the terms of this 
  49. License. However, you may charge a fee for the physical act of transferring
  50. a copy of the Codec, and you may at your option offer warranty protection

  53. c. In each instance in which you attribute ownership or authorship of 
  54. the Codec you will include an acknowledgement in a location viewable 
  55. to users of the Codec as follows: "This product includes software 
  56. developed by or derived from software developed by Project Mayo." 
  57. In any event, the origin of the Codec must not be misrepresented; you 
  58. must not claim sole authorship in the Codec.

  60. d. Each time you redistribute the Codec, the recipient automatically 
  61. receives a license from Project Mayo to copy, distribute or modify the 
  62. Codec subject to these terms and conditions. You may not impose any 
  63. further restrictions on the recipients' exercise of the rights granted herein.

  65. 3. You may copy and distribute the Codec in object code or executable 
  66. form under the terms of Section 2, provided that you also accompany 
  67. it with the complete machine-readable source code, or make such 
  68. source-code freely and publicly available.
  69.  
  70. 4. You may incorporate the Codec into a Larger Work and distribute 
  71. that Larger Work under terms of your choice, provided that:
  72.  
  73. a. The terms permit modification of the work for the customer's own 
  74. use and reverse engineering for debugging such modifications.
  75.  
  76. b. You include an acknowledgement in a location viewable to users 
  77. of a distribution of a Larger Work as follows: "This product includes 
  78. software developed by or derived from software developed by Project Mayo."

  80. 5. Any Codec or Larger Works created by you must conform to the 
  81. MPEG-4 Video Standard, however modules of the Codec that do not 
  82. derive from MoMuSys can be used and incorporated into a non-MPEG-4 
  83. conforming work that otherwise complies with this license.

  85. 6. Except as provided in section 7 below, you must receive prior 
  86. express written permission from Project Mayo before you use the names 
  87. "DivX;-)" or "DivX" (or any names incorporating those names) or the 
  88. file extensions ".divx" or ".div" to promote or endorse any products 
  89. derived from the Codec, including, but not limited to Larger Works.

  91. 7. You must use the ".divx" file extension in any Encoded Content, 
  92. when tools for this purpose are readily available. For Encoded Content 
  93. used for a commercial purpose, you must prominently display the 
  94. "Encoded in DivX" logo on the package of any Encoded Content in a 
  95. manner immediately visible to viewers and you must include the 
  96. "Encoded in DivX" video logo at the beginning of any Encoded Content 
  97. when the means for such display are reasonably available.

  99. 8. The Codec contains copyrighted materials that are proprietary to 
  100. Project Mayo, and no rights are granted to you except as expressly provided 
  101. herein. You may not copy, modify, sublicense, display, distribute or 
  102. transmit the Codec except as expressly provided under this License. Any 
  103. act or attempt to copy, modify, sublicense, display, distribute or transmit 
  104. the Codec other than as permitted herein will automatically terminate your 
  105. rights under this License. However, parties who have received copies 
  106. from you under this License will not have their licenses terminated so 
  107. long as such parties remain in full compliance.

  109. THIS CODEC IS PROVIDED BY PROJECT MAYO AND ITS CONTRIBUTORS "AS IS" AND ANY 
  110. EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO THE IMPLIED 
  111. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND 
  112. NON-INFRINGEMENT ARE DISCLAIMED. IN NO EVENT SHALL PROJECT MAYO OR ITS 
  113. CONTRIBUTORS BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, 
  114. EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, 
  115. PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOSS OF USE, DATA OR PROFITS; 
  116. OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY 
  117. WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR 
  118. OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF 
  119. ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
