GOOD NEWS! HB 112, Prevention of Retaliatory Lawsuits, was passed
UNANIMOUSLY by the House Judiciary Committee today. This bill helps
protect activists from frivolous lawsuits designed to silence them. HB
112
now goes to the entire House. Please call YOUR Representative and tell
him/her you expect a YES vote on HB 112. And thanks to those of you who
called committee members. Your hard work is paying off.
BACK DOOR GUN CONTROL
Thanks to dedicated gun rights activists like you, the anti-gun forces
know
they face a difficult battle to disarm Utahns. You may have noted that
we
have fewer overt anti-gun bills this year, as compared with previous
years.
The anti-gun forces know that a bill titled "Revoking Gun Rights on a
Whim"
would never pass the legislature.
That's why anti-gunners are now trying to sneak gun control legislation
past us. They're doing this by using the appropriations process to
bypass
public discussion.
The appropriations committees have the task of allocating money to all of
our many state agencies and programs. The standing committees debate and
vote on bills that, if passed, become law. But appropriations committees
can also be used to bypass the legislative process and fund "rules" and
"programs" that have the same effect as laws.
For the past several years, the anti-gun forces have tried to enact
back-door gun control by way of the mental health system. They know that
committing someone for alleged mental illness is the quickest and easiest
way to revoke most of that person's rights - including his right to own a
firearm.
Once a person is committed, he loses his right to own a gun forever -
even
if he was wrongfully committed or if he has completely recovered. There
is
currently no way to get these records expunged or to get rights
restored. (Even violent criminals can have their records expunged and
can
petition for restoration of rights.)
There are many reasons that psychiatric commitment is such a great gun
control tactic. A person accused of being mentally ill has very little
in
the way of due process.
He doesn't get a jury trial. The usual standards of evidence are thrown
out the window, so that hearsay and conjecture are admissible evidence,
and
he's forced to testify against himself. The standards for commitment are
low. No one has to be proven mentally ill "beyond a reasonable
doubt". Instead all that's necessary is somebody's belief that he is an
"immediate danger to himself, others or property". (And the Division of
Mental Health is trying to loosen even that standard!)
In addition, once the person is committed, he's forced to pay for his own
incarceration and drugging. (Even murderers don't have to pay for their
imprisonment!) If he doesn't have money, the federal government chips
in. So, the more people committed, the more money the Division of Mental
Health gets.
That's right. The Division of Mental Health gets more money for each
person whose rights they revoke. And the Division is notoriously
anti-gun.
The major limitation on how many people can be committed is money and
space. Most committed people are treated in psychiatric hospitals.
There
are only so many beds and so much money. So it's not possible to commit
tens or hundreds of thousands of people each year. It's not possible to
lock up every "right-wing extremist" or "paranoid gun nut", drug them
into
submission and revoke their right to self defense forever.
The "solution" to this "problem" is a program called PACT or Program for
Assertive Community Treatment. PACT allows people to be committed while
living in their own homes and working at their own jobs. A state mental
health worker or law enforcement officer comes to the person's home and
makes sure he is taking his medications and complying with all the other
terms of commitment. This can involve not only forced drugging, but
warrantless searches.
Once the person is committed, he loses his right to own a gun, is no
longer
eligible to serve in the military, and is disqualified from many other
jobs
that require background checks.
And while currently one needs to be an "immediate danger" to get
committed,
both Gov. Leavitt and the Division of Mental Health have said that they
would like to expand commitment to anything the division considers
"mental
illness". This includes such "mental illnesses" as poor housekeeping,
poor
hygiene, failure to pay child support on time, inability to hold a job,
homelessness, and loitering.
PACT is not only a threat to gun rights, it is a threat to ALL civil
rights. If a person truly is a danger to himself or others, he should
not
be living at home. If he's not a danger to himself or others, he should
be
left alone unless he agrees to psychiatric treatment.
To clarify: UTGOA has no objection to PACT if it is VOLUNTARY.
Providing
care to non-violent mentally ill people in their homes is certainly
preferable to locking them in hospitals - if they agree to the treatment.
However, no one should be forced to take mind-altering drugs against his
will. And no one should have his rights revoked permanently without
being
convicted of a crime by a jury of his peers.
Currently the Division of Mental Health is asking for over $800,000 for 4
PACT teams. The plan is ultimately to implement PACT statewide

Please remember to be POLITE! Most of these legislators are not aware of
the problems with PACT. They've been told it's a "compassionate" program
to "help the mentally ill". Your job is not to call them names, but to
explain the problems with PACT, and the very real threat to our civil
liberties.

Honorable Members of the Health and Human Services Appropriations
Committee,
I am writing to ask you to remove funding for PACT (Program for Assertive
Community Treatment) from the Division of Mental Health Budget, and to
refuse to approve the budget unless PACT is removed.
PACT is a very serious threat to civil liberties. People who have not
committed a crime, and are living in their own homes should not be forced
to take mind-altering drugs against their will. And people who are a
threat to themselves or others should not be living in the community.
I am also concerned that PACT might be used to revoke the rights of
peaceful citizens who have "politically incorrect" ideas, belong to
minority religions, own guns, etc. Of particular concern is that once
someone is committed, he loses his right to own a gun forever - even if
the
commitment was unjustified or if he has fully recovered. Likewise,
someone
who is committed may lose custody of his own children, and may be
prohibited from holding certain jobs or serving in the military.
I do not want my tax dollars used to revoke the rights of my fellow
citizens or to force people to take mind-altering drugs.
Please OPPOSE PACT, and make sure it is removed from the Division of
Mental
Health Budget.

I have mixed feelings on this article. On the one hand, a single written
test may curb problems and concerns over the very few bad instructors who
are not teaching what they should. OTOH, it could very well serve as the
first step towards the State limiting the availability of permits.
Perhaps requiring a standard, State written tests to be administered by
current instructors would be ok. Thoughts?
The section about raising prices on permits is of concern as well.
People should not be taxed at all in order to exercise God given,
Constitutionally enumerated and protected rights. My attitude is that,
as a gun owner, permits and background checks don't do me a bit of good.
They are to calm the fears of the gun phobes and thus benefit only them.
Thus, they--and not I--should be paying for them.
The final sentence gives some comfort this time around, but we should
maybe be watching closely just to make sure nothing slips through.

Audit Says Gun-Safety Program a Failure
Lawmakers urged to replace loose concealed-gun training with a
mandatory state test

Legislative auditors recommend the state consider junking the
gun-safety program used to qualify citizens for concealed-weapons
permits.
An audit released Friday in the Capitol says Utah's Concealed
Carry
Weapon (CCW) Program is dramatically underfunded and lacks the
resources to oversee safety training courses.
"At present there is no evidence that CCW permit holders are
actually
taught or understand the state's laws on allowable uses of deadly
force or
safe weapons-handling techniques," said the audit by Legislative
Auditor
General Wayne Welsh.
Courses intended to ensure people are competent to handle guns
and
knowledgeable about laws regulating firearms use range over a "wide
spectrum," said the report, "from a bare minimum offering intended
only
to meet the letter of the law to hands-on training designed to
improve
weapon handling and proficiency."
The audit recommended lawmakers consider getting rid of the
current
system that requires training by one of hundreds of private
instructors and
replacing it with a simple written state test.
"A state-regulated testing program may offer greater control
and
evidence that applicants at least have an understanding of Utah's
laws,
use of lethal force and weapons handling and safety than the loose
system
for firearms-familiarity instruction now in place," said the
report.
Auditors also found that taxpayers subsidize the current
concealed-carry weapon program to the tune of $144,000 annually.
Fees charged for weapons permits run $59, including $24 needed
for
FBI background checks and the rest to the state. Last year, the
state
received $307,400 in fees revenue. But the cost of the program was
$451,800.
Moreover, the fees collected on concealed-weapons permits are
not
earmarked for the licensing program. Lawmakers budget just $88,000
for the activity, requiring the Bureau of Criminal Identification
to shift
about $363,834 from other services, including Brady Act
gun-purchase
background checks.
Auditors recommended raising the fees to better reflect the
cost of the
program. They also urged lawmakers to boost the annual
appropriation
-- which has remained flat for several years even though
liberalization of
the concealed-carry laws in 1994 has pushed the number of permit
holders from about 1,000 to more than 39,000.
The audit findings parallel revelations in a 1999 Salt Lake
Tribune
investigation.
A review of gun safety-training by the newspaper concluded that
there
were "serious flaws" in the system and that the quality of courses
offered
by state-certified instructors was "wildly uneven, ranging from
seven-hour
sessions that include firing-range time to sham classes that appear
mainly
designed to provide supplemental income to lax instructors."
"Utah may be playing Russian roulette with how it ensures that
people
licensed to carry concealed weapons are competent to handle guns
and
knowledgeable about gun laws."
Of seven classes sampled by Tribune reporters, five were deemed
good to excellent and two were poor.
In the worst case, instructor Celeste Morgan charged $75 for a
one-hour session in which no gun was ever introduced to satisfy
requirements of safe loading and handling. She signed off on the
certification even though the form was otherwise blank, and could
have
been used by someone other than the student.
House Majority Leader Kevin Garn, R-Layton, attempted to pass
legislation last year requiring that a concealed-weapon applicant
demonstrate shooting proficiency. He dropped it in the face of
overwhelming opposition.
"The problem is there are a lot of instructors out there that
make
money. They have the ability to send panic through the gun
community,
and they don't want the laws to change," said Garn.
"We've got people coming out of those classes who have no idea
how
to use a gun," he said, adding the auditors' idea of a state test
might be a
good solution.
But, Garn added, "it's too late in the [legislative] session to
do anything
now." The current Legislature ends Feb. 28.

While Sen. Stepheson has traditionally been on the right side of the gun

regaining our rights.

I am an instructor in Southern Utah (that doesnÆt mean Provo for you in
Northern Utah):>)
I don't know about all the other instructors here, but I know myself, and
one other, who spend our fair share amount of time putting forth the
doctrine the state "says" they would like to have put forth. Not that I
agree with it that much, as I am of the type that knows carrying a weapon is
a God giving right not a state right, even thought we are currently stuck in
the state mentality, which comes with the support of a good many so called
"freedom loving people". I also know, because of years of teaching pistol
craft, that you can't teach someone to shoot for fifty bucks in a two hour
range session.
I don't see how a state test, on the form of a questionnaire or multiple
guess type test, would be better than the current system. Take for example
the drivers test, which anyone with half a brain, or someone just dropped
out of a space ship from Mars could pass with a 10 minute look in the little
book they have there. How could such a test show a persons ability to load
or shoot a gun? Da? Do I miss something here? No, I don't think I do, I see
the real intent, and that is getting a foot in the door for another state
bureaucracy, which would be on the order of the drivers license bureau, (I
am trying to keep this civil and not say what I am thinking about that
department).
No we don't want to see this testing of applicants for CC handed over to the
state. If the state is paying so much now for what is being achieved, in
their minds, think how much it would cost if you had to pay the state for
the same thing. It would cost the applicant thousands of dollars for the
permit, all this because each little bureaucracy that starts up has to suck,
feed and grow, and the sad part, it wouldn't solve a single problem, except
in the eyes of the left, it would halt the number of applicants, and permit
holders. I guess that would be a plus for some.
All anyone has to do is look at the source of this message, a government
worker, and the leftist press to tell what the real intent is. Why not ask
the people who have taken these little classes, or who would like to take
one, but don't quite have the fifty bucks or so that it now costs to take
it. Ask them if they are getting their monies worth, paying for something
that shouldn't even cost them a dime?

Bill updates and a VICTORY
REMINDER! Please plan to attend the House Law Enforcement and Criminal
Justice Committee hearing Tuesday, 8 AM, Room 225 at the State
Capitol. The following bills will be discussed:
HB 274 - OLYMPIC VENUE SITES This bill would ban lawful concealed carry
at
the State Capitol and Salt Lake City-County Bldg. for roughly 3 months
around the Olympics. It would do nothing to prevent criminals from
carrying firearms in those locations.

It is rumored that Rep. Ure is planning to "modify" this bill, or even
kill
it. But no one ever knows what's really going to happen until it

HB 266 - RESTORATION OF RIGHT TO BEAR ARMS will also be discussed at this
committee. UTGOA has not yet seen the new version of the bill.
According
to bill sponsor, Rep. Throckmorton, the intent is to provide a way for
persons prohibited from owning firearms to have their rights restored.
MEETINGS WITH LEGISLATORS
UTAH COUNTY
The Utah County Delegation is having a report meeting for all citizens
Thursday night, February 8 from 7-9 p.m. at Lakeridge Junior High-900
South
400 West, Orem.
Rep. Mike Thompson has requested that gun rights supporters attend this
meeting. As you know, Rep. Thompson is sponsoring two pro-gun bills this
session: firearms safety education in schools and "Vermont" carry which
recognizes the right to carry a concealed firearm without a permit.
It is now up to US to show our appreciation for Rep. Thompson's
willingness
to sponsor pro-gun bills, and to convince our elected officials to vote
for
them. If you live in Utah County - or even if you don't! - PLEASE plan
to
attend.
SENATOR HOWARD STEPHENSON - Sandy
Sen. Howard Stephenson is having a town meeting Wednesday, Feb. 7 at 7:00
pm in the Sandy City Hall.
Sen. Stephenson is generally friendly towards gun rights. However, he
had
only a 44% correct voting record last year. He would undoubtedly benefit
by hearing from constituents who would like him to support all of our
pro-gun bills this year. He could also use some encouragement to sign on
as co-sponsor for some/all of them.
BILL UPDATES
HB 112 (Prevention of Retaliatory Lawsuits), HB 133 and HJR 10 (Bill of
Rights Day) are on the House third (final) reading calendar. Please make
sure your Representative knows you expect a YES vote on these bills.
Votes
may be as soon as tomorrow.
VICTORY! HB 222 (Tax Credit for Safes) was defeated in the House today
by
a vote of 30-42. Thank you for your assistance in defeating this bill.
SB 87 (Antique Firearms Amendments) passed the Senate Transportation
Committee today. This bill exempts antique firearms from current gun
control laws. UTGOA is neutral on this bill. Please let your Senator
know
how you would like him to vote.
Utah Gun Owners Alliance expects to have bill language on HB 345 (Vermont
carry) and HB 376 (Concealed Carry Reciprocity) in the next few days. So
far, we are very optimistic about these bills, and appreciate Reps.
Thompson and Donnelson for their willingness to sponsor pro-gun bills.

Note: I found out last night that Speaker Stephens is attempting to cut
a deal with Representatives Thompson and Donnelson (who are sponsoring
three pro-gun bills--Vermont Carry HB 345, Gun Safety Law Amendments, or
gun safety education in schools HB 264, and Reciprocity or recognition
of CCW permits from all states). The deal is that if Thompson stops
pushing through the Vermont Carry bill, the other two will get support.
The real reason for this is that legislators do not want to have to vote
on Vermont Carry, because it will show their true colors and allow us to
use it against them in coming elections. Please make your feelings known.

It appears that the main item of focus for Swallow's meeting will be his

It appears that Sen. Stephenson's and Rep. Swallow's town meetings at the
Sandy City Hall this evening have been combined into a single meeting.
House Speaker Stephens and Senate President Mansell are scheduled to be
in attendance as well.
I have no info on the confict on the start time so my suggestion is show
up in time to get good seats should the meeting start at 7:00pm but don't
be too surprised if it doesn't start until 7:30.
Please dress appropriately. IOW, please avoid T shirts (no matter how
catchy the slogan) and if you really must wear cammo, please make it
"urban cammo" also known as a suit and tie. :) Clean jeans and a
collared shirt (pollo or full button down) are very appropriate for the
men. Let's do our best to make sure our elected officials and the media
don't have any "gun nuts" to photograph tonight but rather have
respectable, tax paying, voting citizens who happen to value their right
to self defense.

STOP THE SNEAKY GUN FEE INCREASE
In a sneaky move, Rep. Gary Cox is attempting to raise the fees for
renewing
permits to legally carry a concealed weapon for self-defense. The actual
increase (this time) is relatively small ($10 to $35 for concealed carry
permits, and $10 to $25 for Concealed carry instructors). However, there
is
a definite trend by people opposed to legal gun ownership and use to try
to
make guns too expensive to own through fees, taxes, litigation and other
schemes.
This fee increase is being attempted IN VIOLATION OF THE PROCEDURES for
such an increase.
? The Department of Public Safety did not request a fee increase.
? The Legislative Analyst responsible for such proposals did not request
a
fee increase.
? The fee increase has not gone through the public comment process
required
by the Utah Administrative Procedures Act.
? The data used to audit the concealed carry fees has not been made
available for review
The House Appropriations Committee where this sneak attack took place is
not expected to meet again.
The proposed increase is subject to review at an Executive
Appropriations
Committee meeting in the next few days.

Guns in Movies: Where Do We Stand?

Movies. America is known worldwide for making movies. By making
some things look "normal" and other things look evil, mysterious
or "un-cool," movies massively influence public opinion.
Fashions in speech, conduct, and dress are suggested by movies.
Many people believe that cigarette smoking surged overwhelmingly
in popularity in the last century because most leading men and
women, and even the supporting players, made smoking seem natural,
easy and normal -- even high class -- in movies.
Few would doubt the power of movies today to sway public views
about fashion, ethics and politics.
Movies for Self-Defense
What do most American movies teach about the right to self-defense?
About the right to keep and bear arms?
In times past, there were countless "western" movies. Although some
of these improperly glorified or tried to justify white men killing
Indians, many others were morality stories of good versus evil.
Frequently in western movies the audience would see self-defense in
action. A lone woman picking up a firearm to defend herself and her
family. An armed boy helping his dad ward off attackers. Stranded
settlers organizing to stand watch -- and fight off -- robbers and
marauders.
Western movies of this sort, however, are dead and gone. Last year's
film about the Revolutionary War, "The Patriot", was criticized for
showing young boys using firearms even for an unquestionably good cause.
Movies Against Guns
Hollywood in the last 30 years has turned 180 degrees against the right
to keep and bear arms. Anti-gun films, however, mostly don't preach "gun
control" openly. As always, movies teach by showing what is "normal",
mysterious and "cool" -- and by showing what is ridiculous, dangerous
and uncool.
In Woody Allen's recent comedy, "Don't Drink the Water", the only gun
in the movie is portrayed as unnecessary, awkward, and inherently
dangerous. Viewers get the message that nutty New Yorkers will play
cowboy and accidentally shoot innocent people in all directions. By
watching the players, the audience learned that guns are terribly
risky and people are too crazy to use them properly.
Last year's "Charlie's Angels" movie played against defensive gun use,
too. The three heroines didn't use firearms at all, and the female
stars pointedly mentioned that fact in publicity interviews.
In many other movies, the only people with firearms are either the
criminals and crazies, or the police and military. "Die Hard". "Con
Air". "Air Force One". Only rarely does a modern film show an average
person, living in the city or suburbs, driving away thugs without
shooting -- which is the most common type of defensive gun use.
Practically never do films show wholesome family recreational shooting.
It's time for a change, so JPFO is taking a hard look at the movie
industry. Maybe we need to expose the heavy anti-gun bias that is woven
into most modern films. Maybe we need to make a pro-self defense movie
of our own.
We Need Movie Critics -- Like You!
If you watch movies at all, then you can help with our project. It's
easy: just tell us about movies since 1970 that you thought were
especially anti-gun or anti-self defense, and in a sentence or two
explain why.
We need this information to help build a strategy to take on Hollywood.
We need the information from actual movie viewers, not from professional

While a generic "Dear Legislator" is probably not quite as effective as
an individually addressed email, it is certainly far more effective than
no email at all which might be the alternative for some. This email
contains most or all of the email addresses to contact to oppose PACT.
They are in a format that is very easy to cut and paste into the address
field. I do reccommend that if you send a "bulk" email like this that
you head the advice to put the addresses into the blind carbon copy (bcc)
field so that the recipients do not see who else has received the email.
For those using Juno, you get bcc by placing addresses inside
parenthesis, eg. "(email address, email address, email address)", in the
Cc field. You then only need a single address in the To field. Also for
those using Juno, there is a limit on the number of addresses you can put
in the cc field so the list below has to be done about 1/2 at a time.
Still, it's only two messages to send rather than 40.

It appears as if the proponents of PACT (Program for Assertive Community
Treatment are so worried about losing the funding for their pet project
that
they have turned it into a religious issue.
Members of the National Alliance for the Mentally Ill (NAMI) along with
Representative Trish Beck have been going around the Legislature telling
anyone
who will listen that the only reason why PACT is being attacked is
because of
the "Scientologists" and that if it wasn't for the Scientologists
everything
would be just fine!
Talk about trying to discredit the messenger so you won't have to look at
the
message.
Legislators need to know that this is absolutely untrue and that
non-Scientologists oppose this civil rights abomination too. I don't
think that
the Scientologists are the only one who worry about freedom!
Please copy the email addresses in your bcc (blind carbon copy) section
and
send all the legislators a message saying that you oppose PACT and that
regardless of the claims of Trish Beck and NAMI you are not a
Scientologist.
Please make sure that you include your phone number.
PACT is coming up for vote Friday afternoon so this needs to go out fast.

Yesterday Utah Gun Owners Alliance reported that Rep. Gary Cox had pushed

huge fee increase for CCW permit renewals and instructor certification
renewals through the Criminal Justice Appropriations Committee. UTGOA
does not think a 250% increase in fees is justified.
UTGOA is willing to work with BCI, Rep. Cox, and the legislature, should
the audit show that more funding is necessary. But we feel strongly that
sneaking fee increases into an appropriations bill without input from
BCI,
concealed carry instructors, or gun rights advocates, and without public
comment, is highly inappropriate. This is especially true since no one
has
had the chance to study the auditor's report carefully.
Please contact members of the Joint Executive Offices, Criminal Justice
and
Legislative Appropriations committee. We recommend doing this by phone
over the weekend, while legislators are home. Let them know that 250%
fee
increases are unacceptable and that you would like them to reconsider,
and
to allow for input from gun rights organizations as well as the Bureau of
Criminal Identification.
Also tell them that you would like to attend this meeting and ask them to
schedule it in advance so you can arrange to be there. We are only
asking
that the committee be fair and give us the opportunity to present our
views, and that it be responsible and justify any proposed fee increases.

Honorable members of the Joint Criminal Justice Appropriations Committee,
I am writing to ask you to reconsider the Concealed Carry permit and
instructor
renewal fee increases in the Criminal Justice budget, and to oppose this
budget
until the fee increases are removed.
Fee increases of 250% are outrageous! It's hard to imagine how this
could
ever be justified. Such huge increases should never be enacted without
careful consideration, analysis and opportunities for public comment.
The Legislative Auditor's report on concealed carry has barely been out a
week. No one has had time to review it carefully or to check the
Auditor's
data and analysis. Neither the Bureau of Criminal Identification nor the
public has had the opportunity to be involved in this process. Why are
you
rushing to enact such an ill-considered plan?
Finally, I am extremely disappointed that my elected officials would try
to
sneak such huge fee increases past me by burying them in an
appropriations
bill.
I would appreciate it if the Committee would reconsider these fee
increases, and delay a decision until the issue can be studied fully. At
the very least, hold a public hearing so that BCI, gun rights advocates,
concealed carry instructors, and ordinary citizens can participate in
this
decision.

RUMORS
Utah Gun Owners Alliance has received many inquiries about a rumor
circulating that Speaker Marty Stephens and Rep. Mike Thompson were
"cutting a deal" to kill Vermont carry. This rumor is FALSE. Both
Stephens and Thompson say they have not talked about gun bills at all.
In
fact, Stephens has committed to making sure our pro-gun bills make it out
of rules and are assigned to an appropriate committee. And Thompson is
committed to passing HB 345 - Carrying a Firearm. Utah Gun Owners
Alliance
is working with Rep. Thompson to draft the bill, and we expect to have
bill
text early next week.
BILL OF RIGHTS DAY
Rep. Morgan Philpot's two Bill of Rights Day bills (HB 133 and HJR 10)
will
have their House floor vote on Tuesday, Feb. 13, at 2 PM. Rep. Philpot
says he has amended HB 133 to include Constitution Day as well, although
the exact text is not yet available.
Rep. Philpot has asked Utah Gun Owners Alliance to extend an invitation
to
all people who care about our Constitution and Bill of Rights to come to
the Capitol to observe the vote. No public comments are permitted, but
you
will be able to sit in the gallery above the House floor and watch the
proceedings.

PACT is still being discussed by the Joint Health and Human Services

The original alert had an incorrect phone number for Rep. Ray. Please
see below for the corrected number. Please be aware that at least a
couple members of the committee are really quite hostile to your ability
to carry a weapon for self defense--though they may not say so in that
many words, their tone and actions will leave little doubt in your mind.
However, there are several members who are friendly to and generally
supportive of your rights and ability. If you receive a negative
response from one or more legislators, do not be surprised nor
discouraged. Call the other members, ask them to attend this meeting,
oppose this fee increase or to at least support any efforts to schedule a
time for more comment on them.
Remind them that the Legislative Audit upon which Rep. Cox is basing
these huge increases has only been available for a week, that isn't time
for a full review, and no comment nor testimony has been heard from the
public nor pro-gun organizations on these increases. Also remind them
that while the legislative audit suggested that differences between
income and expendeture levels at BCI be made up via a combination of
general fund appropriation increases and modest fee increases, Rep. Cox's
measure increases ONLY fees forcing gun owners to shoulder the entire
shortfall themselves.
Please remember to be courteous while firmly letting these legislators
know that both the size of the proposed increase AND the process used to
date are not acceptable.

SNEAKY GUN CONTROL - Call these legislators!
Yesterday Utah Gun Owners Alliance reported that Rep. Gary Cox had pushed
a
huge fee increase for CCW permit renewals and instructor certification
renewals through the Criminal Justice Appropriations Committee. UTGOA
does not think a 250% increase in fees is justified.
UTGOA is willing to work with BCI, Rep. Cox, and the legislature, should
the audit show that more funding is necessary. But we feel strongly that
sneaking fee increases into an appropriations bill without input from
BCI,
concealed carry instructors, or gun rights advocates, and without public
comment, is highly inappropriate. This is especially true since no one
has
had the chance to study the auditor's report carefully.
Please contact members of the Joint Executive Offices, Criminal Justice
and
Legislative Appropriations committee. We recommend doing this by phone
over the weekend, while legislators are home. Let them know that 250%
fee
increases are unacceptable and that you would like them to reconsider,
and
to allow for input from gun rights organizations as well as the Bureau of
Criminal Identification.
Also tell them that you would like to attend this meeting and ask them to
schedule it in advance so you can arrange to be there. We are only
asking
that the committee be fair and give us the opportunity to present our
views, and that it be responsible and justify any proposed fee increases.

Honorable members of the Joint Criminal Justice Appropriations Committee,
I am writing to ask you to reconsider the Concealed Carry permit and
instructor renewal fee increases in the Criminal Justice budget, and to
oppose this
budget until the fee increases are removed.
Fee increases of 250% are outrageous! It's hard to imagine how this
could
ever be justified. Such huge increases should never be enacted without
careful consideration, analysis and opportunities for public comment.
The Legislative Auditor's report on concealed carry has barely been out a
week. No one has had time to review it carefully or to check the
Auditor's
data and analysis. Neither the Bureau of Criminal Identification nor the
public has had the opportunity to be involved in this process. Why are
you
rushing to enact such an ill-considered plan?
Finally, I am extremely disappointed that my elected officials would try
to
sneak such huge fee increases past me by burying them in an
appropriations
bill.
I would appreciate it if the Committee would reconsider these fee
increases, and delay a decision until the issue can be studied fully. At
the very least, hold a public hearing so that BCI, gun rights advocates,
concealed carry instructors, and ordinary citizens can participate in
this
decision.

CCW fee hearing today!
Last week, Rep. Gary Cox proposed that permit renewal fees and instructor
renewal fees be raised from $10 to $35, an increase of 250%. The
Criminal
Justice Appropriations committee approved these fees last week, although
many committee members say that the schedule was very busy and they had
no
idea what they were voting for.
In response to your calls and emails, several legislators have agreed to
support a motion that these fee increases by reconsidered. Rep. Mike
Thompson will be making the motion today.
What you must do - NOW!
Call the following legislators and ask them to support Rep. Thompson's
motion to reconsider the fee increases. The problems with the fee
increases are:
1. 250% increases are unreasonable and should never be done without
public
comment.
2. The Legislative Audit does not justify such huge increases.
3. The Legislative Audit said that funds for BCI should come from the
General Fund AND fee increases, not just fee increases.
4. No one has had time to study the Legislative Audit carefully and the
raw
data has not even been released so we can verify its accuracy.
5. While BCI did request fee increases, they were not involved in this
process, and learned of this proposal only after it was passed.
6. Gun rights organizations and concealed carry instructors were not
invited to participate in the review process.
7. Rep. Cox bypassed the usual legislative review process to sneak this
into an appropriations bill after it was defeated by standing committees
several years in a row.
8. Many legislators were apparently unaware that they were voting in fee
increases.

Good news. The Huge CCW fee increase that Rep. Gary Cox sneaked into the
appropriations bill after failing to pass that increase (and other
measures intended to increase the cost and difficulty of getting and
keeping a CCW permit) the last couple of years using stand alone bills
was removed from that appropriation bill. Watch for it to be introduced
later in the session using one of the remaining "boxcar" bills. Thank
you to all of you who took the time to make phone calls to committee
members. They may not seem receptive to your call, but when they get
enough calls, they do vote properly, even if they aren't really happy
about it.
Time to support a good bill.
Rep. Mike Thompson's HB 264 - Gun Safety Law Amendments which would
require that basic ("Eddie Eagle" type) gun safety instruction be given
to grade school children and historical / legal instructions on guns be
given to high school seniors as well as providing optional (with parental
consent) hands-on firearms training for seniors is scheduled to be heard
in the House Education Committee tomorrow, Tuesday February 13th, at 4:00
pm in room 129 at the capital.
This is a good and an important bill. Schools are already allowed to
provide basic safety training, but--surprise, surprise--very few do.
While railroad (TRAX) tracks, power lines, and crime (don't accept rides
from strangers) safety all merit some time and effort by our schools, it
seems that some modest and basic instructions on avoiding injuries should
a gun be found is just too much trouble for them.
This bill faces an uphill battle. Liberals--in both parties--are not
going to support it simply because it deals with guns without demonizing
them or putting anyone in jail. Conservatives are hesitant to support it
(they say) because it imposes another mandate on local school districts.
Legislators of all stripes need to hear from us. This is not about guns
or mandates. It is about the safety of children.
If possible, please attend the hearing tomorrow, Wednesday, at 4:00 pm,
room 129.
This evening, please take a few minutes and call members of the House
Education Committee. Let them know you want them to support HB 264 "for
the sake of the children." :) Remember to be polite, but firm and
clear. If you are a constituent of any committee members, please call
that member first, letting them know you are a constituent. Then (or if
none of them are your rep) please call other members. I've not bothered
to paste in home address so regardless of your area code or that of the
legislator, any of these could be long distance for you and require
1+area code+number. Try it without the one first, then add the 1 if you
need it.
Email is better than nothing, but not nearly as good as a personal call.
Do both if possible. Or, at least call a couple and email the rest. I
suggest the use of the blind carbon copy (bcc) field when emailing more
than one and using a generic greeting like "Honorable Representative".
Be sure to include your name and phone number and/or postal address in
your email. Cut and paste email addresses and email body (if you'd like
to use it) follow the committee members.

Dear Honorable Representative,
Please support HB 264 -- Gun Safety Law Amendments and pass it out of the
House Education Committee favorably.
This bill will require that public grade schools provide a very basic
course of safety instruction in the event a child or his/her playmate
should find a gun. The children will be taught to "Don't touch, leave
the area, and tell an adult." They will also be taught how to teach this
information to others. High Schools would be required to provide basic
instruction regarding historical and legal issues regarding firearm
ownership to seniors. Those seniors would also have the option, with
parental consent, to receive basic hands-on use of a firearm under the
strict supervision of a police officer or other qualified instructor.
Regardless of your position on private firearms ownership or legislative
mandates to schools, the fact remains that most homes in Utah have a gun
and almost no local districts have chosen to offer this essential
education even though they are currently free and encouraged to do so.
Some children will happen upon a gun at some point in their lives and
there is simply no reason for any child to be injured--or to accidently
injure someone else--because they are ignorant concerning basic gun
safety. Children are currently being MIS-educated concerning the dangers
of guns via video games, movies, television, and other media. It is our
duty to make sure children are properly educated in this area so they can
avoid injuries. This is no different than the safety training currently
and routinely given about railroad (or TRAX) tracks, water ditches, power
lines, etc. This program would utilize community volunteers and present
almost no cost to local school districts.
Please let me know whether you plan to support this common sense bill to
prevent childhood accidents with firearms.

Rep. Merlynn Newbold, HD 50, has scheduled a town meeting. If you live
in her district (or even if you don't but are concerned about /
interested in the issues that come before the committees on which she
sits--like the education committee that will vote on Tuition Tax Credits)

It is scheduled for Saturday, February 24th at 4:00 pm in the South
Jordan pubic library.
That is very late in the session, so if you want to give her input on
bills she is likely to see before then, contact her directly. However,
it is soon enough to give her some good guidance on what we expect and
hope for in the final hours of the session when a lot of bad stuff can
slip through. It would be great if she heard from several of us that
we'd like her to do two things:
1--Vote against any bill she hasn't personnaly read in its final form.
2--From the floor object when unanamous consent is requested to waive
reading of said bills before a vote is taken.

It looks like Rep. Thompson's HB 264 that would require grade schools to
teach basic gun safety met all the expected opposition and then some.
Several amendments were proposed and it looked like the opposition had
plenty of votes to kill the bill outright. Somewhat surprisingly, it was
Rep. Duane Bourdoux who saved us by moving to hold the bill. This gives
Rep. Thompson some time to make a few minor technical changes to blunt
the critisism of the educational establishment. The bill should be heard
again in the near future.
If you haven't yet contacted the house education committee members on
this bill now is the time to do so. If you have, now is the time to
contact them, ask them where they stand on the bill after hearing it, and
let them know you expect them to support it. Education committee member
contact info listed below. Support for and oppossition to this bill
really does cross party lines and the usual conservative/liberal labels
so don't hesitate to contact those you think would normally be opposed to
gun issues or neglect contacting those you would normally think are very
supportive of gun issues. Remember, this isn't about guns. It is about
childhood safety. We in the RKBA community are frequently criticized
(unjstly) as not caring about the safety of children when we oppose
mandatory trigger locks and such. NOW is the time to make it clear we
fully support the safety of children.
Rememeber, "You can't childproof every gun. But you can 'gun-proof'
every child with just a little education."

Honorable members of the House Education Committee:
I am writing to ask you to support HB 264, Gun Safety Law Amendments This
bill is not about "guns in schools", or pushing a pro-gun (or anti-gun)
agenda. It is not a partisan issue. It is not even about legislative
mandates to
schools. It's about protecting our children, something we all agree is
important.
The truth is that even though current law allows the teaching of gun
safety and even though
numerous individuals and organizations have offered to provide materials
and qualified
instructors, most Utah Public schools refuse to teach gun safety - even
though it's really
no different than holding fire drills, teaching safety around power lines
or railroad tracks,
or teaching water safety. The goal is to keep children safe should they
encounter a firearm.
I wish schools would teach this lifesaving information on a voluntary
basis, but they don't.
Many parents don't know basic firearms safety, and aren't able to their
children.
And too often, these parents trust mechanical solutions like trigger
locks (which have a
very high incidence of failure and cannot be counted on to be in place
when a criminal
discards a gun near a playground), instead of providing their children
with survival skills.
Please SUPPORT HB 264, Gun Safety Law Amendments. If it saves only one
child, won't
it be worth it?
I consider this a high priority bill, and will be interested to see how
you vote.

Good news! The two Bill of Rights Day Bills, HB 133 and HJR 10 passed
the
House unanimously today! HB 133 was amended to also create Constitution
Day on Sept. 17, an amendment we support. Utah Gun Owners Alliance would
like to thank Rep. Philpot and the members of the House for their support
of our Constitution and Bill of Rights.
These bills will now go to the Senate. Please let YOUR Senator know that
you would like him/her to support HB 133 and HJR 10.
GUN SAFETY EDUCATION - HB 264 - Thompson
HB 264, Gun Safety Law Amendments was debated by the House Education
Committee today. The bill met with a lot of resistance. It was amended
to
make the secondary school safety education optional. (The amendment is
not
yet available.) There was a lot of opposition to "mandating" safety
education.
However, there are already provisions for voluntary safety education in
place - and they're generally ignored. UTGOA doesn't understand the
objection to teaching something that will save children's lives -
especially when we mandate so many other programs that are far less
important. Isn't it worth spending an hour or two to keep our children
safe?
The committee voted to hold the bill to give Rep. Thompson a chance to
revise the bill to deal with some of the objections.
Please contact members of the House Education committee (see previous
alert
for their names) and encourage them to support HB 264. If they voice
objections to the bill, ask them to tell you specifically what they think
needs to be done so that they will support the bill. And please let
UTGOA
know what responses you get.

CHANGES
Utah Gun Owners Alliance has changed its position on the following bills,
due the changes in the bill language.
HB 266 - RESTORATION OF RIGHT TO BEAR ARMS - THROCKMORTON
UTGOA position: OPPOSE
HB 266 apparently intends to make it possible for those who have been
committed to a psychiatric institution to petition to regain their gun
rights. However, as written, the bill would do nothing, since it depends
on the federal government to fund such petitions at the federal level.
In addition, the bill has been amended to provide that a person must not
be
receiving treatment or taking any medication in order to regain his
rights.
UTGOA is not quite sure why someone who recognizes that he has an illness
and cooperates with treatment should be punished for being
responsible. We're not sure why someone should be forced to choose
between
the right to self-defense and necessary medical treatment.
People who are under psychiatric care and are taking medications are
currently permitted to work as teachers, doctors, lawyers, social
workers,
and legislators. Why should they be forbidden to own guns?
UTGOA believes that anyone who is too dangerous to own a gun should not
be
permitted to serve in ANY position of public trust.
If a person can prove he's not a danger to others, what difference does
it
make what medications he takes? And if he can't prove he's not a danger
to
others, whether or not he takes medications is irrelevant.
This bill will not help restore gun rights, and it will open the door to
barring anyone who's ever received mental health treatment from owning a
gun.
HB 266 has passed the House and is now in the Senate. Please ask YOUR
Senator to OPPOSE HB 266, 1st substitute.
HB 95 - REGULATIONS OF PAWN SHOPS - MURRAY
This bill has been substituted and we are currently reviewing it to see
if
it addresses our objections.

HJR 15: RESOLUTION RESCINDING THE CALL FOR CONSTITUTIONAL CONVENTION -
FIFE
UTGOA position: SUPPORT
HJR 15 "urges the repealing, rescinding and superseding of all
applications
to Congress for a constitutional convention". It also urges other states
to do the same.
The Utah legislature has previously voted to support a constitutional
convention. Such a convention would make it possible to rewrite the
Constitution completely and would pose a serious threat to our entire
system of government. We would also almost certainly see attempts to
remove the Second Amendment.
Our existing procedures for amending the Constitution have worked well
for
over 200 years. Rewriting the entire document is neither necessary nor
advisable.
HJR 15 will be heard by the House Political Subdivisions Committee on
Thursday, Feb. 15, at 8 AM, Room 223. Please let committee members know
that you would like them to SUPPORT HJR 15.

HB 355: PUBLIC SCHOOLS SURVEYS AMENDMENTS - KING
UTGOA position: OPPOSE
HB 355 will allow government schools to question children about "matters
related to youth violence, or to the use of alcohol, drugs or tobacco"
without parental consent. In other words, they will be able to ask your
children if you have guns at home, if they're loaded, how they're stored,
etc. - without your permission.
The school would have to send a letter to let you know they plan to do a
survey and if you want to see it, you'll have to go to the school. If
the
letter gets lost, or if you're a non-custodial parent, you're out of
luck.
Earlier today we heard over and over again that no student should be
"forced" to learn gun safety, and that it should require a note from
parents to participate. If teaching life-saving skills requires parental
permission, shouldn't the same hold true for participation in intrusive
surveys?
We were also told that teachers are so terribly overworked that they
can't
possibly find time to include one hour of gun safety education without
seriously affecting our children's academic progress. If there's not
even
an hour to save kids' lives, how is there time to administer surveys that
have no direct benefit to children at all?
Except in the case of child abuse, there is no excuse for questioning
children without parental consent. And precious school time should be
devoted to education, not surveys.
HB 355 is currently in House Rules - where we hope it stays! Please let
your Representative know that you would like him/her to support parental
rights and OPPOSE HB 355.
HB 376: CONCEALED WEAPONS PERMIT HOLDERS - RECIPROCITY is now available
online at http://www.le.state.ut.us/~2001/htmdoc/hbillhtm/HB0376.htm.
HB 376 will require that Utah honor carry permits from any state or
county. It will also require that BCI actively request that other states
recognize Utah permits. UTGOA enthusiastically supports this bill. It
has
not yet been assigned to a committee; we'll let you know as soon as we
do.

Dear friend,
As many of you know, a Constitutional Convention, also known as a ConCon,
(vrs. a Constitutional Amendment) would have the power to re-write the
entire U.S. Constitution.
There has never been an Article V Constitutional Convention since our
current U.S. Constitution was ratified. Sadly, Utah is one of several
states with a standing call for a ConCon. Realizing the threat to the
U.S. Constitution that a ConCon poses, several states have recently
repealed their calls for a ConCon.
HJR 15 would repeal all of Utah's calls for a ConCon. HJR 15 will put
Utah on the books as being pro-Constitution instead of being on the books
as anti-Constitution (calling for a convention implies we need a new
Constitution).
Please attend the House Standing Committee hearing on HJR 15 tomorrow
(Thursday, February 15, 2001) at 8:00 am, in RM 223 (in the State Capitol
Building), if at all possible, in support of HJR 15.
I have included a flyer below with some key points about why HJR 15
should be approved and Utah's calls for a ConCon repealed.

CITIZEN ALERT
Dear Citizen of Utah, please ask your Legislators to rescind (invalidate)
all calls for a Constitutional Convention, which still remain on their
books.
Article V of our Constitution allows amendments to be made two ways. The
only method which has been used since 1787 requires a "yes" vote from two
thirds of both the House and the Senate, plus ratification (approval) by
three quarters of the states. This procedure is reasonably safe. The
other way, a Constitutional Convention (sometimes called an Article V
convention or a Con Con) is dangerous. Recently, several State
Legislatures, hoping to bye-pass Congress and to push through a
single-issue amendment, such as a Balanced Budget Amendment,
have applied to Congress for a convention. It is an erroneous belief that
state Legislatures
can control the convention and limit it to a single issue of their
choosing.
LetÆs look at why a Constitutional Convention can be very dangerous.
Although, the states may have asked for it, they have absolutely no
control over it.
Article V gives the states no power to:
-Decide which topics will be considered, or limit it to a one-issue
convention.
-Choose who the delegates to the convention will be, or how they will be
chosen.
-Write the desired amendment(s).
-Object, or withdraw, if the convention does not do what they intended it
to do.
Congress is given a blank check in choosing:
-Where the convention will be held.
-How many delegates the states may have, and how they will be chosen.
(Note: There is no constitutional guarantee that every state will have at
least one delegate.)
Now û The most dangerous part
Once the delegates are chosen, only the Convention is empowered by
Article V to determine the number and content of the proposed amendments.
The Convention is not bound by any limitations from the States, Congress
or the people.
Chief Justice Burger said, "No one tells a Con Con what to do.. Its
powers are unlimited." Once the Convention is called, there is no way to
stop wholesale changes to our constitution or Bill of Rights. The
delegates may use their power to re-write the rules, the Constitution, or
the means of ratifying their proposals. Chief Justice Burger further
stated, "After a Convention is convened, it will be too late to stop the
Convention if we donÆt like its agendaà..A new Convention could plunge
our Nation into constitutional confusion and confrontation at every turnà
and I am glad to see states rescinding their previous resolutions
requesting a Convention".
All applications to Congress for a Con Con remain active on their books,
regardless of subject matter. If 34 states apply for a convention, for
any reason, Congress must call it. 32 states have already applied. The
good news is that recently four states (Idaho is one) have rescinded all
their applications. It is time for Utah to do the same. Please call your
elected state representatives and ask them to sponsor or co-sponsor a
bill to rescind UtahÆs calls for a Con Con.

There are two very important hearings on pro-gun bills that we need to
attend this coming week. Please get this information to any pro-gun
individuals you know whether or not they are using email.
HB 376 -- Concealed Weapon Permit Holders - Reciprocity hearing
This Monday, February 19 (Presidents' Day), the House Judiciary Committee
will be hearing Rep. G. Donnelson's HB 376 -- Concealed Weapon Permit
Holders - Reciprocity bill in Room 223 at 4:00 pm.
This bill would do two things. First, it would require the DPS to make
formal, annual requests of all States that issue concealed permits but do
not currently recognize Utah's permits to recognize our permits. This
could well lead to an increase in the number of States that would accept
a Utah CCW permit as valid. Second, the bill would recognize the CCW
permits of ALL other States that issue them as well as allowing residents
of any States that do not require a permit to carry concealed to do so
here without a permit. (At this time, this only applies to residents of
Vermont.) This would send a strong message to potential tourists that
Utah welcomes them and their CCW weapons thus making our streets safer
and increasing our tourist revenue. :)
Room 223 is a small room. Please arrive early to get a seat or even
guarantee that you can get into the room. It would be great if the
gun-phobes had no seats at all when they arrived.

I'm writing to ask you to please support HB 376 -- "Concealed Weapon
Permit Holders - Reciprocity" that will be heard before the House
Judiciary Committee this Monday, February 19 and send it to the full
House favorably. This bill would require the Dept. of Public Safety to
make annual inquires of other States seeking to gain their approval of
Utah's Concealed Weapon permits. This would allow those Utahns who have
concealed weapons permits to travel with their legal weapons for
protection in those States. Under this bill, Utah would also recognize
the concealed permits of all States that currently issue them, setting
out the welcome mat to law abiding residents of those States.
This bill is plain common sense. State issued licenses to drive are
valid across State lines. Law abiding residents of one State do not
become any less law abiding simply because they cross State lines.
Neither do reasons and needs to carry a concealed weapon disappear simply
by crossing State lines. There is no good reason that State issued
permits to carry concealed weapons are not valid in other States.
This bill is very important to me. Please let me know whether you plan

HB 376 - Concealed Carry Recognition will be heard MONDAY Feb. 19 at 4 PM
in Room 223. It is VERY important that you plan to attend! We expect a
very close vote, so your presence, phone calls and email are critical.
1. Please plan to attend the committee hearing. The bill is first on the
agenda, so try to arrive no later than 3:45.
2. Dress appropriately. Many legislators mistakenly believe that all gun
owners are drunks, wife-beaters, neo-Nazis, lunatics, terrorists, or
wanna-be criminals. Whether this is a result of ignorance or bigotry,
it's
wrong. But it's also a fact of life. If you want legislators to believe
that you're the responsible, hard-working, law-abiding person you really

interview. If you don't, you are hurting the cause of gun rights and
helping to perpetuate bigotry against your fellow gun owners.
3. If you wish to speak, plan your testimony in advance, and try to have
it
written out. Most people get nervous and tongue-tied, especially when
there's a large crowd and TV cameras, and it helps if you have your
comments prepared. You should plan on 1-2 minutes maximum. Also plan to
stick to the topic. The topic is "why this bill is good public
policy". The reasons HB 376 is good public policy are:
a. It is fair. People have just as much right to self-defense in
Utah as
they do in their home state.
b. It will save lives. When ordinary citizens carry concealed
firearms,
crime goes down. This protects both Utahns and non-residents.
c. By accepting other states' permits, more states will accept
Utah
permits. This will benefit Utahns who travel to other states.
d. It will save money, by decreasing BCI's workload. It will
also save
money by decreasing crime and its associated costs.
e. Just as Utah accepts drivers licenses and marriage licenses
from other
states, we should accept carry permits.
Legislators are very practical people. For the most part, they
will
support or oppose a bill based on its immediate, practical impact: "Will
it
save money, lower taxes, save lives, or make my constituents happy? Will
my constituents be angry enough to vote against me if I vote against
it?" They are generally less concerned (or unconcerned) with
Constitutional law and philosophy, the United Nations, the New World
Order,
Communism, foreign invasions, Hegelian dialectics, the Illuminati, and
various "conspiracy theories".
Your job is to be a good salesperson, and sell legislators the
bill on
their own terms. If you are trying to sell a car to a middle-aged woman,
it's not very smart to tell her that "Chicks love it." If your customer
is
a single male college student, it's not very smart to tell him it will
easily hold 5 kids plus groceries. This is only common sense.
Be smart! Talk to legislators about what matters to THEM - not
what
matters to you. Talk about how the bill affects you in practical
terms. If you have a first-hand experience, or anecdote, that's usually
helpful.
For example: "I work for ______ and I have to travel all over the
country. I usually visit 20 different states a year. If I had to get a
permit in each of those states, it would cost me about $3,500 which I
can't
afford. If HB 376 passes, I'll be able to use my Utah permit in most of
those states."

Plan to attend hearing
In a continuing show of contempt for law abiding citizens' ability to
defend themselvs (as well as his command of legislative procedures) Rep.
Gary Cox dealt a (we hope temporary) setback to Rep. Donnalson's HB 376
-- CCW Recognition today in the House Judiciary Committee by offering a
substitute that gutted the entire bill. Cox's hostile substitute was
accepted by a vote of 7 - 6. This IS progress over last year where we
would have expected to lose 12 -1 or even 13 -0. But the game isn't over
yet. Donnelson will be back with amendments or another substitute to
restore the original intent of the bill. And with some calls, faxes, and
emails, as well as another heavy turn out at the hearing, we think we can
sway one or even two of those who voted against us and send this bill to
the full house on a vote of 7 - 6 in our favor.
HB 376 as originally proposed and substituted by its sponsor, would
require Utah to recognize the CCW permits issued by all other States,
Counties, Cities, etc. Upon doing this, there are about 8 States that
will immediately honor Utah's CCW permits. That's 8 more States where
you can travel with the safety and security of your legally carried self
defense weapon. HB 376 would also allow off duty police officers from
out of State to CCW in Utah. Currently, they may only do so if they are
on "official business." It is also important to note that under current
Utah law we do not honor permits from places like California even though
their requirements are MUCH more stringent (and discriminatory) than our
own simply because in that (and several other States) the permits are not
issued by the State, but are instead issued by the County or City. Some
have, and will make a big deal of the fact that this bill would allow
people from States with less stringent training requirements that Utah to
CCW here. Bear in mind that Utah honors driver's licenses from all 50
States regardless of the local requirements to obtain that license. Also
remember that there is no difference in the rate of problems with CCW
permitees between Arizona which requires 16 hours of training and
Washington State that has no training requirement and Utah that has
minimal training.
We expect this bill will be heard again by the House Judiciary Committee
at their Wednesday, February 21st meeting which is at 7:00 am probably in
Room 223.
What we need to do:
Contact Representatives Ron Bigelow and Ben Ferry and ask them to change
their votes. They voted in favor of Cox's sabotage substitute,
effectively voting against Donnelson's bill. These two are the closest
we have to "swing votes" and some polite, but sure feedback may well
swing them back in line. The other five who voted against us are very
anti-gun and are not worth wasting any time on until the next election.
They are Arent, Cox, Hendrickson, Tyler, Daniels.

sure the recipient's name is in large, bold print on the first page.
Messages for any Rep. may be left during business hours with house
operator at 801-538-1029. Ask her to "hand deliver" the message.

Again, please be polite but firm. Let these two know that you are
disapointed in their vote to allow Cox to sabotage a perfectly reasonable
bill that will make it easier, safer, and cheaper for Utahn's with CCW
permits to travel in other States and to welcome law abiding citizens to
our State. Ask them to change their vote and oppose HB 376 S2 (Cox's
substitue) and support whatever amendments or substitutes Donnelson
offers.
We also need to contact those Representatives who voted with us (by
voting against Cox's sabotage substitute) to thank them for their vote
and to ask them to stand firm and support Donnelson's amendments or
substitutes. A couple of those who voted with us were fairly quiet on
the voice vote and only lent their full support when other members
demanded a roll call vote. More evidence that holding legislators
accountable for their votes tends to get them voting the right way.
Again, please be polite, thank them for their vote, and ask them to
support Donnelson's bill and to oppose Cox's sabotage substitute.

HB 345 Vermont Carry
Rep. Mike Thomson's HB 345 "Vermont Carry" is scheduled to be heard by
the same House Judiciary Committee this Wednesday, February 21st at 7:00
am in room 223. Please contact the above members of the committee and
ask them to support Thompson's HB 345.
This bill would, in most instances, remove criminal penalaties for
carrying a concealed weapon without a permit. Utah's CCW permit system
would remain in place for those who wanted a permit either for travel to
other States, to avoid the background check when buying a gun, or to
carry in one of few places where those without permits would not be able
to carry. In short, this bill would bring Utah's Statutes in line with
Utah's Constitution by recognizing a RIGHT to carry a gun for self
defense rather than just a privelege granted by the State.
To have this bill drafted, introduced, and released from Rules Committee
to a Standing committee is a HUGE success that we only dreamed of just
last year. In any contacts with Rep. Thompson, please be sure to thank
him for sponsoring this bill. The good freshman representative is not
even a gun owner. He has done this because he believes it is the right
thing to do and he has taken heat for it.
ATTEND the HEARING.
Friends, it was an awesome sight today to see the hearing room packed
with pro-gun people. We need to do it again and have an even larger turn
out this Wednesday. This is a small room. If we all show up and all
arrive early, there is no reason we cannot pack the room and the hall way
outside so that anti-gunners cannot even get in, much less find a seat.
Let's give our friends this show of support and deny our enemies any
comfort. The hearing starts at 7:00 am so many of us should be able to
attend before we head off to work. The room is small, I fully expect
that the anti-gun forces will be out in strength, and we want to pack the
room, so please arrive early--6:45 at the latest. 6:30 would be ideal.
Bring some hot cocoa or coffee or OJ and enjoy being able to turn out to
support a couple of good bills for a change. Most of us will probably
have to go straight to work after the hearing, but if at all possible
please dress in your Business or Sunday best or at least "business
casual." There are restrooms where I would suspect you can change into
work clothes if you need to. If you simply must wear work clothes please
avoid Tshirst with slogans.
If any of you are particularly gifted or have special experience that may
be relevant and would like to testify or speak, plese let me or Dr. Sarah

to coordinate our side. We could particularly use a police officer or
two. Rep. Gary Cox is a police officer and we need to counter his
influence with other officers who do trust law abiding citizens to

Subject: HB 376 S3 -- Concealed Carry Recognition Due for Vote between 2 and 3 pm today

Rep. Donnelon's HB 376 S3 that would recognize all out of State concealed
carry permits as well as allowing off duty police officers to carry their
weapons while visiting Utah is due to be voted on by the full house
sometime this afternoon.
It looks like we've done a pretty decent job of contacting legislators in
the last 16 hours on this judging from the comments I received from
legislators or their wives as I called them last night.
Now is the time for the final push to get this good bill past the house,
intact, and sent to the Senate. Legislators and House leadership really
need to come back from their lunch breaks to find a stack of messages in
favor of this bill waiting for them.
Please, take a few minutes and do two things.
1: Email House Leadership and your Representative asking them to support
HB 376 S3 while opposing any efforts to amend or further substitute it.
Cut and paste addresses and sample email below.
2: Call or fax House Speaker Marty Stephens and your own legislator at
the capital again asking them to support HB 376 S3 while opposing any
efforts to amend or futher substitute it. Contact info below.
At this point, volume, rather than content is what really matters. Phone
messages can be simply, "Please support HB 376 S3. Please oppose any
amendments or further substitutes." Faxes and emails need be no longer

I had someone ask for these so here they are. This is, I believe, a full
list of house email addresses--excluding the private email addresses
listed by some reps. It should be in a nice cut-and-paste format with
one address plus semi-colon seperator per line. IOW, it should paste
directly into the blind carbon copy (bcc) field of your email handler.
Please be a bit discriminate in sending emails to the entire legislature.
If nothing else, sometimes you want to send different messages to
democrats and republicans or those who are likely to already support a
bill and those who are likely to already oppose a bill. And make sure to
always use the bcc field rather than the to field.
Note that some email programs (EG Juno) limit the number of email
addresses that can be entered. On these systems the list has to be done
in two or more pieces.

It seems that voting has been delayed at the capital due to a computer
glitch. What the anti-gunners won't do to kill a bill. :)
So, if you have not yet contacted house leadership or your own
Representative in support of Donnelson's HB 376 S3 you have one more
evening to do so. Please do. If you have contacted them, consider
making a "follow up" call tonight just to ask how things went. When they
tell you about the voting delay, make sure they will support the bill
tomorrow and will not let it be amended, further substituted, or even
bumped from its place on the agenda. Once Gary Cox realizes that we are
one step ahead of him and he isn't going to be able to slip a bad
substitute or amendment through he may try to knock it off the agenda.
This is also a good opportunity to email, fax, and/or call in support of
Thompson's HB 264 which requires public schools to offer gun safety to
grades k - 6.

HB 376-S3 - CONCEALED FIREARMS PERMIT HOLDERS - RECOGNITION - DONNELSON
It has come to our attention that both USSC and GOUtah! have sent out
alerts which contain INCORRECT information about HB 376 S3. They both
say
that Senators should support HB 376 S3 without amendments.
The truth is that UNLESS HB 376S3 is amended, it will NOT be passed this
year!
While we believe that these are innocent mistakes, resulting from our
request las week that the House pass this bill without amendments,
innocent
mistakes can have very serious consequences. Despite our best efforts,
the
bill WAS amended and now it needs to be fixed.
Only Utah Gun Owners Alliance (UTGOA) and the Utah Self-Defense
Instructors
Network (US-DIN!) have been on the scene following this bill as it

HB 376S3 said that Utah would honor permits issued by any state or
county.
HB 376S3 Amended version says that Utah will honor permits by any state
or
county that requires a background check.
Here's the problem: BCI would have to check with each of the more than
3000 states and counties in the US and learn what their firearms laws
are,
so they would know which permits to accept. In addition, all (or almost
all) of these states and counties DO background checks, but many don't
REQUIRE it by law. In fact, UTAH doesn't even require background checks
by
law. As a result, these states and counties would not have their permits
honored, even though they perform background checks.
For BCI to check over 3000 agencies would cost a huge amount of money.
And
it's too late in the session for bills that require funding to be
passed. So the legislature will have no choice but to KILL this bill.

Recognition passed!

SB 37 - HATE CRIMES AMENDMENTS - SUAZO
You almost certainly know that there is currently a lot of controversy
regarding SB 37, Hate Crimes - Suazo.
Because we are such a powerful and effective group of grass roots
activists, it seems that everyone is trying to claim that gun owners
should
be "on their side".
We therefore feel obligated to point out that Utah Gun Owners Alliance
does
NOT have an official position on this bill - either for or against.
Yesterday, Senate President Al Mansell offered the opinion that gun
owners
should support SB 37. He thinks we should support it because it would
take
some of the "nuts" off the streets and that by supporting it, it would
give
the gun lobby more credibility.
UTGOA has some philosophical problems with Sen. Mansell's argument. He
is
assuming that there is a connection between the "gun lobby" and/or gun
owners and "nuts" on the street. There is no such connection. UTGOA
members, and members of all the other gun organizations of which we're
aware, are law-abiding, responsible people. We're not Nazis, skinheads,
gang members or criminals and we don't commit "hate crimes" - or any
crimes. In fact, we've argued that all the policies that say "Anyone is
welcome here except someone legally carrying a gun", are in themselves a
heinous form of bigotry.
The job of getting "nuts" off the street is the job of law enforcement
and
the criminal justice system; it's not the job of gun owners. We just
choose to be able to defend ourselves should some "nut" or criminal
decide
to assault us.
It's true that the media work very hard to portray all gun owners as
racists and criminals, and many people believe those lies. It would be
nice if someone in Sen. Mansell's position were to state publicly that
this
is not true, instead of helping to perpetuate the misinformation.
On the other hand, Arnold Gaunt and some others are claiming that SB 37
is
an "anti-gun bill" and that gun owners should oppose it.
UTGOA is concerned about the provision in SB 37 that allow Class A
misdemeanors to be charged as felonies. As you know, a person convicted
of
a felony loses his gun rights forever under both state and federal law.
However, although UTGOA has the greatest respect for Mr. Gaunt, we do not
agree with his opinion that SB 37 is an "anti-gun" bill. And our bylaws
limit us to dealing only with bills that affect gun rights or gun owners.
To reiterate, Utah Gun Owners Alliance has NO official position on SB 37

Hate Crimes Amendments. We trust YOU to make the right decision about
this
bill, and to decide what to communicate to your elected officials.

despite their previous promises to support these bills. We need to

switchboard phones off their hooks today and tomorrow. Ask them to
release and support HB 376 S3 (Concealed Carry Recognition) *with
friendly ammendments* and get it passed. Ask them to also release and
support HB 264 S2 (Gun Safety Education) as is and get it passed. Please
do not mention ANY other bills during this phone call. We recognize that
gun owners have other areas of interest and passion, but we ask that you
make seperate contact on those issues so that this issue is not blurred
in the minds of legislators. Also--at this time and for this contact on

SENATE REPUBLICAN LEADERSHIP is trying to kill our gun bills!
Senate Republican leadership has apparently caved in to pressure from
anti-gunners, perhaps even Gov. Leavitt himself! They have so far
refused
to put HB 376S3 (Concealed Carry Recognition) or HB 264S2 (Gun Safety
Education) on the Senate schedule.
With the legislative session ending tomorrow, this delay can only be
interpreted as a plan to kill pro-gun legislation.
Over the weekend, Utah Gun Owners Alliance spoke with both Senate
President
Al Mansell and Majority Leader Steven Poulton. Both of them said
specifically that they supported HB 376S3 and would make sure it
passed. Sen. Poulton even agreed to sponsor the bill.
Now Rep. Donnelson says they're refusing to put his HB 376S3 on the
schedule at all!
Don't let our gun bills die!
WHAT YOU MUST DO!
1. Call Senate President Al Mansell, and Sen. Steve Poulton. Remind them
that they promised to support our pro-gun bills and that you expect them
to
do so. You want them to put both bills on the schedule right away, and
to
do everything possible to make sure they pass with friendly amendments.
Do NOT accept any excuses, and do NOT make ANY threats of any kind. They
either support gun rights or they don't.
Don't let them confuse you. If they support gun rights, they'll put our
bills on the schedule and vote for them. If they don't, then they don't
support gun rights - no matter what they say.
2. Call YOUR Senator. Ask him/her to do everything possible to make sure
that gun bills get put on the schedule - and to make sure they pass with
friendly amendments.

Senate Leadership is still sitting on our pro-gun bills, though they are
now claiming they are not trying to kill them, "they just aren't on the
calender yet."
Well, we all know that at this point in the session, any bill that
leadership doesn't put on the calendar, leadership has effectively
killed. This is unacceptable. HB 376 S3 passed the house by a HUGE
margin and with every Republican but one (and that was Tyler who everyone
calls a Democrat anyway) and three Democrats supporting it.
Either our Senators and Senate Leadership support our gun rights or they
don't. If they do, they will get these bills on the calander and get
them passed. If they don't get them on the calander and get them passed,
then they are clearly unsupportive or even hostile to our RKBA.
Please, if you haven't called yet, do it now. If you have, call again
and then encourage your spouse, a friend, or a neighbor or relative to
call.

call you can leave a message for several Senators. Please call and leave
a message for Senate President Mansell, Senate Majority Leader L. Steven
Poulton, and your own Senator.
Please note that we've received reports that HB 264 "Gun Safety
Education" may have been amended into an anti-gun bill by removing the
"value neutral" language. If true, this would allow schools to have
Sarah Brady come in to teach gun "safety." For this reason, please focus
on HB376 S3 for now.

idea of actually acting on HB 376 S3 should a much needed amendment be
passed in the Senate. Therefore, please also begin calling Speaker
Stephens, Majority Leader Kevin Garn, and your own Representative and ask
them to see to it that HB 376 S3 receive speedy action and pass once the

HB 376 S3 is about ready to get its final hearing and vote in the Senate.
We have two issues at this time.
First, we understand that Senator Spencer is preparing to offer a hostile
amendment. Spencer's amendment would limit the time frame Utah would
honor out-of-state permits to 60 days. Should this pass, Utah's informal
agreement with some 12 other States to honor each other's permits would
certainly cease to exist. It is also highly unlikely that the 8 states
posed to recognize Utah's permits if we recognize their permits would
consider this time limit as acceptable and would, therefore, not
recognize our permits. Finally, as you CCW permit holders know, it takes
longer than 60 days to obtain a Utah CCW. Thus, if someone moved here
with a valid out-of-state permit, their permit would expire and they
would be unable to legally carry prior to obtaining a Utah permit. We
need to oppose Sen. Spencer's amendment.
Second, the bill currently contains too large of a fiscal note to be
allowed to become law if passed today. There is a friendly amendment
that will correct this issue. This is "amendment 4." We need to support
this amendment.
ACTION ITEM:
PLEASE call the Senate at once. Leave a message for your own Senator,
Senate President Mansell, Majority Leader Poulton, and also Sen. Bramble
(who is Senate sponsor of the bill). Ask them to oppose Sen. Spencer's
amendment and to support "Amendment 4" as written.
Messages should be left at 801-538-1035.
Please then contact friends, family, etc who do not regularly read email
and ask them to call. We can win this, but only with a supreme effort
from gun owners right now, this morning.

URGENT GUN BILL UPDATE!
It turns out that the information give to Utah Gun Owners Alliance
earlier today about Senate leadership "holding" HB 376-S3 (Concealed
Carry Recognition) was incorrect, even though it came from bill
sponsor Glenn Donnelson. The mixup started when the Senate did not
post a list of new bills to be considered today, which led to the
incorrect conclusion that they were "holding" the bill.
As you can imagine, there are some very hurt feelings on the part of
the Senators who have been working hard to support this bill!
The following people have committed to supporting HB 376-S3 with
friendly amendments.
Senate President Al Mansell
Senate Majority Leader Steve Poulton
Senate Rules Chair Mike Waddoups
Sen. Curt Bramble (who is the Senate sponsor and has been
enthusiastically supporting the bill all along!)

Sen. Chris Buttars
There may be others who have not made their support public.
