I'll just cut to the point. Fair use. There is such a thing and
it very well might cover the use of copyrighted characters/sounds/etc in
wads. Your statement that "It does not matter what you are using it for"
is in error...in fact what you are using it for is the most important matter
when deciding a copyright court case. The most important factor as
determined by the supreme court is "the effect of the use upon the
potential market for or value of the copyrighted work." What this means
in simpler terms is if your product uses copyrighted material and cuts
into the wallet of the copyright owner you're in trouble. If anything , IMHO
, wads could only _increase_ the respective owners profit (after playing
aliens.wad and not having seen the movie how many people went out and
rented it?).
There are 3 other factors invloved in determining fair use but
I'll leave that up to the interested to investigate for themselves. Take a
look at the Copyright Act as revised 1976. It's available online though
the web but I can't recall the URL (find WebWorm or similiar searching
device and search on "Copyright").
PS I am not a lawyer but I did a research paper over the summer on
Copyright infringement as applied to computer software. You want sources?
