Hey all.. A quick question..
Is it illegal to make .mp3's from singles? Because some of my friends want
me to get the Memory Gospel (the song played on the Adidias commertial) make
it into a .mp3 and give it to them..
I mean its not like I woulden't do it if it was illegal, but it just seems
to me that if an artist releases a single, that it would be good promotion
to get it on the net.. Anyway, just wondering..

Simply put YES. Without permission from the original copyright holder it
is criminally and civilly illegal to DISTRIBUTE copies. You can, for your
own purposes(say make anmp3 for your portable player or computer) make
copies, but not give them away or sell them to your friends or the public
in general.
However there are two sides to this coin. The legal issue, which is clear
cut and obvious and the ethical issue which is not so clear cut.
What I mean is, obviously the law says don't do this, but given the
pragmatics of the situation, the law is effectively moot--that is there is
a VERY small chance that you would be procecuted or find yourself in civil
court. SInce there is no legal repurcussion, we have to ask ourselfs,
should we still do it?
There are many schools of thought on this, but generally if you copy and
distribute mp3s because you don't want to pay for the actual album, it is
wrong and you shouldn't do it. If you want to make and mp3 for someone to
sample to see if they like it, then I would say it is okay, as long as
they buy the album if they like it or delete it if they don't in a
reasonable amount of time, say 30 days max or something. This would
satisfy your "promotion" idea without outright stealing. It would also be
acceptable if you had MP3s of extremely rare stuff, or live stuff that the
artist hasn't/will not release commercially; however, the second they do
so you should patronize the commercial release.
You have to ask yourself--if I like the music on this mp3 enough to keep
the MP3, do I respect the artist who made the mp3 enough not to steal it
from him? To pay them for their talent so they can continue to make good
music?

As far as I know, it's NOT Illegal to MAKE mp3's but it IS Illegal to DISTRIBUTE
them. I know w/ roms it's like if you have the real game, you can keep the
downloaded rom but it you don't, you can only store it for 24 hours. But who
would ever know you know? Up to you. My ex has thousands of MP3's on his works
site and they were only available for his workmates but that's still highly
illegal. Whatever.
Hope that helped.

Yeah, but doesn't he usually dontate that stuff? I mean, didn't he donate like
a nice big check to a charity when he allowed some company to use "GMOFW" for a
car comercial? Yeah. I think. :-)
I dunno, I think things like that are slightly bad for a person's image, well,
a MOBY type person's image. I mean, Madona or Carmen Electra could hawk CK but
MOBY? I think that wouldn't look right but if he gave the money to a good
cause, then who can really complain? I think if I were in a similar position,
I would do it just because. Just for shock and for fun. And ofcourse I would
probably give the money away too. I do believe in giving to others if you have
more than you need. Which leads me to want to say "If you can't donate,
volunteer...at least for like a few months every once and a while." It makes
you feel really good. Which is kinda selfish. I suck, ok, please don't kill
me. :-)

If you make the mp3's from singles you already own for yourself
(for in your RIO or something) it's not illegal, but if you sell them
or even GIVE them away it's illegal!
I think the copyright laws concerning the use of CDR's also apply to mp3z
I must admit that every now and then I also download an mp3, but I only
do it because I can't find the original CD... I believe that this mp3/CDR
revolution is killing the music industry! In the early '90s, compilation
CDs
still had the WHOLE song on them, and now almost everytime the last
and the first 3 seconds of a song are mixed over into another song.
How did this happen do you think? :(

Well the music industry is in afervor over this topic but the fact of
the matter is, while the old law of copyrighted material still exists,
there are many corporate and label-owned sites that offer free downloads
of mp3's.
As an career artist myself(albeit not a money hungry one) I have no
problem with mp3's as long as the artist and label info is included in
the file.
As a human being, I don't get the mp3 thing, I'd much rather listen to
the cd than convert the music listening experience into a sound card
based point and click experience. But thats just me. I'm the kind of
guy who has 200W cd player in his car, and 500W amp, receiver, 200 cd
player, dual cassette 8 remote control home stereo. But that's just me,
like i said.
I take the listening very seriously, I'm the kind of guy who tells you
to be quiet during the songs.

I hate commercialism as much as the next guy(not really, I couldn't care
less actually) but if some world famous designer came up to me and asked
me to be a model in a couple of photos, you better believe I'd get my
ass in those jeans, money or no money.
This has nothing to do with money, it has to do with getting your 100 ft
poster plastered on the side of a manhattan building. That and being
able to say that you modeled for Calvin Klein.
Sometimes I think people on this list miss a few links in the moby
psyche. Sure he's a down to earth peace love harmony and the punk
lifestyle kinda guy, but he has that rock star drive. There isn't a
single successful musician out there who doesn't have it. I don't know
if you noticed this but every time moby opens his mouth he talks about
how his music affects others, and how others react to him. "I make the
music for myself" is just insecurity, or lack of drive. We(musicians)
tend not to attempt to make music that shouldn't be heard. "We do it
for the chicks"~old 80s rock idealogy.

Right, this is the problem half so I'll keep trying....
As well as the playlist, this was also on the Rage web page (http://www.abc=
.net.au/rage/rage.htm) about Moby:
When Moby first erupted onto the rave arena with the Twin Peaks =
sampling Go, little did the
world realise just how far this New Yorker would go to confound =
the public. From house
innovator to techno punk originator, thrash metal rocker to =
inadvertent soundtracker and
composer, Moby has travelled disparate musical terrains with an =
insatiable thirst for fresh
sounds and spiritual energy. It's been a long and varied =
journey and one which laughs in the
face of the accepted take on eclecticism. Not for Moby the safe =
bet. Moby, you see is one of
music's true mavericks. Most of the cliches attached to Moby - =
strident environmentalist,
Christian, non-drinker, non-dr_g taker - have kind of fallen by =
the wayside over the last few
years as his take on the world has become more and more =
ambiguous.=20
Born in New York and raised in Connecticut, Moby's father died =
when he was only two.
Subsequently he was brought up by his mother, an open minded =
woman who encouraged
Moby to pursue whatever creative avenues appealed to him. By =
the time Moby was ten he
was actively learning classical guitar, something which held =
him in good stead for the punk
explosion which attracted him in his teens. By his twenties he =
had been involved in bands as
disparate as speed metal kids The Vatican Commandos, anarchist =
noise combo Flipper and
critically acclaimed 4AD band Ultra Vivid Scene.
With Moby's love of new in music it was inevitable that he =
would be drawn to the house
scene in the late 80s. His early singles were staples of the =
rave scene, with Go storming the
top ten in the UK. With 1995's Everything is Wrong album - his =
first true long player, the
previous releases being little more than collections - he could =
be found pouring the styles that
he'd grown up with into a hybrid of house, rock, h_rdcore, =
th_ash and jungle, all laced with
more than a touch of drama. The singles Hymn, Feeling So Real =
and Everytime You Touch
Me revealed Moby's ability to create uniquely moving music.
With Moby's appearance playing on 1995's Lollapallooza came the =
realisation that he had
eschewed his dance roots and gone back to the h_rdcore thrash =
punk of his youth. A
tryptych composed of industrial punk, speedcore and heartbreakin=
g instrumentals, the
following year's Animal Rights album was a stab in the back for =
purism of any kind. "It was
an intentionally abrasive, misanthropic record." he recalls. =
Around the same time he also
released The End of Everything, an album of breathtaking =
synthetic orchestrations, under the
pseudonym Voodoo Child.
In 1997 Moby released I Like To Score, a compilatioin of some =
of the many of his tracks
which have been used in movies. Among these was the breakbeat-dr=
iven version of the
universally recognisable James Bond Theme , a single which not =
only represented Moby's
return to the dance arena but also hinted a new found love of =
hip hop, a genre explored in a
little more relaxed way on his latest opus Play.
If Play were a theatrical performance it would be in three =
acts. Act one finds Moby building
his music around field recordings of indigenous black music =
from the early 20th century. Act
two features Moby himself on vocal duties. The final act is =
represented by the quietly
reflective instrumental tracks. The glue that holds the entire =
performance together is provided
by the breaks of hip hop. Fear not because the overall effect =
is often moving, occasionally
spooky and always breathtaking.
He plays everything from classical guitar to Roland 303, he's =
played everything from thr_sh
metal to hands in the air techno, he's remixed everyone from =
Michael Jackson to Metallica
and he's turned down production offers from Hole and Guns 'n =
Roses. One thing is certain
about Moby - he can still surprise. With Play Moby has =
delivered another stunning head
turner. And the best bit is, you get the feeling that there's =
still so much more to come from
NYC's favourite maverick.
Moby was also on ABC's Recovery on Saturday morning where he was interviewe=
d by a badly drawn cartoon kid, although there doesn't seem to be anything =
on their website (http://www.abc.net.au/recovery/recovery.htm) about it.
Mark.
