  21. EXTENDING THE CONSTITUTION TO AMERICAN CYBERSPACE:

  23. TO ESTABLISH CONSTITUTIONAL PROTECTION FOR ELECTRONIC MEDIA AND TO
  24. OBTAIN REDRESS FOR AN UNLAWFUL SEARCH, SEIZURE, AND PRIOR RESTRAINT
  25. ON PUBLICATION, STEVE JACKSON GAMES AND THE ELECTRONIC FRONTIER
  26. FOUNDATION TODAY FILED A CIVIL SUIT AGAINST THE UNITED STATES SECRET
  27. SERVICE AND OTHERS.

  29.     On March 1, 1990, the United States Secret Service nearly
  30. destroyed Steve Jackson Games (SJG), an award-winning publishing
  31. business in Austin, Texas.
  32.     In an early morning raid with an unlawful and
  33. unconstitutional warrant, agents of the Secret Service conducted a
  34. search of the SJG office.  When they left they took a manuscript
  35. being prepared for publication, private electronic mail, and several
  36. computers, including the hardware and software of the SJG Computer
  37. Bulletin Board System.  Yet Jackson and his business were not only
  38. innocent of any crime, but never suspects in the first place.  The
  39. raid had been staged on the unfounded suspicion that somewhere in
  40. Jackson's office there "might be" a document compromising the
  41. security of the 911 telephone system.
  42.     In the months that followed,
  43. Jackson saw the business he had built up over many years dragged to
  44. the edge of bankruptcy. SJG was a successful and prestigious
  45. publisher of books and other materials used in adventure role-playing
  46. games.  Jackson also operated a computer bulletin board system (BBS)
  47. to communicate with his customers and writers and obtain feedback and
  48. suggestions on new gaming ideas.  The bulletin board was also the
  49. repository of private electronic mail belonging to several of its
  50. users.  This private mail was seized in the raid.  Despite repeated
  51. requests for the return of his manuscripts and equipment, the Secret
  52. Service has refused to comply fully.
  53.     Today, more than a year after that raid, The Electronic
  54. Frontier Foundation, acting with SJG owner Steve Jackson, has filed
  55. a precedent setting civil suit against the
  56. United States Secret Service, Secret Service Agents Timothy Foley and
  57. Barbara Golden, Assistant United States Attorney William Cook, and
  58. Henry Kluepfel.
  59.     "This is the most important case brought to date,"
  60. said EFF general counsel Mike Godwin, "to vindicate the
  61. Constitutional rights of the users of computer-based communications
  62. technology.  It will establish the Constitutional dimension of
  63. electronic expression.  It also will be one of the first cases that
  64. invokes the Electronic Communications and Privacy Act as a shield and
  65. not as a sword -- an act that guarantees users of this digital
  66. medium the same privacy protections enjoyed by those who use the
  67. telephone and the U.S. Mail."
