  1. No-Nonsense license statement and limited warranty.

  3. This software is protected by international copyright treaty. Therefor, you
  4. must treat this software just like a book, except that you may copy it onto
  5. a computer to be used and you may make archive copies of the software for
  6. the sole purpose of backing up our software and protecting your investment
  7. from loss.
  8.  
  9. By saying "just like a book, Borland means, for example, that this software
  10. may be used by any number of people, and may be freely moved from one
  11. computer or location to another, so long as there is no possibility of it
  12. being used by more than one person at a time. Just as a book canÆt be read
  13. by two different people in two different places at the same time, neither
  14. can the software be available for use by two different people in two
  15. different places at the same time without BorlandÆs permission (unless, of
  16. course, BorlandÆs copyright has been violated).

  18. Adding Users.

  20. You may add users by paying for a separate software package for each user
  21. you wish to add.
  22.  
  23. Transferring the software.
  24. --------------------------
  25. You may transfer all your rights to use the software to another person,
  26. provided that you transfer to that person all of the software, diskettes,
  27. and documentation provided in this package and transfer or destroy all
  28. copies in any form. Remember, once you transfer the software you no longer
  29. have any right to use it, and the person to whom it is transferred may only
  30. use in accordance with the copyright law, international treaty, and this
  31. statement.

  33. The software is subject to U.S Commerce Department export restrictions, and
  34. is intended for use in the country into which Borland sold it (or in the
  35. EEC, in the case of software Borland first sold into the EEC). Except as
  36. provided in this statement, you may not transfer, rent, lease, lend, copy,
  37. modify, translate, sub-license, time-share, or electronically transmit of
  38. receive the software, media or documentation.

  40. Distribution of applications.

  42. Programs and applications that have been constructed with the software may
  43. not be distributed. The software is provided only with the aim of allowing
  44. the owner to learn the use of this software. For distribution rights of
  45. owner generated application, the owner will have to purchase a copy of
  46. additional software or package designed for this purpose.

  48. Limited warranty.

  50. Borland have licensed the software to Future Publishing for distribution,
  51. under strict terms, with the publication PC-PLUS. As such, all physical
  52. media are provided by Future Publishing and therefor Borland are not
  53. responsible for the provision of replacement media, in the case of
  54. defective materials.

  56. BORLAND SPECIFICALLY DISCLAIMS ALL OTHER WARRENTIES, REPRESENTATIONS, OR
  57. CONDITIONS EXPRESS OR IMPLIED, INCLUDED BUT NOT LIMITED TO, ANY IMPLIED
  58. WARRANTY OR CONDITION OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR
  59. PURPOSE. ALL OTHER IMPLIED TERMS ARE EXCLUDED.

  61. Specifically, Borland makes no representation or warranty that the software
  62. or documentation are "error free", or meet any userÆs particular,
  63. requirements, or needs.

  65. Borland is not responsible for, and does not make any representation,
  66. warranty, or condition concerning product, media, software or documentation
  67. not manufactured or supplied by Borland, such as third partiesÆ programs
  68. which are designed using Borland software or which include Borland programs
  69. or files.

  71. General provisions.

  73. This statement may only be modified in writing signed by you and an
  74. authorised officer of Borland. If any provision of this statement is found
  75. void or unforceable, the remainder will remain valid and enforceable
  76. according to itÆs terms. If any remedy provided is determined to have
  77. failed itÆs essential purpose, all limitations of liability and exclusions
  78. of damages set forth in the limited warranty shall remain in effect.

  80. This statement shall be construed, interpreted and governed by the laws of
  81. the State of California, USA This statement gives you specific legal
  82. rights; you may have others which vary from state to state and country to
  83. country. (UK STATUTORY RIGHTS ARE NOT AFFECTED OR PREJUDICED AS TO THE
  84. SOFTWARE AQUIRED OTHER THAN IN THE COURSE OF A BUSINESS.) Borland reserves
  85. all rights not specifically granted in this statement.
