Responding to the demand of Suzy Pearce , coordinator of the Middle
Power Initiative, seeking our reaction to US Senate refusal to ratify
the CTBT, we had already issued a Statement in Arabic language on the
basis of the following themes which reflect the general feelings of the
public in Egypt and possibly in other NNWSs :
1. The refusal of the US Senate to ratify the CTBT should be condemned
Its impact is detrimental, particularly in NNWSs where many will
question the credibility of the current non-proliferation system .
Practically, this refusal has leveled a blow at non-proliferation.
2. Doubts about the validity of non-proliferation system has been
further evolved in the Middle East (ME) where US Administration is
pursuing against Iraq and other countries of the region the policy of
counter proliferation by using or threatening to use military force
coupled with nuclear deterrence to prevent proliferation instead of
implementing in good faith article six of the non-proliferation Treaty.
3. Moreover, the people of the region are also concerned over the Lab
Tests conducted by US Administration to produce new types of nuclear
warheads including mini-nukes which could be used in regional and local
theaters in the ME and other regions.
4. With these policies together with the new plans to weaponise the
space US is becoming The Biggest Rouge State posing nuclear threats at
all peoples.
5. While the decision of the Senate differs from the current policy of
the Administration, yet it is actually and practically the net result of
all nuclear policies and strategies officially laid down by US , Senate,
Administration and both political parties .
6. Therefore, all efforts should be made to change the Senate decision
as a part of a package of measures leading to the elimination of all
nuclear weapons . Yes, the urgency to change the Senate decision should
be stressed while the dispute between the Senate and the Administration
should be intensively utilised to put an end to US nuclear policies,
otherwise the Clinton Administration, which is pursuing horrible
nuclear policies, will be turned (by NGOs) into a champion of nuclear
disarmament.

The defence is based on two matters:
Firstly the three accused consider Trident was being used illegally
based on an understanding on what international law said and on advice given
to them;
if they were right that the use and threat of nuclear weapons was illegal,
not just
possession, then they had a right given the enormity of the risks of nuclear
weapons
to try and do something to stop that illegality.
Secondly they had an absolute necessity, in which case it didn't matter
whether
Trident is illegal or not, the necessity was there.
In considering this I have really not a great deal to go on other than what
the
ICJ said in 1996 and their opinion, which although advisory, acknowledges in
words
what is authoritative and agreed by all. On the face of it
very careful consideration should be given to its terms.
In reaching their opinion the ICJ based the opinion on all the body of law
that
went before it which was carefully outlined. That law was canvassed in
court.
The opinion did not say possession of nuclear weapons was illegal,
nowhere does any law say that.
Even our own High Court of Judiciary has said that possession of nuclear
weapons is not itself illegal. They did not consider the law except
as far as it related to possession. The Helen John case can be
distinguished. Here there is a defence of international law and
necessity, but the whole defence hinges on the use made of nuclear
weapons now and the percieved threat or threats made by the nuclear
state. The use or threat of use, I would conceed that the ICJ did
not say that in all circumstances threat or use of nuclear weapons
was universally prohibited. Equally there no conventional law that
authorises
the threat or use of nuclear weapons.
They issued what may be considered an enigmatic decision which has been read
on a number of occassions "the threat or use of nuclear
weapons would be generally contrary to the rules and principles of
international law applicable in armed conflict and in particular the
principles and rules of humanitarian law. However, in view of the current
state
of international law and of the elements of fact at its disposal, the Court
cannot
conclude definitively whether the threat or use of nuclear weapons
would be lawful or unlawful in an extreme circumstance of
self-defence, in which the very survival of the State would be at
stake."
The last words are important. We do not know what they meant by generally,
but their final
conclusion implies that the use or threat could only apply in very
tight circumstances of sefl defence the very survival of the state.
The President of the ICJ said "I cannot overemphasise that the inability
of the court to go further than the formal pronouncement at which it has
arrived cannot in any way be interpreted as a half-open door to recognition
of the legality of the threat or use of nuclear armaments."
Also the way in which the judges voted showed that a majority voted
against the use of nuclear weapons. Lord Murray quote on this very helpful
given the status of Lord Murray:
"Turning to the central matter the judges were divided until the President's
casting
vote. The court decided that the threat or use of nuclear weapons is
unlawful under all
circumstances except last resort self-defence to avoid annihilation. Three
of the
judges dissenting took the opposite view to the other four dissenters. Four
said that
nuclear threat or use in not unlawful. The other three considered that
nuclear threat
or use is always unlawful. It follows that an absolute majority of 10 out
of 14 judged
that the threat or use of nuclear weapons is either entirely illegal or
generally
illegal subject to one possible exception. A two thirds majority rejected
the general
lawfulness of nuclear weapons."
I have the ividious task of deciding on international law as it relates to
nuclear weapons.
I am only a very junior sheriff without the wisdom or experience of those
above me. I have
a knowledge of the repercussions which could be far reaching. As a sheriff
I took an oath
to act without fear or favour in interpreting the law.
A point of international law has been raised here and I have to answer it.
I take comfort from the fact that there are other higher courts which can
rectify any
mistake.
In the absence of anything other than the ICJ and having regard to the
article by Lord
Murray, in particular the part relating to treaties and conventions ...
Lord Murrays article concludes "there then are the principles on which
the lawfulness of the proposed use of a particular weapons are to be
assessed .. to be noted that in so far as they consist of international
customary law they are part of the domestic laws of this country."
I listened carefully to Professor Boyle and have taken into account all the
evidence in this case from him and the other experts and in the
absence of any expert contradictory
evidence from the crown, I have to conclude that the three accused in
company with many others were justified in thinking that Great
Britain in their use of Trident, not simply possession, the use and
deployment of Trident allied with that use and deployment at times of
great unrest, coupled with a first strike policy and in the absence
of indication from any government official then or now that such use
fell into any strict category suggested suggested in the ICJ opinion
.. the threat or use of Trident could be construed as a threat, has
indeed been construed by others as a threat and as such is an
infringement of international and customary law.
The three took the view that if Trident is illegal, given the horrendous
nature
of nuclear weapons, they had the obligation in terms of
international law to do whatever little they could to stop the deployment
and use of nuclear weapons in situations which could be construed as
a threat.
It follows, if I consider that Angie Zelter, Ulla Roder and Ellen Moxley
were justified in the first leg of their defence and having given that
as the principle reason the crown has a duty to rebut that defence.
They have not done so and so I uphold the three defence submitions
in so far as they refer to malicious and willful damage.
I uphold the comments of Mr McLaughlin with regard to malice. Gordon
says "no act is punishable unless it is committed with a criminal
mind ..." I have heard nothing which would make it seem to me that
the accused acted with criminal intent Therefore I will instruct the
jury that they should acquit all three accused on charges 1 to 3
which leaves only the alternative in charge 4, they should also be
acquited on the first alternative in charge 4.
I anyone else takes such action they do so at their peril. The law
is not clear on nuclear arms. I may be totally wrong. If it goes to
appeal I may not be upheld and every case depends on whatever
circumstances. What I have said is with regard to the very special
circumstances of this trial and in the light of international tension
around June 8th.

This year's March for Peaceful Energy speakers will discuss serious
environmental problems related to the present nuclear and fossil fuel

Since before last year's MFPE event, a controversy has been brewing because
of its final speaker's message (Global Emergency Alert Response) for a
global-scale environmental emergency campaign to grow industrial hemp for
biofuels, and to preserve forests by using this more prolific source of
cellulose, to thereby help ameliorate global warming; and because of his
appeal for a $108 million per year "New-Energy Manhattan Project II"
emergency research and development project to complete engineering and
manufacturing of new devices to harness the Zero Point Energy properties of
the quantum vacuum as mentioned in DOE's 1998 new National Energy Policy
Plan (Comprehensive National Energy Strategy CNES) due to his public
comments on CNES, devices which some experts say will entirely replace
nuclear and fossil fuel power as well as most presently available
alternative energy technologies, some even offering methods to neutralize
radioactive wastes.
This controversy has lead to the decision, on behalf of scientists and
activists maligned by MFPE, to file a $108 million lawsuit against the
University of Maryland and its key MFPE organizers for libel and defamation
of character in connection with their thirteen month efforts to suppress
this New-Energy research information and to prevent the success of this
appeal.
Another result of this controversy is the (MFPE "spinoff") Rally to End

1) OUR GOAL: To create an active and well informed global constituency=20
dedicated to protecting space and the Earth from a space based arms race an=
d=20
ecological destruction.
2) BIG EARS: Europeans are becoming increasingly angry about the U.S. spy=
=20
base at Menwith Hill in the moors of northern England (Yorkshire). The bas=
e=20
with it=92s 27 giant golf ball like "radomes" is used to download informati=
on=20
from U.S. spy satellites and intercept communications. There is growing=20
evidence that the U.S. uses the base to spy on European governments,=20
businesses and citizens. For years the Menwith Hill Women=92s Peace Camp h=
as=20
had an active and on-going protest presence at the base. On October 14, 19=
99=20
a writ was issued in the High Court in London to seek an injunction to stop=
=20
the building of two new radomes at the spy base. In 1997 it was announced=
=20
that Menwith Hill would become the European Ground Relay Station for the=20
U.S.=92s Space-Based Infrared System (SBIRS) which will be part of the=20
Ballistic Missile Defense (BMD) system.
3) MILITARY SPACE FUNDING: The fiscal year 2000 Pentagon budget will brin=
g=20
whopping increases for military space projects. The House and Senate have=
=20
agreed to give funding hikes to the following programs: Space-Based Infrar=
ed=20
Satellite (SBIRS); Milstar Satellite; Space-Based Laser Project; National=
=20
Missile Defense Program; and the Navy Theater Missile Defense Project. =20
Overall the Pentagon budget is set to be over $288 billion in 2000. But=20
there is no money, we are told, for health care!
4) COMPUTER WARFARE: The U.S. military has recently acknowledged that it=
=20
used computer warfare against Yugoslavia last spring. The Space Command wa=
s=20
given the responsibility of coordinating attacks on "enemy" computer=20
networks. It is widely believed that the U.S. launched cyber attacks on=20
Yugoslavia=92s air defense network. The U.S. also mounted computer attacks=
on=20
foreign bank accounts held by Slobodan Milosevic and other Serbian leaders,=
=20
with the goal of draining their assets or altering banking records. In=20
future wars U.S. cyber warriors will try to disable air defense systems,=20
upset logistics and infect the software of rivals.
5) RENEGADE PENTAGON: The United States Congress recently discovered that=
=20
the Pentagon had been breaking the law and the Constitution by spending=20
hundreds of millions of dollars on military projects that lawmakers never=
=20
approved. Among the illegal projects were several "black," or secret, spac=
e=20
projects. The Air Force tried to buy an $800 million military satellite=20
without lawful authority and illegally spent millions of dollars on a Star=
=20
Wars missile defense program called "Meads" that Congress had cancelled. T=
he=20
Air Force said that it had not "misled" Congress and called the whole affai=
r=20
a "misunderstanding." If this had been a case of food stamp fraud people=
=20
would have gone to jail. Makes one realize that the Pentagon now has=20
essentially taken over the government.
6) BMD TEST & PROTESTS: On October 2 the Air Force launched it=92s first =
test=20
of the National Missile Defense (NMD) program from Vandenberg AFB in=20
California. The Global Network (GN) organized two protests at the base pri=
or=20
to the successful test. Activists from throughout Southern California join=
ed=20
GN Coordinator Bruce Gagnon at the base on September 25 and 29 for vigils. =
=20
There was extensive newspaper and TV coverage of the protests throughout th=
e=20
region. CBS Radio and CNN also interviewed Bruce about the protests. (Bru=
ce=20
also traveled to New York, Connecticut, Michigan and Ohio during this recen=
t=20
period on speaking events in opposition to the Star Wars program). =20
Originally there were to be 18 NMD tests from Vandenberg but the Air Force=
=20
recently changed the number to only three. The next tests are scheduled fo=
r=20
sometime in January and April of 2000.
7) WHAT IS BMD?: The Ballistic Missile Defense Organization (BMDO), the=
=20
Clinton successor to Star Wars, is made up of two key components. The=20
National Missile Defense (NMD) is the missile program to "protect" the Nort=
h=20
American continent from attack by so-called "rogue" nations. Once deployed=
,=20
over 100 interceptors will be located in Alaska and/or North Dakota. The=
=20
second program now underway is Theater Missile Defense (TMD). TMD is=20
intended to protect troops on the battlefield from missile attacks. The Ar=
my=20
and Navy are each running testing programs for the TMD system. The Army=92=
s=20
program, called THAAD, tested at White Sands in New Mexico and has recently=
=20
had two successful tests after a string of six failures. (A top Pentagon=
=20
official has called the two recent successful THAAD tests "highly scripted.=
")=20
The Navy program tests the theater missile from ships and is competing to =
be=20
the premier supplier of TMD launching for the Pentagon. Since there is onl=
y=20
money for one TMD system, a decision will be made in December on either the=
=20
Army or Navy. (Maybe they will just pick the winner of the annual Army-Nav=
y=20
football game.)
8) JUNE NMD DECISION: In June, 2000 President Clinton is expected to give=
=20
the final go-ahead to the Pentagon to begin deployment of the NMD system. =
=20
The deployment of NMD will violate the ABM Treaty of 1972 and the 1967 U.N=
=2E=20
Outer Space Treaty. The U.S. has already begun negotiations with Russia in=
=20
hopes of "renegotiating" the ABM Treaty. The Clinton administration is=20
offering to build the Russians a new missile-tracking radar facility if the=
y=20
will "consent" to U.S. BMD deployment. Pressure must be created globally o=
n=20
Clinton to stop this dangerous step toward a new arms race in space. With=
=20
the recent rejection of the Comprehensive Test Ban Treaty, and now movement=
=20
toward Star Wars, the peace movement must react strongly and quickly. Plea=
se=20
help organize people in your community to contact Clinton and Congress befo=
re=20
the June, 2000 deadline. Protests in your communities would be useful as=
=20
well.
9) BMD - OFFENSE OR DEFENSE?: The U.S. sells the BMD system as "defensive=
=2E"=20
The Space Command, committed to space "control and domination," has other=
=20
plans. BMD is truly a Trojan horse, a way to get public support for the=20
deployment of offensive weapons in space. Gen. Lester Lyles, Vice-Chief of=
=20
Staff of the Air Force recently stated that, "Space control and all of its=
=20
capabilities and ramifications, I think, are going to grow=20
exponentially=85Ultimately, you can see the Air Force deploying systems tha=
t=20
can deny space capabilities to our enemies. Systems like the Space-Based=
=20
Laser, which we are currently trying to develop and demonstrate=85" The=20
offensive Space-Based Laser now being developed by TRW, Boeing and Lockheed=
=20
Martin will be the follow-on technology to the BMD Trojan horse.
10) LASER TESTS: For the first time in the history of military weaponry, =
a=20
laser beam was fired and struck a satellite in space. On October 16 the=20
MIRCL laser at White Sands Test Range in New Mexico was fired at an Air For=
ce=20
research satellite. Other space laser tests are on-going at TRW=92s Capist=
rano=20
Test Site, near San Clemente, California. While calling these tests part o=
f=20
the "defensive" BMD program, it is clear that the intended use of the=20
Space-Based Laser will be for "offensive" war fighting in space.
11) INT=92L BMD PARTNERS: Japan and Israel are now deeply involved in the=
=20
U.S. BMD program. Japan is assisting with funding of the TMD system and is=
=20
reportedly interested in the sea-based missile defense program and has=20
already acquired several Aegis radar-equipped cruisers which are the=20
foundation of the Navy TMD program. Israel is working with the Army at Whi=
te=20
Sands to develop a laser system for theater defense.
12) GN APRIL, 2000 EVENTS: In order to build pressure on President Clinto=
n=20
and Congress (who voted in favor of BMD on May 20 by 345-71), the Global=20
Network will hold four days of protest activity in Washington DC on April=
=20
14-17, 2000. Events will include a demonstration at the Treasury Departmen=
t=20
to make the point about wasted tax dollars on Star Wars development (April=
=20
14); an International Conference on the Prevention of an Arms Race in Space=
=20
(April 15); a global space strategy meeting (April 16); and a keep space fo=
r=20
peace lobby day (April 17). We urge local organizations to begin discussin=
g=20
sending delegations from their communities to these events. A large group =
of=20
activists will be coming to the DC protests from overseas.
13) ISS PRIVATIZATION: NASA is now looking for someone in private industr=
y=20
to take over the International Space Station (ISS) within the next 10 years=
=2E =20
NASA administrator Daniel Goldin recently stated that, "The government woul=
d=20
become just one of many tenants and users of the station." Originally set =
to=20
cost taxpayers $10 billion to construct and deploy, the ISS is now up to $1=
00=20
billion and growing.
14) MIR TO FALL BACK: The 13-year old Russian space station Mir is slated=
=20
for "descent" in February or March of 2000. Because of its size, parts of=
=20
Mir are likely to survive the fiery fall through the atmosphere and hit=20
Earth. NASA is closely following the Mir story in hopes of learning how to=
=20
handle the ISS when it is "deorbited" in the future. Also expected to fall=
=20
back to Earth in coming years are several Russian satellites with nuclear=
=20
power sources on board.
15) MOON RETURN: The competition for manned missions to the moon or Mars =
is=20
heating up. "The moon is our future," says former astronaut John Young. =
=20
Each of the two planetary bodies now has it=92s own lobbying group. The=20
presence of helium-3 on the moon is creating great interest as a source of=
=20
power for nuclear fusion. Efforts are now underway to circumvent the U.N.=
=20
Moon Treaty that does not allow for individual or corporate land claims. =
=20
Former astronaut Young and others within the U.S. military, have also state=
d=20
that U.S. bases on the moon will be useful for "planetary defense."
16) MARS ORBITER LOST: On September 23 NASA=92s Mars Climate Orbiter, at =
the=20
cost of $123 million, was lost during orbital "injection" due to human=20
failure. This accident came on the heels of the successful Cassini plutoni=
um=20
fly-by of Earth and made a mockery of NASA=92s claim that orbital fly-by=20
accidents are a 1-in-a-million chance. In fact at the end of National Publ=
ic=20
Radio=92s (NPR) coverage of the Mars accident, the reporter asked the big=
=20
question. "What if this had happened with Cassini with its 72.3 pounds of=
=20
plutonium?" Some researchers suggest that the error is a result of NASA=92=
s=20
policy of "faster, better, cheaper" missions. NASA=92s previous Mars misha=
p,=20
the loss of the $1 billion Mars Observor in 1993, was instrumental in causi=
ng=20
the switch to more frequent, cheaper missions. On December 3, 1999 the Mar=
s=20
Polar Lander is set to touch down on the Red planet. There are growing=20
questions about the total cost of this series of Mars missions. Recently,=
=20
Space News reported that early estimates begin at $400 billion for the tota=
l=20
Mars program. In order to promote the Mars series, NASA has begun renovati=
ng=20
their Kennedy Space Center tourist facility (4 =BD million visitors per yea=
r)=20
with a Mars theme. In addition, a series of Mars movies will be coming out=
=20
in 2000-2001 to sell the program. Filmmaker James Cameron recently told a=
=20
Mars Society conference that "I want to make humans-to-Mars real in the min=
ds=20
of the viewing public." He said that he hopes to help create a ground-swel=
l=20
for increased NASA funding. (And for the aerospace industry, too, we might=
=20
add.)
17) PIZZA HUT ADVERTISES: Expecting 500 million TV viewers to witness a=
=20
launch was too much for Pizza Hut to resist. They are putting their=20
corporate logo on an unmanned Proton rocket that will launch the living=20
quarters of the ISS. The 200-foot rocket will carry a 30-foot Pizza Hut=20
logo. "This is one small step for mankind, but one giant leap for our Pizz=
a=20
Hut turnaround," the company said in a statement. =20
18) UNCOPUOUS: December will be the 40th Anniversary of the U.N. Committe=
e=20
on Peaceful Uses of Outer Space (UNCOPUOUS). The GN is urging people to=20
