I remember going to see one of Ron's groups a few years ago in Boulder. They played in this tiny basement of some coffee house. To say the least it was LOUD! What Spy vs Spy did to Ornette tunes this group did to Prince tunes. If anyone on this list is from Denver, go hear him play. Apparently Sony Japan finally responded to his repeated requests to purchase back the rights to the material. This occasionaly happens when a huge, multinational record company (i.e. Sony) realizes that a particular recording will probably never sell a bazillion copies and that they are probably lucky to get anything for it at all. Zorn should consider himself lucky - the other, infinately more popular option is for the record company to deny all requests to use the material and simply let it go unheard for years, decades, millenia, etc. This is essentially why most prolific avant-garde artists have a bunch of albums that are considered classic yet are not available on CD (take Ornette Coleman, whose Caravan of Dreams album _In All Languages_ was out of print for many years up until, well, two weeks ago). Can't the breach of contract be used in such cases? Zorn would have no problem with us to testify that Sony did nothing to promote his music. I was also under the impression that Zorn has had no luck in securing the rights. However, in the last digest, I noticed this post about "FILMWORKS VII" upcoming on Tzadik. So, perhaps it's all been sorted out??? Breach of contract can only be an issue if there was a contract that specified what type of promotion would be used. But more importantly, _Cynical Hysterie Hour_ did sell out - there was no factory stock on it at all when I obtained a copy from someone in Japan with connections at Sony. It was sold as the soundtrack to a cartoon, not as a John Zorn recording, so I doubt that Zorn had any promotional commitments from Sony on it. And what was pressed probably sold to children who watched the show. The point is well taken, but I'm not sure that this is an accurate description of what happened in this particular case. Caravan of Dreams was a tiny, Texas-based indie label which stopped making records entirely shortly after _In All Languages_ was released. Ornette himself presumably wasn't in a position to get this material released until his recent deal with Verve, and I doubt anyone else has tried. But we can blame Columbia for the long absence of _Skies of America_. These are the newest releases for Avant under their 4 month old Koch distribution agreement. Every month Koch picks up distribution in the USA for 4 titles, basically whatever is fairly new and then fills in the remainder with old catalog titles. So next month, for example, we get three new ones and _Voyager_ to make four. After next month, the total number of titles you can get from Koch will be up to 24. Any reviews on the Cake Like CD? Jeff summed it up really well, but here's a couple of lines from the excellent book _Tim Sweeny's Guide To Releasing Independent Records_ to remember the next time we get frustrated as to why a big label isn't doing a damn thing to promote the music we love : "...Which brings up a very, very important point : record labels, especially big ones, are very often not concerned about the fate of individual bands. Their main concern is that they sell enough records each year to make a tidy profit. They don't particularly care if you are one of the bands that are making those records. To put it another way : It is not safe to assume that your record label will do what's in your best interest." Seeing how quickly it went out of print, I would assume that Cynical Hysterie Hour was a fairly low priority for Sony. George Michael fought sony in court using the same "no promotion" argument and lost. Does anyone have any further info on these? 2)Gysin is credited in the notes for creating the cut up style in literature, but it has always been my understanding that Gertrude Stein was the first to develop it a couple of generations before Gysin (not to mention dadaists like Tzara). The concert is listed as a coming out party for the Avant CD release. Douglas will be in town tonight with Tiny Bell Trio. If I get a chance I'll ask him about the release date. Shoei's prices for SOME items are expensive, but not everything across the board. for instance, the 00100 (or whatever the name of Pee Wee's new group is) CD is listed at $15 or thereabouts in the last catalog i received; a far cry from the $30.99 Rasputin's (local record store) was asking for. additionally, JO releases are quite cheap when buying direct from the source. the Coa CD was $10 i believe. where i would put in a word of caution is that JO does not sell any Avant titles, nor any other similar releases. everything they sell is either punk, noise, metal or some unclassifiable underground Japanese band. all great stuff, to be sure, but... if you're looking for titles on the Avant, DIW, PSF, etc. Japanese labels, i would recommend Forced Exposure instead. http://www.forcedexposure.com/ hasta.
