  1. The following appeared on the back cover of a mailing from Parc Place
  2. Systems to its customers in January 1991.

  4. Patent nonsense, and what to do about it
  5. ----------------------------------------

  7. The laws regarding copyrighting and patenting of software (beyond the
  8. traditional use of copyright to prevent copying of actual code or
  9. specific screen images) are in a state of turmoil. There is
  10. controversy as to whether the new, broadened concepts of
  11. "look-and-feel copyright" and software patenting are helpful or
  12. harmful to the industry. Recent lawsuits and counter-suits have made
  13. it clear that this is an important issue, with high stakes.

  15. At least one organization, the League for Programming Freedom, has
  16. taken a strong position that the broader kinds of protection are
  17. harmful to the industry. The following statement indicates our
  18. position with respect to the activities of this organization.

  20.     The management of ParcPlace Systems, Inc. supports the League for
  21.     Programming Freedom in its efforts to eliminate software patenting and
  22.     broad, non-traditional expansion of copyright laws to software.  These laws
  23.     and interpretations seriously compromise the benefits to customer and
  24.     industry that have resulted from the open exchange of ideas, and from the
  25.     freedom to compete by adding value to de facto standards.

  27.     Given the current existence of these laws and interpretations, ParcPlace
  28.     Systems may nevertheless feel compelled to pursue patenting or broad
  29.     copyrighting for some elements of its technology, as a matter of prudent
  30.     business practice, but will continue to call for change in the laws.

  32.     Nothing in this endorsement should be taken as implying or requiring that
  33.     any particular employee of, or other person affiliated with ParcPlace
  34.     Systems, Inc., individually support the League for Programming Freedom or
  35.     its activities.
