  10. IMPORTANT! PLEASE READ THIS LICENSE AGREEMENT CAREFULLY BEFORE USING
  11. THE SOFTWARE 'The Next Tool' for Windows(R) 95 - V1.91! IF YOU DON'T
  12. AGREE TO THIS LICENSE AGREEMENT, YOU MAY NOT USE THIS VERSION OF THE
  13. SOFTWARE.
  14. IF YOU ARE GOING TO REPLACE AN OLD VERSION OF THE SOFTWARE 'The Next
  15. Tool' for Windows(R) 95, THIS LICENSE AGREEMENT SHALL BE VALID FOR THE
  16. NEW VERSION OF THE SOFTWARE. IF YOU DECIDE TO USE THE OLD VERSION OF
  17. THE SOFTWARE, THE INITIAL LICENSE AGREEMENT REMAINS VALID.

  19. This license agreement is an agreement between the authors of the
  20. software 'The Next Tool' for Windows(R) 95, Christian Hagenah and
  21. Joerg Schliesser, and you, the user of the software. ('User' can be
  22. any individual person as well as a legal entity.) By using the software
  23. 'The Next Tool' for Windows(R) 95 or by distributing the software
  24. to a third person, you accept the terms of this license agreement.

  35. I. Grant of Usage

  37. The software 'The Next Tool' for Windows(R) 95 is shareware. That
  38. means you can try out the software for 45 days free of charge. If you
  39. want to use the software after the 45 day evaluation period, you have
  40. to purchase a registered user license. If you purchase the license,
  41. you will get a personal registration code to register the software
  42. and the right to use the software permanently.

  44. If you use a version of the software that is not registered, a
  45. shareware reminder will appear about 10 days after the software was
  46. installed. After 45 days the reminder screen will temporarily block
  47. the use of the program and you can remove the reminder screen without
  48. quitting the program only after an increasing period of time.
  49.  
  50. Purchasing a registered user license and a registration code only
  51. entitles the use of the software by one person on one computer system
  52. at one given moment in time. If the software is to be used on a number
  53. of computer systems at the same time, a registered user license and
  54. registration code must be purchased for each installation of the
  55. software.

  57. The software may be duplicated and distributed without a registration
  58. code according to the guidelines that are named below. Renting, lending
  59. or modifying the software is not permitted. Decompiling, disassembling
  60. or reverse engineering the software is only permitted to obtain
  61. information that is necessary to establish the interoperability of
  62. a computer program that was created independently.

  66. II. Exclusion of High Risk Activities

  68. The software 'The Next Tool' for Windows(R) 95 is not fault-tolerant
  69. and is not designed, manufactured or intended for use in hazardous
  70. environments requiring fail-safe performance.
  71. You may not use 'The Next Tool' on or in conjuncton with systems that
  72. serve the operation of power stations, nuclear facilities, aircraft
  73. navigation or communication, air, sea or street traffic control, direct
  74. life support, medical diagnosis or industrial process control. You may
  75. also not use 'The Next Tool' on or in conjunction with any system, where
  76. failure of the software could lead directly to death, personal injury,
  77. or severe physical or environmental damage. You may also not use 'The
  78. Next Tool' on or in conjunction with systems that are interlinked with
  79. systems that serve any of the purposes named above.

  83. III.  Limited Warranty and Disclaimer of Liability
  84.  
  85. You have the chance to try out the software 'The Next Tool' for
  86. 45 days free of charge. The general duty of care and good data
  87. processing procedure dictate that any program be thoroughly tested
  88. with non-critical data before relying on it. You must assume the
  89. entire risk of using the program when testing it. The authors shall
  90. not be liable for any damages or costs, direct or consequential,
  91. that arise from the free use of the software.

  93. The software is supplied as is. As the software may be used in various
  94. hardware and software environments that are not foreseeable by the
  95. authors, there is no warranty for the correctness of the software and
  96. its suitability for a certain purpose.

  98. During the free of charge test period, you must determine that the
  99. software sufficiently meets your requirements. The purchase of a
  100. registered user license takes place for the software 'as is' during
  101. the test period. No claims may arise from the purchase of a registered
  102. user license for the removal of defects that are obvious and/or known
  103. to the user before the purchase of the license.

  105. The registration code that you get if you purchase a registered user
  106. license will also work with other versions of the software 'The Next
  107. Tool' for Windows(R) 95. (Note: If you purchase a license through a
  108. reseller, you may obtain a registration code that doesn't work with
  109. other versions of the software. In this case, you can contact the
  110. authors and send a proof of purchase in order to get a registration
  111. code that also works with other versions of the software.) It is up
  112. to you to decide whether or not to use another version of the software.
  113. However, other versions may differ from the version for which the
  114. registered user license was purchased. The authors don't warrant that
  115. other versions of the software show the same behaviour or offer the
  116. same features. Before using another version of the software, you have to
  117. determine that the other version sufficiently meets your requirements.
  118. The general duty of care and good data processing procedure dictate
  119. that any program be thoroughly tested with non-critical data before
  120. relying on it. You must assume the entire risk of using another version
  121. of the program when testing it. The authors shall not be liable for any
  122. damages or costs, direct or consequential, that arise from the free
  123. use of another version of the software. No claims may arise from the
  124. purchase of a registered user license that other versions of the
  125. software show a certain behaviour or offer certain features. If you are
  126. not satisfied with another version of the software, you can still use
  127. the version of the software that you had the chance to evaluate before
  128. purchasing the registered user license.

  130. In the case of a complaint, the licensee is committed to send his
  131. registration code, a proof of purchase and a comprehensible and
  132. verifiable description of the defect to the authors. The warranty
  133. period is six months from the date of the purchase of the registered
  134. user license. If a repair or the delivery of a replacement does not
  135. remove an essential defect within a reasonable period of time, the
  136. licensee has the right to step back from the agreement or demand
  137. a reduction of the license fee.

  139. The authors shall not be liable for defects or damages that arise from
  140. a modification of the software by a third person, from a use of the
  141. software that does not correspond to the functionality as it is
  142. described in the documentation or from the non-observance of notes
  143. in the documentation or this license agreement. In these cases, the
  144. authors shall especially not be liable for side effects or damaging
  145. after-effects of a defect.

  147. The authors shall only be liable for damages of the licensee as far
  148. as they arise from intentional actions or gross negligence or from the
  149. violation of an essential duty by the authors or as far as they have
  150. to be compensated according to applicable law.
  151. The entire liability of the authors and the user's exclusive remedy
  152. shall be, at the option of the authors, either the return of the license
  153. fee paid, or the repair or replacement of the software. Further claims
  154. by the licensee are excluded.

  156. This limitation of liability is valid for all claims of compensation,
  157. regardless of the cause in law. The limitation of liability does not
  158. cover damages for which an imperative legal liability exists. For any
  159. other damaging after-effects of a defect, the authors shall only be
  160. liable in the limited way described above.

  164. IV. Distribution Requirements

  166. The software 'The Next Tool' for Windows(R) 95 is protected by copyright
  167. laws and international copyright treaties. The software may be duplicated
  168. and distributed as an unregistered version, that means only without a
  169. registration code, according to the following guidelines and provided
  170. that none of the conditions of this license agreement are violated.
  171.  
  172. - The software may only be distributed completely, including all files
  173. that are named below. None of the files may be modified or omitted.
  174.  
  175. - The distribution has to be free of charge or for a common contribution
  176. towards expenses.
  177.  
  178. - Including the software in shareware collections and the distribution
  179. on shareware CD-ROMs as well as spreading the software through computer
  180. networks, the Internet and online services is allowed.

  182. - Selling the software commercially or distributing it as the sole
  183. program on a data carrier without written permission of the authors
  184. is not permitted.

  186. The authors reserve themselves the right to limit or revoke the right
  187. to distribute the software for individual persons without giving any
  188. reasons.

  260. This agreement is subject to German law. The 'Convention on Contracts
  261. for the International Sale of Goods' is excluded. The exclusive place
  262. of jurisdiction is Stuttgart (Germany) for all disputes that may arise
  263. from this license agreement or from the use of the software. However,
  264. the authors remain authorized to take legal actions against the
  265. licensee at his general place of jurisdiction.

  267. If some parts of this license agreement are or become partly or
  268. entirely invalid or incomplete according to applicable law, the
  269. validity of the remaining parts of the agreement is not impaired.

  271. The transferal of rights from this license agreement by the licensee
  272. is excluded.
