SANTA ANA, Calif., Jan. 23 (UPI) -- The Walt Disney Co. reportedly
maintains a log of numerous reports of ride injuries, but keeps the
information from becoming public by using a popular legal strategy.
The Orange County Register reports that when sued, the park insists on
confidentiality agreements before it will release the data.
Attorneys who have seen the logs say the complaints involve some of
Disneyland's most popular rides -- Space Mountain and the Indiana Jones
Adventure -- but conclude there is no way to know how seriously park
visitors were injured.
Anaheim resident Lou Carlson, 51, blames a 1996 ride on the Indiana Jones
Adventure for rupturing two vertebrae. He said, ``It seems to me that
Disney's interests have to be balanced with the interest of millions of
people who come into that park.''
Attorney Barry Novack, whose client allegedly suffered a severe brain
injury on the Indiana Jones ride, says the Disney log contained several
reports of injuries and about a dozen letters complaining of injuries
suffered on the ride.
A Santa Ana attorney inspected the log for Space Mountain, and said he saw
reports of at least 50 other injuries over several years.
Consumer advocates call Disney's secrecy dangerous to the public, saying
people need the information to make educated choices and to pressure the
park to correct problems.
But Disney officials say they are protecting trade secrets because the park
designs its own rides.
California is not one of the 10 states that limit or disallow
confidentiality agreements in lawsuits, but a state lawmaker is drafting
legislation for such a law. A similar measure was vetoed seven years ago by
Gov. Pete Wilson.

NEW YORK CITY, NEW YORK, U.S.A., 1999 JAN 25 (NB) -- By Bob Woods, Officials
with the New York City Department of Consumer Affairs (DCA) confirmed to
Newsbytes late Monday they are looking into alleged fraudulent transactions
at online auction houses.
The statement comes following the early Monday publication of a newspaper
article stating the department was investigating Internet person-to-person
auction concern eBay Inc. [NASDAQ:EBAY] in connection with the actions of
people trading on its site.
In a statement made "in response to inquiries regarding eBay," DCA
Commissioner Jules Polonetsky said the department "is actively investigating
complaints regarding alleged fraudulent sales at online auction houses."
Polonetsky also urged New York City
consumers who believe they have been sold fraudulent goods via an online
auction house to contact the DCA office at 212-487-4444, or via the World
Wide Web at http://www.ci.nyc.ny.us/consumers .
No other information was immediately available from DCA.
For its part, eBay said it was "not contacted by the New York City
Department of Consumer Affairs prior to the news breaking in the press."
"We have had subsequent conversations with the New York City Department of
Consumer Affairs and they have been unable to confirm elements of the
story," a statement released by eBay late Monday said. An article in Monday
morning's New York Post, which started a firestorm of coverage in both
mainstream and technology media news services, including Newsbytes, "uses an
`unnamed source' as the basis for the report," eBay said.
"While eBay will not directly comment to an unnamed source and hypothetical
situations, eBay will discuss its industry-leading trust and safety
programs," the statement said. "It has always been eBay's practice to offer
to fully cooperate with any investigation
involving improper items on the site. EBay takes pride in its close working
relationship with law enforcement and regulatory agencies."
A source inside eBay told Newsbytes the company urges consumers who feel
they have been defrauded to take action against the third party who sold
them the product. "We encourage everyone to file a complaint, so the
(fraudulent party) can be found and prosecuted," the source also said.
EBay brings together buyers and sellers of all types of merchandise in an
auction format, Newsbytes notes. In the past, eBay has claimed it acts as a
"middleman" between buyer and seller, and maintains a "buyer beware" stance
on goods sold. Shoppers on eBay who buy goods from third-party sellers, for
example, can post positive, neutral or negative comments about the seller on
the Web site.
Shares of eBay unofficially closed up $20.75 or 10.55 percent at $217.50 per
share on the Nasdaq exchange. Minutes before the close, eBay hit an intraday
high of $217.813 a share.
Early Monday morning, the Post reported DCA was specifically investigating
eBay because sports memorabilia dealers have allegedly sold "one-of-a-kind"
items like signed baseballs to many people. DCA is also alleging that eBay
itself can be charged with fraud because it collects fees from sellers on
each item changing hands via the service, the Post said.
A source within DCA told the Post the government agency is trying to show a
pattern of fraud, and hopes to build a case that can be transferred to the
US Attorney's Office. No charges are currently pending against eBay, the
Post said.
Earlier this month, though, eBay updated its antifraud SafeHarbor and Buddy
Programs security features, in an effort to prevent fraud on its Web site
(Newsbytes, Jan. 15). While an eBay spokesperson told Newsbytes the site has
seen a limited amount of fraudulent activity, the company believes security
issues remain a top concern among its users.
EBay said SafeHarbor 2.0 and Legal Buddy Program 2.0 will help promote safe
online trading, as well as protect the overall community from fraud, the
sale of illegal or infringing materials and people that would misuse its
system.
The programs even go so far as to provide free insurance from Lloyd's of
London to respected traders, eBay said.
Among the other features of the new systems are verified eBay user
identification status, an enhanced feedback forum area, tougher deadbeat
bidder and shill bidding policies, clarification of illegal items that are
not permissible for sale and strengthened antipiracy and anti-infringement
protection.
"EBay has zero tolerance for fraud," stated Meg Whitman, eBay president and
chief executive. "We have committed and will continue to commit resources to
have the most comprehensive programs in order to keep eBay a safe harbor for
online person-to-person trading."
Currently a person joining eBay submits contact information that is verified
at the time of registration and periodically updated to confirm its
validity. However, eBay said it will launch a new program in March 1999 that
will encourage users to voluntarily supply eBay with additional information
for online verification.

I respectfully must agree with Bob, and suggest that your aversion to a
few thin, deliciously cold shards of ice floating at the top of your
martini is merely your own finical fetish against frozen food. If'n you
freeze the Sapphire (I'm assuming!) before shaking (don't even *think*
about freezing the Noilly Prat, though) and you have the shaker
completely filled with cubed ice a properly chilled martini will be born
in five seconds.
But you're right that introducing V**** into the mix is a definite
no-no.

The best martini (other than mine) in the known galaxy can be had for
mere CalTrain fare: The Persian Aub Zam Zam on Haight near Ashbury is
the place for you--if you ask for a martini with Plymouth gin you might

Franklin, you should definitely give their martini a try. And I know
what you mean about the Li-Lo Lounge...it's probably best to stick with

(other than mine) I've had lately: at Bruno's on Mission near 20th.=20
Next time you're at an Oranj Symphonette show, check it out! In
general, I'd recommend Bruno's as having some of the best barkeeps in
the city.

They were actually made by Fisher-Price, called the Pixelvision
PXL-2000. And Charlieman was quite right, they're no kid's toy any
more. If you keyword search on eBay for 'Pixelvision', you'll usually
find between 1 and 3 of them up for auction at any given time. They all
sell right in the $225-300 range. If you ask me, they're worth it...the
thought of taping video on the ubiquitous audio cassette is well-neigh
irresistible to me.

Tally-ho and greetings to all list members!
I've just subscribed, and thought I should go through the introduction thing:
My name is Marc Hermann, one and the handfuls of 16 year olds who actually
like this type of music. I have no explanation for my affinity for it; my
father is a connoisseur of the older genre, and among his Duke Ellingtons and
Ella Fitzgeralds, his collection included a few Martin Dennys. A homemade
compilation tape was probably my first introduction to this music....I started
listening to it when I was in 6th grade, but it wasn't until about 3 years ago
that I learned what it was I was listening to, when we found a box of some of
his old albums in the basement, one of which was Martin Denny's "The Enchanted
Sea" and an album by the Waikiki Beach Boys. I was hooked.
Last year, I became part of the Lounge Comeback movement, and discovered
"Organs in Orbit." This is a part of my daily listening, and would be one of
the three things I'd take to a deserted island. (The other two things would be
a CD player and a power generator...)
A good friend of mine and I have wanted to start a lounge group, but we never
formalized it, so we've been limited to informal jam sessions of lounge
classics.
Among the instruments I play are the piano (never had the chance to do my
thing on a nice, authentic lounge organ, though!), drums, steel guitar and
theremin.....Which leads me to this: Anyone notice that the primary instrument
on Enchanted Farm by The Forbidden Five is a theremin, though it's not
mentioned in the liner notes?? I'd appreciate any info on the Forbidden Five
or their instrumentation (I haven't been able to find any of their music out
their, except for that one track.)
I look forward to some enlightening conversation on the list, and "thank you"
to Michele G. for letting me know about it!

If I recall rightly, The Eliminators (credited as Cyril Stapledon and
the Eliminators) appear on a Pye 60s multi-artist album "Top TV
Themes", with a version of the theme from "The Saint". I have no idea
if there was a separate album of their material; I suspect "The Saint"
was originally released as a single b/w "Staccato", but this is just a
guess.
Cyril Stapledon albums are usually pretty lame, IMHO, but watch out
for "Top Pop Instrumentals" on Decca Ace Of Clubs, which is fantastic,
and features a truly staggering version of the theme from "Dragnet".

KA-POW! Last night I heard my new copy of MOON GAS, DICK HYMAN! I thought
I had some Hyman faves, but I dunno, this might be the best!
Stellar-by-starlight-outerspace-exotica. I just did a web search for info
on the space nymph singer of the record, Mary Mayo, but found nothing! Did
she do other records, especially this celestial? What else can ya'll tell
me about her? Huh?

Again, I wish to respectfully disagree. While the LOST EPISODE , and the
BY POPULAR REQUEST cds, are no I COULD HAVE DANCED ALL NIGHT (heh, heh),
ok, they're no JUNGLE JAZZ, I do think for any serious Baxter collector
they are essential. They are just so dang cool, to hear some of those cuts
live, mit bird calls, and the charming voice of Les Baxter saying something
like "whenever I need new material, I turn to a Cole Porter song" or
something like that! Truly nice period pieces with some good performances.
So, Nathan, now you have a point-counterpoint opinion, and nobody got
slapped!

Just read the last Exotica mailings and decided to put my two cents in.
First, the Pixel 2000 camcorder was manufactured by Fisher Price in 1987.
It was around for a couple years then vanished without a trace. The target
audience were kids but the only ones who picked this up were artsy type
filmakers and curious types like myself. It really is cool. By the way
they have their own mailing list which can be found at

As far as +ACI-New+ACI- Lounge bands that have that old type sound.........
+ACI-WAKE UP+ACI- There isn't any. This is the 1990's, not the 50's or 60's.
There are a few that have tried to recreate that sound but the times have
changed and so has the instrumentation. They just don't make'em like they
use to. Your best and only chance of reliving this classic sound is to buy
the Original vinyl.
On a similiar note........
To Roy G Biv (hey, don't you own an art gallery), The best place to find
samples of exotic sounding instruments at least within a tight budget is
with original records. There is no substitute for that classic sound. My
band the +ACI-Weird Lovemakers+ACI- have taken this form of copyright infringment to
the extremes. We don't try to sound like anybody. We sound like everybody
on Acid. If anybody is interested yes we do have tapes available. Write to
me off list.

What makes a CD unplayable?
I may be wrong here but a scratch on the bottom isn't the main cause
of a disc not playing. I guess if it is deep enough it may affect the
reflective properties of the disc and it's playability but these
things are mighty resilient and the plastic bottom layer is thick enough
that the aluminum layer is well protected.
A bigger concern would be delamination of the aluminum layer, cracking
of the disc, discoloration, or bad encoding of the original, none of
which I can think could be repaired by any system I can imagine... Short
of copying the data off the bad disc using some hypersensitive machine
and re-recording onto a fresh CDR. I have one disc that has developed
an ugly dull surface coating on the playing side that does not
come off plus visible bubbles within the layers from delamination and
it still plays fine. Then I have a few home made numbers that still give
me trouble, and not a scratch to be found!
All this leads me to thinking that vinyl had it drawbacks... between skips,
pops, scratches, etc. .. but you could at least always manually play it!

I wish you could see this theater play that's taking place here in
Munich!
It's called "Time For Tomorrow" and is by a Gerhard St=E4bler, who seems
to have 4 CDs out. Laura of KBZ 200 did the choreography and also played
as "Miss Understood". Gordon W., the cook of the Shmaltzwald / KBZ200
CanadianartistsgrouplivinginBerlin, the ones who did these "Exotica
Trilogy" compilations, played an Indian hypnotist ("disciple of McRajah
Yogi") and a Tiki drummer (with a wonderful Mexican rubber sort-of-Tiki
mask) and talked a lot about Futurism while cooking. All in all 14
people (plus a hundred surprised guests) acted it out for about one and
a half hours (too short!).
The soundtrack was mostly handplayed by some musicians with additions of
well-known Exotica samples, very subtle and altogether very enchanting.
There was eating, there was smelling, light effects and sounds were
combined in a magic way, it was funny and had a surrealistic humor. I
liked it a lot. It was trippy, though we came sober.
Gordon W. calls it Futurism, but however, I've been waiting for this
kind of surrealistic entertainment for quite a while. The soundtrack is
available on CD.
We went again on Saturday with Sven Tiki who was visiting Munich for the
event. After the show there was a bit of a party, musically supported
by local Shmaltzers Captain Nemo and "Trade" Mark. After that we all
went to Trader Vic's to zip some Tiki Bowls and eat the Gardenia
blossoms floating on top of it.

I think you're nuts ;-) sending tape without any protection
around it? the jewel boxes break easily during transport, BUT
they're an extra protection against crushing; i once got a tape
in the mail that looked like a truck ran over it; the case was
in pieces, the body was severely damaged, BUT the tape was as
good as untouched.

Cocktails are classically defined as a beverage derived from a combination
of distilled alcohol, such as vodka or whiskey, with a mixer. The mixer can
be a very broad spectrum of fruit juices, sodas, liqueurs, vegetable juices,
and just about everything else under the sun. We have found these cocktails
to be one of the most difficult subjects for photomicrography (photography
with a microscope) that we have ever encountered. In our system, we must
crystallize or orient the sample so that polarized light will be refracted
as it passes through--giving us the beautiful patterns that we typically see
with this type of microscopy. Unfortunately getting pure tequila (or it's
counterparts) to crystallize has proven to be extremely difficult. Without
divulging all of our tricks, we have found methods (such as cooling with
liquid nitrogen) that can be used to force crystallization on the most
stubborn specimens. This gallery represents a significant part of our
efforts in this arena.
