  3. LICENSING AGREEMENT

  6. This file, LICENSE.TXT, describes the only terms by which JeSof Software
  7. permits other parties to distribute this program throughout the world.
  8.  
  9. General terms:
  10.  
  11. 1. Distribution by Internet or modem:
  12.  
  13. JeSof software allows and encourages all bulletin board systems and online
  14. services to distribute this program by modem as long as no files are altered
  15. or removed.  If a distribution fee is charged for this software, you must
  16. additionally ensure that:
  17.  
  18. A. JeSof Software is credited as the publisher of the file.
  19. B. The file is identified as shareware.
  20. C. The shareware concept is explained adequately elsewhere online.
  21. D. You charge less than $9 for downloading this shareware program.

  24. 2. Distribution of single programs by floppy disk:
  25.  
  26. Shareware vendors may distribute this program alone on a floppy disk if the
  27. following conditions are met:
  28.  
  29. A. You explain the shareware concept and describe this program as shareware.
  30.    (Shareware is "try-before-you-buy" software, and the price paid by users
  31.    for shareware is a distribution charge only).
  32. B. You credit JeSof Software as the publisher of this software in all
  33.    catalog descriptions and any other written descriptions.
  34. C. You sell the software for less that $9, and only sell the most current
  35.    version of it.
  36. D. No files are modified or deleted.

  39. 3. CD-Roms and multi-disk packs:
  40.  
  41. If you wish to commercially distribute this program on a CD-ROM or a pack of
  42. several disks (through mail-order, wholesale, retail, or any other channels),
  43. you need to follow these terms and conditions:

  45. A. You explain the shareware concept and describe this program as shareware.
  46. B. You credit JeSof Software as the publisher of this software in all
  47.    catalogs and program descriptions.
  48. C. The CD-ROM may contain no more than 3 programs from JeSof Software (not
  49.    including installation routines and support utilities).
  50. D. The front-cover packaging must contain the word "Shareware" in large type.
  51. E. The name "JeSof Software", as well as the names of all JeSof Software
  52.    products included on the Cd-rom, must appear on the front-cover packaging
  53.    in large type.
  54. F. No files may be modified or deleted.
  55. G. You must send me a copy of the CD-ROM as soon as it has been manufactured.

  57. Reasons for these conditions:  I appreciate CD-ROM distribution when it
  58. is focused on bringing users a few top shareware products at a good price.
  59. But the numerous 10,000-program CD's that are hitting the stores aren't
  60. helping JeSof software authors and distributors achieve their goal of getting high-
  61. quality distribution and registrations.
  62.  
  63. So, please don't include this software on a gigantic CD-ROM stuffed with
  64. programs.  But do consider doing a small, high-quality CD-ROM that focuses
  65. on a few good products - that will bring in good sales for both you and us,
  66. and that will make us all happy.

  69. 4. Any distribution in a retail environment:
  70.  
  71. Any party wishing to sell JeSof Software products in a retail
  72. environment must meet all of the above conditions that apply, in addition
  73. to the following:
  74.  
  75. A. The following must be included in large type on the front cover of all
  76.    packaging:  The name "JeSof Software", the name of this program, and
  77.    the word "Shareware".
  78. B. You must send us a copy of your packaging for every JeSof Software
  79.    program you distribute as soon as the packaging has been manufactured.

  82. 5. Bundling with hardware:
  83.  
  84. You may bundle JeSof Software shareware products with new hardware (computers,
  85. sound cards, etc.) as long as you don't modify or delete any program files, and
  86. as long as you provide the shareware programs free of charge (i.e. at no
  87. additional cost) to the user when the hardware is purchased.

  89. If you'd like more information about OEM and hardware bundling opportunities,
  90. please contact me!  I greatly appreciate the opportunity to work with
  91. hardware manufacturers and resellers.

  94. 5. Other distribution opportunities:
  95.  
  96. Please contact me if you would like to distribute JeSof shareware products
  97. in a new and unique way.  I am open to new opportunities, and I
  98. appreciate new and unique forms of distribution as a way of reaching
  99. new customers.

  102. 6. Violation of the agreement:
  103.  
  104. If you distribute this software in violation of the terms of this agreement,
  105. you are liable to JeSof Software for damages of not less than $1 per copy
  106. distributed or the registration fee, whichever is greater.

  109. 7. Other terms and conditions:
  110.  
  111. A. Ownership: Except as expressly licensed by JeSof Software, I have and
  112.    reserve the exclusive copyright and all other rights, title and
  113.    interest to distribute this program.
  114. B. Current version: All previous versions of this program have been withdrawn
  115.    from shareware.  This version replaces any previous versions.
  116. c. Your right to distribute under this license is personal, and does not
  117.    include any right to sublicense the Program.
  118. E. THE PROGRAM IS PROVIDED "AS-IS".  NO WARRANTIES OF ANY KIND,
  119.    EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON.
  120.    I WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE
  121.    OR INCIDENTAL DAMAGES ARISING FROM IT, INCLUDING SUCH FROM
  122.    NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR CONTRACT,
  123.    EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.

  126. 8. Thanks:  I thank you for distributing JeSof shareware products
  127.    in accordance with the terms of this agreement.
