  9. SAN ANGELO -- The former commander of Goodfellow Air Force Base was
  10. convicted in a court martial Monday of sending obscene material via
  11. his home computer.
  12.  
  13. A jury of four men and one woman, all Air Force colonels,
  14. deliberated
  15. about two hours before returning guilty verdicts on all counts
  16. again
  17. Col. James Maxwell.
  18.  
  19. He was convicted of transmitting obscene material via home
  20. computer,
  21. of transmitting child pornography through his computer and using
  22. indecent language with a junior Air Force officer.
  23.  
  24. Maxwell, a 26-year Air Force veteran, now faces a possible 16-year
  25. prison sentence and loss of his military retirement benefits.

  27. Charges were filed against Maxwell after the FBI found his name
  28. among
  29. users of an on-line computer network who accessed
  30. computer-generated
  31. pornographic images of children.
  32.  
  33. Maxwell also was said to have used the computer network to inquire
  34. about the location of homosexual meeting places.

  36. Maxwell's attorney had sought to have the charges dropped on
  37. grounds
  38. his transmissions on the computer from the privacy of his home were
  39. protected under the constitution.

  41. But the trial judge, Col. Donald Weir of Randolph Air Force Base,
  42. allowed the charges to stand last week, ruling that freedom of
  43. speech
  44. can be limited when it involves conduct unbecoming an officer.

  46. "That the writings were private between consenting adults, that
  47. they
  48. may have been welcome doesn't place them under the judicial
  49. umbrella
  50. of a constitutional protected condition," Weir had ruled.

  52. Weir dismissed a count alleging Maxwell had disgraced the Air Force
  53. by
  54. allegedly using electronic mail to ask about homosexual bars and
  55. child
  56. pornography.

  58. Maxwell, 48, was removed from command at the Goodfellow Air Force
  59. Base
  60. training center last summer after the charges were filed.

  64. COMMENT: Looks to me like this thing is full of red flags. Isn't it
  65. coincidental that the story breaks just as there's a flap over gays
  66. in
  67. the military?!

  69. And where it says "the FBI found his name among users of an on-line
  70. computer network who accessed computer-generated pornographic
  71. images
  72. of children", one might ask what network? what was the FBI doing
  73. there? how did the images get there? how did the FBI think to track
  74. them? who else is getting snared? civilians? were the images really
  75. "computer-generated" or just scanned?
