  4. A federal court says schools are not responsible for sexual
  5. abuse of pupils

  8.     In 1989 two teenage girls reported they had been sexually
  9. molested over a period of five months in a suburban Philadelphia
  10. vocational high school. Five male students were convicted of
  11. indecent assault, and two others pleaded no contest and
  12. cooperated with the police. The girls' families sued the school
  13. district, arguing that since the state requires school
  14. attendance, schools -- like mental institutions and prisons --
  15. have a duty to protect their charges.

  17.     The girls lost in a lower-court decision, and a federal
  18. appeals court last week ruled against them. In a 7-to-5
  19. decision, the court held that while school officials may have
  20. disregarded complaints of the assaults, students are not
  21. confined in the manner of mental patients or prisoners; in
  22. short, the victims could have sought help outside the school,
  23. but failed to do so. The girls' lawyer said he would take the
  24. case to the U.S. Supreme Court.
