PLEASE READ THIS LICENSE AGREEMENT CAREFULLY BEFORE USING THE SOFTWARE 'The Next Tool' for Windows(R) 95 - V1.91! IF YOU DON'T AGREE TO THIS LICENSE AGREEMENT, YOU MAY NOT USE THIS VERSION OF THE SOFTWARE. IF YOU ARE GOING TO REPLACE AN OLD VERSION OF THE SOFTWARE 'The Next Tool' for Windows(R) 95, THIS LICENSE AGREEMENT SHALL BE VALID FOR THE NEW VERSION OF THE SOFTWARE. IF YOU DECIDE TO USE THE OLD VERSION OF THE SOFTWARE, THE INITIAL LICENSE AGREEMENT REMAINS VALID. This license agreement is an agreement between the authors of the software 'The Next Tool' for Windows(R) 95, Christian Hagenah and Joerg Schliesser, and you, the user of the software. ('User' can be any individual person as well as a legal entity.) By using the software 'The Next Tool' for Windows(R) 95 or by distributing the software to a third person, you accept the terms of this license agreement. I. Grant of Usage II. Grant of Usage The software 'The Next Tool' for Windows(R) 95 is shareware. That means you can try out the software for 45 days free of charge. If you want to use the software after the 45 day evaluation period, you have to purchase a registered user license. If you purchase the license, you will get a personal registration code to register the software and the right to use the software permanently. If you use a version of the software that is not registered, a shareware reminder will appear about 10 days after the software was installed. After 45 days the reminder screen will temporarily block the use of the program and you can remove the reminder screen without quitting the program only after an increasing period of time. Purchasing a registered user license and a registration code only entitles the use of the software by one person on one computer system at one given moment in time. If the software is to be used on a number of computer systems at the same time, a registered user license and registration code must be purchased for each installation of the software. The software may be duplicated and distributed without a registration code according to the guidelines that are named below. Renting, lending or modifying the software is not permitted. Decompiling, disassembling or reverse engineering the software is only permitted to obtain information that is necessary to establish the interoperability of a computer program that was created independently. II. Exclusion of High Risk Activities The software 'The Next Tool' for Windows(R) 95 is not fault-tolerant and is not designed, manufactured or intended for use in hazardous environments requiring fail-safe performance. You may not use 'The Next Tool' on or in conjuncton with systems that serve the operation of power stations, nuclear facilities, aircraft navigation or communication, air, sea or street traffic control, direct life support, medical diagnosis or industrial process control. You may also not use 'The Next Tool' on or in conjunction with any system, where failure of the software could lead directly to death, personal injury, or severe physical or environmental damage. You may also not use 'The Next Tool' on or in conjunction with systems that are interlinked with systems that serve any of the purposes named above. III. Limited Warranty and Disclaimer of Liability You have the chance to try out the software 'The Next Tool' for 45 days free of charge. The general duty of care and good data processing procedure dictate that any program be thoroughly tested with non-critical data before relying on it. You must assume the entire risk of using the program when testing it. The authors shall not be liable for any damages or costs, direct or consequential, that arise from the free use of the software. The software is supplied as is. As the software may be used in various hardware and software environments that are not foreseeable by the authors, there is no warranty for the correctness of the software and its suitability for a certain purpose. During the free of charge test period, you must determine that the software sufficiently meets your requirements. The purchase of a registered user license takes place for the software 'as is' during the test period. No claims may arise from the purchase of a registered user license for the removal of defects that are obvious and/or known to the user before the purchase of the license. The registration code that you get if you purchase a registered user license will also work with other versions of the software 'The Next Tool' for Windows(R) 95. (Note: If you purchase a license through a reseller, you may obtain a registration code that doesn't work with other versions of the software. In this case, you can contact the authors and send a proof of purchase in order to get a registration code that also works with other versions of the software.) It is up to you to decide whether or not to use another version of the software. However, other versions may differ from the version for which the registered user license was purchased. The authors don't warrant that other versions of the software show the same behaviour or offer the same features. Before using another version of the software, you have to determine that the other version sufficiently meets your requirements. The general duty of care and good data processing procedure dictate that any program be thoroughly tested with non-critical data before relying on it. You must assume the entire risk of using another version of the program when testing it. The authors shall not be liable for any damages or costs, direct or consequential, that arise from the free use of another version of the software. No claims may arise from the purchase of a registered user license that other versions of the software show a certain behaviour or offer certain features. If you are not satisfied with another version of the software, you can still use the version of the software that you had the chance to evaluate before purchasing the registered user license. In the case of a complaint, the licensee is committed to send his registration code, a proof of purchase and a comprehensible and verifiable description of the defect to the authors. The warranty period is six months from the date of the purchase of the registered user license. If a repair or the delivery of a replacement does not remove an essential defect within a reasonable period of time, the licensee has the right to step back from the agreement or demand a reduction of the license fee. The authors shall not be liable for defects or damages that arise from a modification of the software by a third person, from a use of the software that does not correspond to the functionality as it is described in the documentation or from the non-observance of notes in the documentation or this license agreement. In these cases, the authors shall especially not be liable for side effects or damaging after-effects of a defect. The authors shall only be liable for damages of the licensee as far as they arise from intentional actions or gross negligence or from the violation of an essential duty by the authors or as far as they have to be compensated according to applicable law. The entire liability of the authors and the user's exclusive remedy shall be, at the option of the authors, either the return of the license fee paid, or the repair or replacement of the software. Further claims by the licensee are excluded. This limitation of liability is valid for all claims of compensation, regardless of the cause in law. The limitation of liability does not cover damages for which an imperative legal liability exists. For any other damaging after-effects of a defect, the authors shall only be liable in the limited way described above. IV. Distribution Requirements The software 'The Next Tool' for Windows(R) 95 is protected by copyright laws and international copyright treaties. The software may be duplicated and distributed as an unregistered version, that means only without a registration code, according to the following guidelines and provided that none of the conditions of this license agreement are violated. - The software may only be distributed completely, including all files that are named below. None of the files may be modified or omitted. - The distribution has to be free of charge or for a common contribution towards expenses. - Including the software in shareware collections and the distribution on shareware CD-ROMs as well as spreading the software through computer networks, the Internet and online services is allowed. - Selling the software commercially or distributing it as the sole program on a data carrier without written permission of the authors is not permitted. The authors reserve themselves the right to limit or revoke the right to distribute the software for individual persons without giving any reasons. V. General This agreement is subject to German law. The 'Convention on Contracts for the International Sale of Goods' is excluded. The exclusive place of jurisdiction is Stuttgart (Germany) for all disputes that may arise from this license agreement or from the use of the software. However, the authors remain authorized to take legal actions against the licensee at his general place of jurisdiction. If some parts of this license agreement are or become partly or entirely invalid or incomplete according to applicable law, the validity of the remaining parts of the agreement is not impaired. The transferal of rights from this license agreement by the licensee is excluded.
